Experimental Service Pensions

Present: The KING's Most Excellent Majesty in Council.
Whereas there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the eighth day of July, one thousand nine hundred and seven, in the words following, viz.:-
Whereas by Section 3 of the Naval and Marine Pay and Pensions Act, 1865, it is enacted, inter alia, that all pay, pensions and other allowances in the nature thereof payable in respect of services in Your Majesty's Naval or Royal Marine Forces to a person being or having been an Officer, seaman or marine therein, shall be paid in such manner, and subject to such restrictions conditions, and provisions, as are from time to time directed by Order in Council.
And whereas under Your Majesty's Royal Warrant of 1906, Officers of Your Majesty's Army Retired whilst serving in Army Ordinance Factories receive certain increases of retired pay, and whereas we are of opinion that similar provision should be made for Officers of Your Majesty's Navy appointed to posts in the Inspection and Experimental Departments, or to posts at the Admiralty connected with those departments, if the latter are subsequently created ;
We beg leave humbly to recommend that Your Majesty may be graciously pleased by Your Order in Council to sanction the following regulations for increases of retired pay of Officers of Your Majesty's Navy who are placed on the Retired List whilst serving on the staff of the Inspection and Experimental Departments or in posts at the Admiralty connected with those departments:-
- If an Officer is discharged to retired pay at his own request or on completion of any period for which he may have been appointed, or as unfit for further employment from other cause than age, medical unfitness, or misconduct, his retired pay should be increased by one-sixtieth of the pay and allowances of the appointment for each complete year of service.
- If discharged to retired pay on account of age, medical unfitness, abolition of office, or reduction or reorganisation of establishment.
- With ten or more years service after date of retirement from Your Majesty's Navy his retired pay should be increased by one-sixtieth of the pay and allowances of the appointment for each complete year of service;
- With less than ten rears service after such date the increase should be at the rate of one-fiftieth of the pay and allowances of the appointment, provided that the total addition shall not exceed ten-sixtieths of such pay and allowances.
The Lords Commissioners of Your Majesty's Treasury have signified their concurrence in these proposals.
His Majesty having taken the said Memorial into consideration, was pleased, by and with the advice of His Privy Council, to approve of what is therein proposed. And the Right Honourable the Lords Commissioners of the Admiralty are to give the necessary directions herein accordingly.

Retired Officers working for the Admiralty - Experimental Departments
And whereas we consider it desirable that Naval Officers who may be placed on the Retired List whilst holding the appointment of Superintendent or Assistant Superintendent of the Torpedo Factory which is now situated at Woolwich, and is shortly to be established at Greenock, should be granted the benefit of the provisions of His late Majesty's Order in Council dated the twelfth day of August, one thousand nine hundred and seven, relative to increase of Retired Pay to Naval Officers serving on the Staff of the Inspection and Experimental Departments or in posts at the Admiralty connected with those Departments:
We beg leave humbly to recommend that Your Majesty may be graciously pleased by Your Order in Council to sanction as from 1st June, 1910, the following regulations for increases of Retired Pay of Officers of Your Majesty's Navy who are placed on the Retired List whilst serving as Superintendent or Assistant Superintendent of the Torpedo Factory:

Retired Royal Marines Officers working for the Admiralty Experimental Departments
At the Court at Buckingham Palace, the 28th day of November, 1910.

Whereas there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 7th day of November, 1910, in the words following, viz.:-
Whereas by section 3 of the Naval and Marine Pay and Pensions Act, 1865, etc,
And whereas by His late Majesty's Order in Council, bearing date the twelfth day of August, 1907, provision is made for an increase of the retired pay of Naval Officers who are placed on the Retired List whilst serving on the staff of the Inspection and Experimental Departments or in posts at the Admiralty connected with those Departments :
And whereas we are of opinion that rules should be framed to govern the employment in such appointments of Officers of Your Majesty's Corps of Royal Marines :
We beg leave humbly to recommend that Your Majesty may be graciously pleased by Your Order in Council to sanction the following regulations:
- Officers of the Royal Marines to be eligible equally with Officers of the Royal Navy for appointment to posts in the Inspection and Experimental Departments, and to posts. at the Admiralty connected with those Departments :
- Royal Marine Officers so appointed to be seconded for 'such duties under the same conditions as apply to Officers seconded for duty in the Army Ordnance Department, and if retained permanently to remain seconded until they reach the rank of Lieutenant-Colonel, when they should - become supernumerary, being subject to the same rules as regards qualification for promotion and retirement for age in any rank as other Officers of the Royal Marines
- Royal Marine Officers so employed to be retired, in any event, on completing six years' service as Lieutenant-Colonel:
- Royal Marine Officers permanently retained for Inspection and Experimental duties not to be at liberty to retire until they have sufficient service to qualify them for retired pay : and in the event of retirement from the Active List to be eligible for the same benefits as have been conferred on Naval Officers by His late Majesty's Order in Council of the twelfth day of August, 1907, payment of retired pay being suspended during employment. Provided always that such Officers as may be retained in the Naval Ordnance Department after being placed on the Retired List with retired pay of over �300 per annum, shall not be eligible for those benefits:
The Lords Commissions of. Your Majesty's Treasury have signified their concurrence in these proposals.
His Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of His Privy Council, to approve of what is therein proposed. And the Right Honourable the Lords Commissioners of the Admiralty are to give the necessary directions herein accordingly.

And whereas we consider it desirable that any retired Officer of the Royal Navy or Royal Marines who may be appointed to the experimental staff, H.M. S. 'Excellent' should be subject to the provisions of Your Majesty's Order in Council 13 December, 1921, relative to the counting of service (after retirement) in the Inspection, Experimental and Compass Departments in the Admiralty for increase of retired pay:
And whereas under the provisions of Your Majesty's Order in Council of 14 July, 1922, certain Officers have been allowed to retire from the Active Lists of the Royal Navy and Royal Marines with rates of retired pay higher than those permissible under ordinary regulations for Officers of like age, rank and service and have nevertheless been retained for further service in the Inspection, Experimental and Compass Departments of the Admiralty:
And whereas we are of opinion that in such cases some modification is necessary in the conditions under which Officers serving in these appointments are permitted to count service after retirement from the Active List for increase of retired pay under the provisions of Your Majesty's Order in Council 13 December, 1921:
We beg leave humbly to recommend that Your Majesty may be graciously pleased, by Your Order in Council,
- to sanction the addition of the posts on the experimental staff, H.M.S. 'Excellent' to the list of appointments to which the provisions of Your Order dated the 13 December, 1921, apply, and
- to direct that the retired pay of any Officer who has been, or may hereafter be, retired from the Active List of the Royal Navy or Royal Marines with a special rate of retired pay higher than that permissible under the ordinary regulations in force at the date of retirement for an Officer of like age, rank and service and who has been, or may hereafter be, either retained in, or appointed to, a post to which Your Order in Council dated the 13th December, 1921, as amended or extended by any subsequent Order, may apply, shall not on the final cessation of his service in any of the appointments in that Order referred to, exceed the greater of the two following sums:
- the retired pay for which he would have been eligible had he on retirement from the Active List of the Royal Navy or Royal Marines been awarded the rate of retired pay permissible under the ordinary regulations in force at the date of such retirement for an Officer of like age, rank and service and permitted to count the whole of his subsequent service for increase of retired pay under Your aforesaid Order dated the 13th December, 1921, or
- the actual rate of retired pay awarded to him on retirement from the Active List without any addition for subsequent service.
