(Reflecting a Decrease in Salary of 5� per cent.)

Present, The King's Most Excellent Majesty in Council.

Whereas there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 14th day of. December, 1925 (C.W. 4967/25), in the words following, viz. :

Whereas by Section 3 of the Naval and Marine Pay and Pensions Act, 1865, it is enacted, inter alia, that all pay, pensions, or other allowances in the nature thereof payable in respect of services in Your Majesty's Naval or Marine Force to a person being or having been an Officer, Seaman, or Marine therein, shall be paid in such manner and subject to such restrictions, conditions and provisions as are from time to time directed by Order in Council:

And whereas by Section 2 of the Officers of Royal Naval Reserve Act, 1863, it is enacted, inter alia, that the Admiralty may enrol Officers of the Reserve to the Royal Navy under, and subject to, such Rules, Orders and Regulations as the Admiralty may, with the consent of Your Majesty in Council, from time to time establish:

And whereas by the Naval Forces Act, 1903, it is enacted that the Admiralty shall have power to raise and maintain a Force to be called the Royal Naval Volunteer Reserve, and that any Volunteer enrolled under this Act, when serving for training afloat or called out for actual service shall be deemed to be serving in Your Majesty's Naval or Marine Force within the meaning of the Naval and Marine Pay and Pensions Act, 1865:

And whereas by clause 9 of Section X of Schedule V to Your Order in Council bearing date the 22nd day of January, 1920, and by certain subsequent Orders, Your Majesty was graciously pleased to direct that the rates of full pay, unemployed pay, half pay, retired pay and gratuities authorized therein for Officers of Your Majesty's Naval, Marine, Naval Reserve and Naval Volunteer Reserve Forces should be subject to revision on or after the 1st day of July, 1924:

And whereas we are of opinion that all rates of full pay, unemployed pay, half pay and retired pay duly authorized and in course of payment on the 30th day of June, 1924, to such Officers (hereinafter referred to and denoted as �standard rates') should, except as otherwise provided in the Schedule attached hereto, be reduced by approximately five and one half per cent. with effect from the 1st day of July, 1924, and that a corresponding reduction should be made with effect from the same date in certain allowances (namely those referred to in the Schedule attached) payable to such Officers:

And whereas we are further of opinion that revised standard rates of full pay, unemployed pay and half pay should be instituted for certain Officers of Your Majesty's Naval, Marine, Naval Reserve and Naval Volunteer Reserve Forces who enter the Service, or are promoted to certain ranks or are granted certain commissions as specified in paragraph 4 of Part I of the Schedule attached hereto on or after the 5th October, 1925, and that such revised rates should be comparable with the standard rates authorized by Your Majesty's Order in Council of the 22nd January, 1920, and subsequent Orders in Council, and should be subject to revision on the same dates and in the same manner, as prescribed in the Schedule to this Order:

We beg leave humbly to recommend that Your Majesty may be graciously pleased, by Your Order in Council, to establish:-

  1. Revised rates of full pay, unemployed pay, half pay, and certain allowances for Officers of Your Majesty's Naval, Marine, Naval Reserve and Naval Volunteer Reserve Forces generally (hereinafter referred to and denoted as 'current rates ') with effect from the 1st July, 1924:
  2. Revised standard rates of full pay, unemployed pay and half pay for the Officers specified in paragraph 4 of Section 1, of the Schedule attached hereto, and that such rates shall be reduced by approximately five and one half per cent. to the rates shown in the Schedule to this Order, and hereinafter referred to and denoted as �current rates,' with effect from the 5th day of October, 1925:
  3. The revised rules for computing the retired pay of Officers of Your Majesty's Naval and Marine Forces set forth in the attached Schedule with effect from the 1st day of July, 1924, and in substitution for the corresponding rates and rules in force prior to that date:
  4. That the current rates and revised rules prescribed by this Order shall be subject to further review on or after the 1st day of July, 1927:

Provided that nothing in this Order shall be taken to modify in any way the regulations or conditions governing the payment of any emolument mentioned therein, but only the amount thereof.

The Lords Commissioners of Your Majesty's Treasury have signified their concurrence in this proposal.

Schedule.

Section I - General.

  1. In this Schedule the term �standard rate' or �standard scale' denotes the rate of full pay, unemployed pay, half pay, or allowance, or the scale of retired pay, as the case may be, duly authorized for Officers of the rank or ranks specified on the 30th day of June, 1924, or rates subsequently established by this or other Order as being comparable with those established by Order in Council of the 22nd January, 1920, and being subject to revision at the same dates and in the same manner; likewise the term �current rate' denotes the corresponding rate of full pay, unemployed pay, half pay, or allowance, as the case may be, applicable with effect as from the 1st day of July, 1924, in substitution for the aforesaid standard rates; or to be introduced on or after the 5th October, 1925, for certain Officers entered, promoted to certain ranks or granted certain commissions as specified in paragraph 4 of this Section on or after that date.
  2. The aforesaid �current rates' are to be subject to further review on or after the 1st day of July, 1927.
  3. The �current rates� of full pay shown in Sections II and III of this Schedule are to apply also in accordance with their several ranks, and subject to the Regulations governing their service, to Officers of the Royal Naval Reserve, Royal Naval Volunteer Reserve, Special Reserve of Engineer Officers, R.N., and Special Reserve of Officers, R.M., whilst serving or training in H.M. Ships or Establishments, or whilst called out for actual service in war or emergency.
  4. The �standard ' and �current ' rates of full pay, unemployed pay and half pay shown in, Sections III, VI, clause (ii), and VII, Part II, respectively, of this Schedule are to apply to Officers of the Royal Navy and Royal Marines of the ranks specified therein who enter the Service on or after the 5th October, 1925, (including Naval Cadets who have not passed out of the R.N. College, Dartmouth, before the 5th October, 1925,) or are promoted to Mate or Mate (E), of are granted a Commission in the Royal Marines under Order in Council of the 11th February, 1913, Clause 1, on or after 5th October, 1925. They will not apply to Special Entry Cadets, Naval Cadets from Mercantile Marine Training Establishments, Paymaster Cadets and Probationary Officers, Royal Marines entered direct by examination whose date of entry was prior to 5th October, 1925. The rates of full pay shown in Section III will also apply to Officers of the Royal Naval Reserve and Royal Naval Volunteer Reserve entered or re-entered on the permanent lists of these Reserves on or after the 5th October, 1925, and to Officers entered or re-entered in the Special Reserve of Royal Marines on or after that date when undergoing training or being otherwise eligible for full pay, but will not apply to Officers of the Royal Naval Reserve, Royal Naval Volunteer Reserve and Special Reserve of Royal Marines entered as Probationary Officers before that date.
  5. The rates shown in this Schedule are daily rates unless otherwise specified.

Section VIII

Revised rules for computing the retired pay of retired Officers of the Royal Navy and Royal Marines.

  1. Subject to the exceptions stated in the second paragraph below, the revised rules in paragraph 3 of this Section shall apply to all rates of retired pay of Officers of the Royal Navy and Royal. Marines authorized by Order in Council of the 22nd January, 1920, and subsequent Orders, and, subject to the same exceptions, shall apply to the retired pay of all Officers in receipt of such rates and with effect from the 1st day of July, 1924.
  2. The revised rules of this Section shall not apply to:
  1. Retired pay reckoned at rates which were established prior to Order in Council of the 22nd January, 1920.
  2. Retired pay granted to certain Officers retired under the provisions of the Special Retirement Schemes sanctioned by Orders in Council of the 14th July, 1922, and 16th January, 1924, i.e. those whose retired pay was therein specifically exempted from subsequent reduction.
  3. Additional retired pay for disablement, and except as provided in paragraph 3 (c) below, disability retired pay awarded under the provisions of Order in Council of the 11th October, 1923.
  4. Pensions for wounds and other injuries awarded under the provisions of Chapter LII, King's Regulations and Admiralty Instructions.
  1. Revised Rules.
    1. Retired pay reckoned at the Officer's half pay rate:
    2. In such cases the revised rates of half pay shown, in Section. VII of this Schedule shall apply.

    3. Retired pay reckoned at other than a half pay rate:
      1. A reduction at the rate of five and one half per cent. shall be applied to the Officer's yearly rate of retired pay reckoned according to the appropriate standard scale as defined in section I of this Schedule, provided that if the resulting yearly rate is not an integral multiple of ten shillings it shall be increased or decreased to the nearest ten shillings per annum; exact amounts of five shillings or fifteen shillings being increased to ten shillings or one pound respectively in favour of an Officer.
      2. In cases where an Officer has commuted a portion of his retired pay and the latter is subject to revision in, accordance with the above rules, the reduction to be made from his remaining retired pay shall be determined by applying the rules to the rate of retired pay of which he would have been in receipt if he had not commuted.
      3. In cases where an Officer, retired under the provisions of Order in Council of the 12th day of October, 1925, and previous Orders embodied therein, is in receipt of a reduced rate of retired pay based on a standard rate, his rate of retired pay shall be subject to further reduction at the rate of five and one half per cent.
    1. The standard scales of disability retired pay referred to below are to be reduced as indicated.
      1. The scale for the Officers referred to at (a) of the third paragraph to the first Schedule to the Order in Council of the 11th October, 1923, shall be reduced by five pounds and ten shilling-, throughout and the addition for each complete year of service not exceeding three shall be reduced from ten pounds to nine pounds and ten shillings.
      2. The scale for the Officers referred to at (b) of the third paragraph of the same Schedule shall be reduced by three pounds and ten shillings throughout.
      3. The scale for the Officers referred to at (c) of the third paragraph of the same Schedule shall be reduced by two pounds and ten shillings throughout.

His Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of His Privy Council, to approve of what is therein proposed.

And the Right Honourable the Lord, Commissioners of the Admiralty are to give the necessary directions herein accordingly.
