An Act for establishing a more easy and expeditious Method for the punctual and frequent Payment of the Wages and Pay of certain Officers belonging to His Majesty's Navy.

Instructions for the more effectually carrying into Execution, and for the due Observance of the Privileges of an Act of the Thirty-fifth of George the Third, entitled, "An Act for establishing a more easy and expeditious Method for the punctual and frequent Payment of the Wages and Pay of certain Officers belonging to His Majesty's Navy," dated 22nd June, 1795.
I. A Commissioned Officer, Master, or Surgeon, may on appointment to a Ship from half pay, apply to the Commissioners of His Majesty's Navy, for an Order from them on the Treasurer of the Navy, to pay such Officer the Arrears of half-pay due to him up to the Day of his commencing full-pay when the Commissioners, being satisfied as to the appointment, and that no imprest stands against his wages, will grant an order for the payment of the arrears of half-pay appearing to be due, which the Act of Parliament says shall be paid at the Pay-Office of the Treasurer of the Navy.
II. A Commissioned Officer, Master or Surgeon may also, on being appointed to a Ship from half-pay, apply to the Commissioners of the Navy for an order from them (or the Commissioner at the Port where the Ship may be) on the Treasurer of the Navy, to pay such Officer the Amount of three months net personal pay, which will be accordingly granted, provided no imprest stands against his wages, and he transmits along with his application, a certificate of the Day he is entitled to commence full-pay, but no Officer is authorised to draw a bill for pay in advance, nor can any Officer be allowed three months full pay in advance, whose name does not appear on the half-pay list previous to the time of his appointment.
III, Commissioned Officers, Masters and Surgeons, commanding or serving in any of His Majesty's Ships, and entitled to the pay of such service may at the end of three, six, or twelve Lunar Months, draw Bills on the Commissioners of the Navy for the Amount of the net personal pay due for the time, which Bill, if drawn by a Lieutenant, Master, or Surgeon, must be "approved" by the Captain or Commander, in testimony of his knowledge of such pay being justly entitled to be drawn for : and Commanding Officers are particularly enjoined not to approve any Bill, unless the same is previously dated whence and when drawn, also filled and signed; and are also desired to be careful that their own Bills are complete in these particulars previous to their being negotiated.
IV. A Lieutenant, Master, or Surgeon being sent to sick quarters, who may be desirous of drawing for Pay up to the end of the six weeks allowed, provided be remains so long at sick quarters, must be careful to take with him, the time he is entitled to pay up to the day of his going sick, certified by his Commanding Officer ; he must also have annexed thereto a Certificate under the hands of the Physician or Surgeon of the hospital or sick quarter, of his remaining under cure ; otherwise no Captain is authorized to approve the bill that may be drawn, nor can such bill, if defective in any of these particulars, be accepted and assigned for payment.
V. No Officer whose command ceases, nor any Lieutenant, Master, or Surgeon, who is superseded or discharged by reason of a Ship's being paid off or lost, is entitled to draw bills for personal pay up to the day of being put upon half pay of ceasing to be entitled to pay for the Ship or service, but is required forthwith to transmit vouchers or journals for passing his accounts, when the usual certificate being granted of no objection to such Officer receiving his wages, his full pay and compensation will be ascertained thereon, (including any additional pay allowed by reason of a flag having been flying on board the Ship) the sums that may have been drawn for will be abated therefrom, and the residue of pay immediately assigned for payment at the office of the Treasurer of the Navy in town, but which may be paid at any of the out-ports where the Officer may himself be desirous of receiving the same.
VI. The bills drawn for pay by any Officer will remain as a charge (or imprest) against him till his accounts or journals for the Ship are past, and any Officer transmitting vouchers or journals for passing an account to any specific time is there-after to draw bills for pay for a subsequent time only.
VII. By His Majesty's Order in Council of the 15th June, 1796, Chaplains of His Majesty's Ships may draw bills for their personal pay, and two-thirds of four-pences under the regulations prescribed by the act of parliament.
