Captain of the Fleet.

Article I
EVERY Commander in Chief, who shall have under his Command Ten of His Majesty's Ship of the Line, shall be entitled to have a Captain of the Fleet to assist him in regulating the details of the Fleet, in making the necessary distribution of Men, Stores, and Provisions, and in such other duties as he shall think fit to direct. A Captain of the Fleet to be allowed to a Commander in chief having under his command Ten Sail of the Line.
Article II
The Captain of the Fleet may be either a Flag Officer, or one of the senior Captains of the Navy ; if he be a Flag Officer, he is on all occasions to rank with the Flag Officers of the Fleet, as the date of his Commission shall entitle him ; but if he be a Captain, he is to rank next after the junior Rear Admiral, and is to have the pay, and compensation for the servants, of a Rear Admiral. Captain of the Fleet may be either a Flag Officer or one of the Senior Captains of the Navy. How he is to rank.

Article III
The Captain of the Fleet is to be borne, with two servants which will be allowed him provided they be on board, as Supernumeraries on the Ship's books which carries the Flag of the Commander in Chief. Captains of the Fleet and retinue to be borne as supernumeraries on board the Ship carrying the Flag of the Commander in Chief.
Article IV
After a Captain of the Fleet shall have been appointed, although, by the loss of any of the Ships, or by other accidents, or by detachments being made by the Commander in Chief, the Fleet shall be reduced to a number of Ships of the line less than ten, the Captain of the Fleet shall retain his situation with all the authority and emoluments attached to it, until the pleasure of the Lords Commissioners of the Admiralty shall be known; but if the Fleet be reduced to a number less than Ten by the Orders of the Admiralty, the functions of the Captain of the Fleet, and all the emoluments annexed to his station, shall immediately cease. Captain of the Fleet to retain the situation although the number of Ships be reduced to less than Ten ; except to reduced by the orders of the Admiralty.
Article V
All Orders or Instructions issued by the Captain of the Fleet are to be given as the Orders, &c. of the Commander in Chief; and they are to be obeyed by all persons to whom they are addressed, as well by those who are senior to, or of higher rank than, the Captain of the Fleet, as by others. But he is never to issue an order for any general regulation, nor to make any change in the arrangement of the Fleet, without directions from the Commander in Chief; nor to alter, without his permission, the temporary position of the Fleet, by Signal or otherwise, unless some evident necessity require it. All Orders and Instructions to be issued by the Captain of the Fleet as the Orders &c. of the Commander in Chief, and never without his directions.

Article VI
Returns of the state and condition of the Ships, applications for their being repaired or refitted, or for supply of Stores or Provisions, which the Commanders of Squadrons and Divisions may not be authorized to order; and in general all reports relating to the equipment of Ships, the state of their discipline and their fitness or unfitness for Service; are to be transmitted to the Captain of the Fleet, to be by him laid before the Commander in Chief. Returns of the state and condition of Ships applications for Stores, reports, &c., to be transmitted to the Captain of the Fleet.
Article VII
If the Commander in Chief shall die, or shall give up his Command, the Captain of the Fleet is to preserve his situation under the Officer who succeeds to the Chief command, if there be a Flag Officer senior to him in the Fleet; but if he be the Officer next in rank to the Commander in Chief, he is, on such death or resignation, to hoist his Flag and take the command of the Fleet, and he may appoint such Officer as he shall think proper to act as Captain of the Fleet until the pleasure of the Lords Commissioners of the Admiralty shall be known, observing that such Officer must be one of the Flag Officers, or one of the senior Captains in the Fleet, who shall be willing to accept of the appointment. Captain of the Fleet to preserve his situation if the Commander in Chief shall die or resign, and to succeed to the command, if next in rank to the Commander in Chief, and to appoint another Captain of the Fleet.

Article VIII
A Commander in Chief shall not order the Captain of the Fleet to hoist his Flag, nor remove him from his situation for any other purpose, without orders from the Lords Commissioners of the Admiralty. But if the Captain of the Fleet shall die, or shall, on account of his health, be under the necessity of leaving the Fleet, the Commander in Chief is to appoint one of the Flag Officers under his command, or one of the senior Captains willing to accept of such appointment, to act as Captain of the Fleet until the pleasure of the Lords Commissioners of the Admiralty shall be known, and such Officer, so appointed, shall enjoy all the rank, authority and emoluments of Captain of the Fleet as long, as he shall continue to act. Commander in Chief not to remove the Captain of the Fleet without orders from the Admiralty.

Captain of the Fleet dying or being under the necessity of leaving the Fleet ; Commander in Chief to appoint another.

Article IX
The Captain of the Fleet is to keep a journal of the proceedings of the Fleet, according to the form given for the Commander in Chief, which is to he sent at the end of every three Months to the Secretary of the Admiralty. Captain of the Fleet to keep a journal which is to be sent at the end of every three months to the Admiral.
