Fowke & ors to Miller Regd the 23rd day of novr 1733 at half an hour after five oclock in the afternoon

A memorial of indented deeds of lease and release bearing dates respectively the 19th and 20th days of october in the year one thousand seven hundred and twenty nine and made between the Honble Thos Fowke esq Lieutenant Collonell of Maties own regiment of dragoons and elizabeth Fowke als Ingoldsby his wife only daughter and heir of sir William Ingoldsby late of York Buildings in the County of Middx Bart deced of the one part and John Miller of Ballycaseybegg in the Co of Clare Esq of the other part by which said release the said Thomas Fowke and Elizabeth his wife granted sold bargained released and confirmed unto the said John Miller his heirs and assigns for ever all that and those the farm and lands comonly or known by the name of Knockakelly and Ballymurtagh containing two hundred acres one rood and four perches of profitable land be the same more or less and all that and those the two cartrons of lands in Tullaglass aforesd both in the Barony of Bunratty and Co of Clare in the Kingdom of Ireland together with all houses edifices buildings woods underwoods mines minerals quarries fishings waters watercourses mills millseats & all other the appurtenances thereunto belonging to have and to hold the said severall Towns lands tenemts & all & singular other the poss� s to the sd John Miller & his heirs to the use of the said John Miller & his heirs and assigns for ever He the said John Miller his heirs and assigns yielding and paying yearly and every year unto the said Thomas Fowke and Elizabeth his wife & her heirs and assigns for ever the several and respective rents hereinafter mentioned viz.for the first sixteen years and a half of this Demise to comence on the first day of november next ensuing the date hereof and ending the first day of May which will be in the year 1746 the yearly rent or sum of one hundred and thirty eight pounds ten shillgs paid that is to say 40 pounds pamt referred by a lease made to William Smith by Sit William Ingoldsby deced father to said Elizabeth Fowke of the lands of Knockanelly and Ballymurtagh for forty pounds pamt more which the said John Miller had agreed to pay out of the said last mentioned deeds as an additionale rent during the said term of sixteen years and a half and the said thirty eight pounds 10 shillgs pamt referred by the said Wm Smith�s lease and apportioned for the said lands of Tulloglass & twenty pounds pamt more which the said john Miller hath agreed to pay out of the said last mentioned lands as an additionale rent during the said term of sixteen years and a half then yielding and paying yearly and every year unto the said Thomas Fowke and elizabeth his wife her heirs and assigns for the next three years of said term commencing on the first day of May 1746 and ending 1 May 1749 and the yearly rent or sum of 58 pds stg ten shillgs pamt and from and after the expiration of the said three years then yielding and paying yearly and every year unto the said Thomas Fowke and Elizabeth his wife and heirs and assigns for the next six years of said commencing on the first day of May 1749 and ending 1 May 1755 the yearly rent of 41pds 4shillgs & sixpence per ann and from and after the expiration of the six years yielding and paying yearly.... Winesses John Ussher of Hetford Esq Andrew Verdon of the same gent and William Johnston of the City of London gent also James Miller and John Jones of Ballycasey farmers and Charles FitsGerald of Castle Keale Co Clare gent and this Meml is also witnessed by John Ussher James Miller and George Browne Dublin gent etc Galway [judge??] also mentioned [final date] 19 July 1733 the yearly rent or sum of eight 28 pounds stg to be paid by two equal half yearly payments on the first day of November and first day of may during said term in which said deed of release are contained several other clauses and covenants and the said deed are witnessed as to the perfection thereof by the said Elizabeth Fowke by John Ussher of Hedford esq Andrew Verdon of the same gent and by William Johnson of the City of London gent and also the perfction thereof by Thomas Fowke and John Miller and John Jones both of Ballycasey farmers and by Charles FitzGerrald of Castle Keale in the said Co of Clare gent and this Memorial is witnessed by the said John Ussher and James Miller and Georg Brown of the City of Dublin gent [seals etc]
