Position of Retired Officers when Called Out in the Event of War or Emergency

Whereas we have had under consideration the manner in which Retired Officers of Your Majesty's Navy should be employed when called out for service in the event of War or Emergency, and whereas we are of opinion that the position of these Officers when thus employed should be clearly defined, we beg leave to recommend that Your Majesty may be graciously pleased by Your Order in Council to sanction the following rule being substituted for Article 264 of the Regulations for the government of Your Majesty's Naval Service : -
Whenever Her Majesty may be pleased, by Her Order in Council, to call Officers from the reserved or retired lists into Active Service in case of War or Emergency, such Officers shall be, in all respects, entitled to the pay and emoluments of their corresponding ranks on the Active List.
2. All steps in rank given on or after retirement while conferring the title, uniform, and other advantages of the higher rank, will not give the right of command amongst Naval Officers which is always to be governed by the date of commission in the rank held on the Active List at the date of retirement.
