Jan 1840 Rio de Janeiro, following the arrest of the slave ship Congresso on 17th inst. the Nova Piedade is noted as being used as a receiving and prison ship by the British anti-slavery vessels on the on the South America station, some of the crew of the Congresso being accommodated on this vessel, when the Congresso and the remainder of her crew were taken to the Cape of Good Hope to be dealt with by the Vice-Admiralty Court.

On or shortly after 30 Jan 1840, when the slave vessel Sandade was arrested by the Fawn, a part of her crew were probably put on board as the rest of them were taken in the Sandade to the Cape of Good Hope to appear as witnesses in front of the Vice Admiralty Court adjudicating the vessel following her arrest for being fitted out as a slave vessel.

Some days prior to the 17 Feb 1840, the Rose arrived at Rio de Janeiro from Santa Cruz, with her arrival apparently thwarting an attempt by Portuguese slave traders making an attempt to cut out the hulk Nova Piedade from the harbour at Rio de Janeiro with a view to releasing from of the prisoners from slave ships held on board.
