Pensions
At the Court at Buckingham Palace, the 20th day of January, 1944.
Present, The King's Most Excellent Majesty in Council.
Whereas there was this day read at the Board a Memorial from the Right Honourable the Lords Commissioners of the Admiralty, dated the 15th day of December, 1943 (P.M. 3513/43), in the words following, viz.:-
Whereas by Section 3 of the Naval and Marine Pay and Pensions Act, 1865, it is enacted, inter alia, that all pay, pensions or other allowances in the nature thereof payable in respect of services in Your Majesty's Naval or Marine Force to a person being or having been an Officer, Seaman, or Marine therein, shall be paid in such manner and subject to such restrictions, conditions and provisions as are from time to time directed by Order in Council:
And whereas under the Regulations governing Your Majesty's Naval Service provision is made for additions to pension in respect of time served by Seamen and Marines in a substantive rating or rank above that of Able Seaman or equivalent rating or rank:
And whereas it has been found necessary to make advancements on a temporary basis during the period of the present war
And whereas we are of opinion that subject to certain conditions, the time served during the present war in such temporary higher rating or rank should similarly be allowed to reckon for additions to pension:
We beg humbly to recommend that Your Majesty may be graciously pleased, by Your Order in Council, to sanction the following proposals with effect from the 3rd September, 1939:
- Paid Acting, Acting Temporary, and Temporary rating or rank which has been held for a continuous period of three months to reckon as if it were substantive rating or rank for the purpose of rank additions to pensions, and other pensionary benefits.
- Such rating or rank held continuously for a period of less than three months, similarly to reckon for pension purposes, provided it is immediately followed by substantive promotion to that, or higher rating or rank.
The Lords Commissioners of Your Majesty's Treasury have signified their concurrence in these proposals.
His Majesty, having taken the said Memorial into consideration, was pleased, by and with the advice of His Privy Council, to approve of what is therein proposed.
And the Right Honourable the Lords Commissioners of the Admiralty are to give the necessary directions herein accordingly.
