"Amos Parks

"In the name of God, amen, I, Amos Parks, of Salem township Luzerne County and Commonwealth of Pennsylvania, being sick, indisposed, and weak in body but of sound mind and memory, thanks be given to Almighty God therefore, calling unto mind the mortality of my body, and knowing that it is appointed for all men once to die, Do make ordain and publish this my last Will and Testament, in manner following, that is to say, Principally and first of all, I give and recommend my soul unto the hand of God who gave it, and my body I commend to the earth to be buried in decent Christian burial at the discretion of my executors nothing doubting but at the general resurection (sic) I shall receive the same again by the mighty power of God.

"And as touching such worldly estate wherewith it hath pleased God to bless me with in this life, I give, devise, bequeath and dispose of the same in the following manner and form:

"First, It is my will and desire and I do order that all my just debts and funeral charges be fully paid and satisfied out of the money which may be raised out of my estate.

"Item. I give and bequeath to my oldest son Joseph Parks five shillings, as his birth right, and five shillings more as his proportion share and part out of my estate, and no more, he having already aforehand received a full and competent portion part and share out of my estate.

"Item. I give devise and bequeath unto my other four sons Edward Parks, Amos Parks, Moses Parks, and Silis Parks their heirs and assigns forever, all that tract of land whereon I now live in Salem township and County of Luzerne to be equally divided amongst them, or their heirs or assigns, share and share alike.

"Item. I do will give and bequeath all the remaining part of my personal estate unto my four sons and four Daughters, (viz) Edward Parks, Amos Parks, Moses Parks, and Silis Parks, Experience Vanlone, Prudence Corey, Lucy Hollaway and Sarah Johnson to be equally divided among them or their heirs or assigns share and share alike, "And further, I do will and order that the money given & bequeathed to my son Joseph Parks be paid unto himself by my executors hereafter named one year after my decease.

"And further, I do hereby constitute make constitute and appoint and ordain my trusty and well beloved sons Edward Parks, Amos Parks, Moses Parks, and Silis Parks the sole executors of this my last will and testament to Execute and fulfill the same.

"And I do hereby utterly disallow, revoke, and disannul and make void, all and every other former testaments, wills, legacies, bequests and executors by me before mentioned or named Willed and bequeathed, Ratifying and confirming this and no other to be my last will and testament.

"In witness whereof I have hereunto set my hand and seal this twenty fourth day of September in the year of our Lord one thousand eight hundred and four.

"On the 2d day of November 1804 before me Jacob Hart, Register for the probate of Wills and granting Letters of administration in and for the county aforesaid, personally came Timothy Millard and James Chestnor two of the subscribing to the foregoing last will and testament of Amos Parks, deceased, and being duly sworn and affirmed, declared that they were present and saw the testator sign, seal and heard him publish and declare the same as and for his last will and testament and that at the doing thereof, the said testator was of sound mind memory and understanding to the best of their knowledge and belief, and that the deponent and affirmant subscribed their names thereto as witnesses in the presence and at the request of the testator, and that they saw Benin Stookey also subscribe his name as a witness thereto.
