[NI054839] Oct 5 1900 Story, Johnstown Demo KILLED BY A SHIFTER. Jacob Thomas Struck & Run Over Near Ott's Planing Mill. WAS LYING ON THE TRACK. Testimony of Conductor on B & O Train. Unfortunate Victim Was Abt 80 Yrs of Age. Jacob Thomas was decapitated by the B & O shifter last eve abt 7:20 pm opposite the lumberyard of David Ott in 7th Ward. News of the man's death was sent immediately to Chief of Police Frazer & he in co with Coroner Miller, went at once to the 7th Ward to investigate the case. Coroner Miller did not hold an inquest, but he examined a no. of witnesses, whose testimony shows that it was not the fault of the conductor in charge of the shifter that Mr. Thomas was killed. According to the story told by 3 boys, William H. Jones, 513 1/2 Oak St, George Rodgers, 621 Horner St, & Charles Mast, 706 Horner St, Thomas was coming up the track when struck by the shifter. The boys were coming down the track & saw the old man approaching. Before they reached him, however, they turned off the track & went over to a pile of ties & sat down. They had seen the engine backing down the track when it was some distance away & supposed Thomas had seen it also. They paid no more attention to the man or to the train until they heard a brakeman shout that a man had been killed. They went to the scene & found Thomas dead on the track. The wheels of the tender & engine had passed over his head abt the mouth, causing instant death. Young Jones & Rodgers were sworn in the case, but Mason said he could corroborate the story told by them, & the coroner did not swear him & take his evidence. Conductor E. Searfoss gave a very different testimony from that of the boys. He said he was standing on the car which killed Thomas. He did not see the man until the car was on him. He looked down & noticed that the man was lying on the track, with his head just over the rail, as though he was asleep. The man's skull was fractured & his head cut off. Coroner Miller found $50 in the man's clothes, proving that he had not been killed & laid on the track. Thomas was aged abt 80 yrs & had been boarding with Mr. & Mrs. Josiah Gindelsperger, Hickory St. He has a no. of chldn living & had lived with them at different times. He is well spoken of by all who knew him & was a highly respected old man. The surviving chldn are: Mrs. Hiram Shank, 329 Oak St, 7th Ward; Mrs. Catherine Weininger, Bedford Co, Mrs. Christina Helsel, Elton, this Co; William, Scottdale; Samuel, Oak St, 7th Ward, & John Thomas, Easton. He had no bros or sis' living. The remains were taken to Henderson's undertaking establishment & prepared for bur. The time of the funeral has not been set. // Johnstown Trib Oct 5 1900 DECAPITATED BY A TRAIN. Jacob Thomas, an Aged Citizen, Run Down by the B & O Shifter Last Eve. [The story is abt the same as above except....] Coroner Miller learned that Mr. Thomas was highly respected by all who knew him & that he never drank a drop of liquor. He found $50 on the body & a note for $100 in the dead man's pockets. Mr. Thomas was 77 yrs of age & survived by the following chldn; Mrs. Hiram Shank, etc... Mrs. Thomas, w/o the subject of this sketch, d abt 12 yrs ago. He is bur with his wife in Weaver Cem, Richland Twp., Johnstown, PA

[NI054872] From Early Family Notes: Alixander must have emigrated to Cornwall, probably to work in the tin mines around Truro & St. Agnes, as he appears on the St. Agnes parish rolls as the father of Elizabeth. Four of his chldn are registered at St. Agnes; Elizabeth bapt Aug 12 1728, Richard bapt Feb 28 1730, John bapt Apr 3 1738, Alexander bapt Oct 11 1740. We know he must have emigrated after 1715, from the will of his father. The seaside village of St. Agnes in Cornwall lies abt 12 mis west of Truro. It was in the Anglican Ch in St. Agnes that Alixander had his chldn christened. Ch record & the Bishop's Transcripts, are on file in the Co record offices in Truro: "Thomas, Alexander".

[NI054992] John Thomas d. 1715, Wales, Mothvey, Co of Carmarthen, Wales Will of John Thomas: Mar 29 1715. In the name of God Amen: I John Thomas of the pit of Mothvey in the Co of Carmarthen yeoman, being sick in body but of good & perfect memory, thanks be to almighty God, & taking to remembrance the uncertain estate of this transitory life & all flesh must yield unto death when it shall please God to call do make constitute ordain & declare this my last will & testament in manner & form following. Item I give unto Meredith my bro 20s & 2 Shootes of Clothes & I give to my sis Elizabeth 1 yew & lamb & to my bro William 1 yew & lamb & 1 pig & I give to my sis Margaret 1 shilling & 1 shilling to my father, & I give to Anne Thomas 1 sixpence & to John William 1 sixpence: & all of the rest of my good I do give them totally unto Alixander Thomas & I do make him my executor of all chatteles goods & deptes. Signed & delivered in the presence of William Lewis & John William Thomas John The mark of Thomas John // We can see from John's will that he was a yeoman, which is defined as a farmer who farms his own land, one step below the gentry. He may also have been a miner, as he describes himself as being "of the pitt of Mothvey" (Myddfai). In Wales coal mines are the only mines referred to as pits. We can also deduce from the will that Alixander was his oldest son, since by English law of primogeniture the eldest son inherited everything, as Alixander did. The purpose of primogeniture was to prevent a man's estate from being subdivided among all his heirs. Thus the English estates passed intact from eldest son to eldest son. John leaves bequests to each of his 5 siblings & to his father. He must have d relatively young, as he predeceased his own father. He leaves a sixpence to Anne & John William who were probably Alixander's siblings. Anne could have been an older or younger sis & John William was a younger bro, but at least 21, as he witnessed the will. The small bequests to siblings were to ensure the will could not be contested on the grounds that these persons had been inadvertently omitted.
