This Indenture made this Sixteenth day of October in the yeare of our Lord god one thousand seven hundred and Eight and in the seventh yeare of the Reigne of our Sovereign Lady Ann by the grace of god of Great Brittaine, France, and Ireland Queen Defender of the faith. Between Gabriell Soulden of Kinsale in the County of Cork Gent. of the one part and William Bullen of the same Gent. of the other part Wittnesseth that the said Gabriell Soulden for and in Consideration of the Rents, Covenants, and Reservations hereafter in and by these presents mentioned, reserved, and expressed hath demised sett and to farme lett unto the said William Bullen his Exrs. Admrs. and Assigns all that and those the messuage or paire of Old-walls and small garden adjoining and belonging to the same situate laying and being in high Fisher Street in Kinsale aforesaid and Extending from the land formerly belonging to Edmond Roch and now to William Bullen, on the East to High Street, on the West, and from the said land formerly belonging to the said Edmond Roch, on the south to the land formerly the land of Domnick Courcy and now the land of John Fisher on the North, with all and singular the profitts, Commodities and Advantages whatsoever to the said messuage or paire of Old-walls and small garden and any part or parcell thereof in any wise belonging now or heretofore appertaining To Hold the said Messuage or paire of Old-walls and garden with their and every of their appurtenances and appendances unto the said William Bullen his Exrs. Admrs. and Assigns and during the tyme, term, and space of ninety one yeares commencing the twenty ninth day of September last past before the date of these prefents from thenceforth fully to be completed and ended — he the said William Bullen his Exrs. Admrs. and Assigns Yielding & paying therefore and thereout yearly and every yeare during the said terme of ninety one yeares unto the said Gabriell Soulden his Exrs. Admrs. and Assigns the yearly rent or sum of six shilling sterling Currant and lawfull (vizt.) on the feast days of the annuntiation of the Blefsed virgin Mary and of St. Michaell the Arch Angle and that over and above all Rates, Taxes, Contributions, Subsidyes, Impositions and other Charges whatsoever, Quitt Rent Crown Rent and Chief Rent allways excepted, And if it shall happen that the said yearly Rent or any part thereof shall be behind and unpaid by the thirty one days next after either of the said days of payment in the yeare wherein and whereon the same is and ought to be paid as aforesaid that it shall and may be lawful to and for the said Gabriel Soulden his Exrs. Admrs. and Assigns into the said premises into to enter and distraine at(?) the distress ________ [missing line of about 20 words in jpg copy of deed] _____ take, leave, drive, take away, detaine, sell, keep, or otherwise dispose of according to law untill the said Rent with the Arreariges thereof, if any be, be fully satisfied and paid out for want of a sufficient distress then and there to be had and found it shall and may by lawfull to and for him, the said Gabriell Soulden his Exrs. Admrs. and Assigns into the said demised premises or into any part thereof in the name of the whole to reenter and the same and every part and parcell thereof to have againe held repossess, and enjoy as in his or their first and former Estate anything in these presents Hereto are contained to the contrary in any wise notwithstanding And it is Covenanted, Concluded and agreed upon between the said parties to these presents that at any tyme during the said term of ninety one yeares any Commotions, Insurrections, Wars, or Rebellions which god forbid should happen, be or continue __ that the said William Bullen his Exrs. Admrs. and Assigns can not or may not make his or their full advantage and profitt of the said demised premises that then and in such Case the said William Bullen his Exrs. Admrs. and Assigns shall and may have a reasonable allowance and consideration for the same from the said Gabriell Soulden his Exrs. Admrs. and Assigns And the said William Bullen for himself his Exrs. Admrs. and Assigns and both by these presents Covenant, promise and agree to with the said Gabriell Soulden his Exrs. Admrs. and Assigns, that he the said William Bullen his Exrs. Admrs. and Assigns shall and will well and Truly pay or cause to be paid unto the said Gabriell Soulden his Exrs. Admrs. and Assigns the said Rent hereby reserved yearely at, or on the severall days and tymes as the same shall become due and payable by virtue these presents according to the true intent and meaning thereof And the said William Bullen doth hereby for himself his Exrs. Admrs. and Assigns promise, Covenant and agree to and with the said Gabriell Soulden his Exrs. Admrs. and Assigns the houses and other Improvements hereafter to be built Erected of made on the said demised premises from tyme to tyme or at any time during the said terme of ninety one yeares to uphold, maintaine, and keep in good sufficient order and repair and at the End and Expiration of the said term of ninety one yeares the same shall and will yield upp in good tennantable condition, the accident of fire and war Excepted, And the said Gabriell Soulden doth hereby for himself and Bullen his Exrs. Admrs. and Assigns promise, Covenant and agree to and with the said William Bullen his Exrs. Admrs. and Assigns that he the said William Bullen his Exrs. Admrs. and Assigns under the Rents and Covenants aforesaid shall and may have, hold, possess, and enjoy the said demised and granted premises with all and singular the appendances and appurtenances whatsoever thereunto belonging or in any wise appertaining during the said term of ninety one years without any lett, Suite, Trouble, Molestation or Exetion(?) of him the said Gabriell Soulden his Exrs. Admrs. and Assigns but the same shall and will warrant and defend against him the said Gabriell Soulden his Exrs. Admrs. and Assigns and against all manner of person or persons whatsoever, Claiming or to Claime in, by, from, or under him or them, or any or either of them by virtue of these presents In Wittness thereof the parties aforesaid to these presents have Interchangably sett their hands and seales the day and yeare first above written ~
