The story I received was that Mark Patterson Duncan went to the War of 1812 and did not return to Elizabeth. Instead he went to Robertson Co., Tenn, married Joanne MOORE, and had about 15 children with her that scattered throughout the TN/KY border area..

It is believed that all of the children were born in Montgomery Co.,TN, however, "he was living in Robertson County before he moved to Montgomery County? He was on the 1820 census so chances are his children who were born before 1828 where born in Robertson not Montgomery County."

In 1775 Timothy secured a grant of land from the colonial authorities of North Carolina, situated in what is now Lincoln co.. He afterward obtained other grants of land and his sons also secured grants that were chiefly in Surrey co. which seems to have been the general headquarters of the family. One of his sons, Zadok, was sheriff of that county about 1788.

The list of Timothy's children as given in Roster and Soldiers, The Tennessee Society of the Daughters of the American Revolution (1894-1960) omits the name, Sarah, and shows an additional son, Samuel. It also gives additional information covering the following children: Zadok, born 1753 in New Jersey; Daniel, born 1765; Timothy, Jr., born 1760, North Carolina; Reuben, born 1770, North Carolina; David, born November 8, 1749, New Jersey; Israel, married February 28, 1811, to Elizabeth Winsett. Timothy and his sons received grants of land in North Carolina amounting to 2,040 acres. The first grant, for 640 acres, was received by Timothy in 1773 from George III, the King of England. Subsequent grants to Timothy amounted to 900 acres, and he and his sons later acquired the remaining 500 acres. These grants are recorded by the State Department in Raleigh, North Carolina, as follows:

Timothy Riggs Jr., 100 acres, July 9, 1794 on Puzzle Creek.
Timothy Riggs was a patriot who served his country during the Revolution as a Justice of the Peace in old Tryon and Rutherford Counties, North Carolina. He served without a break from the time of the "Court held at Newbern 10th November, 1769," through the entire Revolutionary period. During the period 1775-1777 he and two other justices composed the Court as the only session held during that time (July 1776). Doubtless he was also a member of the Committee of Safety of Rutherford County (originally part of Tryon County) for he continued as Justice of the Peace, and therefore a member of the County Court, every year up to and including 1794.

Caroline Durham Kerby was deceased when the 1850 Census of Warren County, Tennessee was taken. The census shows:

Also, when her father, James Durham, wrote his will in January, 1852, she was deceased. He stated in his will, “. . . I also will and bequeath unto the Legal Heirs and Representatives of my daughter Caroline Kerby one dollar as their portion of my Estate. I also will and bequeath unto my Granddaughter Mary Matilda Kerby a good Feather bedstead and furniture. . . . .”
In order to determine the name of Caroline’s husband I have compiled a list of known facts, hypothesis and conclusions. · Caroline Durham Kerby was deceased when the 1850 Census of Warren Co. TN was taken. Her children are living in the house of her grandparents James and Elizabeth Durham. · in Jan. 1852, James Durham write his will, mentioning Caroline’s “heirs and representatives.” · her parents were married in 1808 in Surry Co. NC. · her oldest daughter Elizabeth Kerby was 20 years of age, born in 1830. · she was probably born about 1810-1815, and was the eldest of James and Elizabeth’s children. · estimating Caroline’s age with her known sisters: Julia A. Durham Sanders was 30, Elizabeth Durham Randolph was 26. · The 1830 Warren Co. TN census was searched for a male Kerby with a small female child and a wife about 20 years old. The following family was found: Frances Kerby; 1 male 30-40, 1 female 0-5, 1 female 15-20. · the 1840 Warren Co.. TN census for Frances Kerby shows 1 male 40-50, 1 male 5-10, 2 females under 10. The ages, and the male child do not correlate with the 1830, but I have not examined the microfilm, just published editions. We know both of the younger girls were born in 1837 and 1839, therefore they are accounted for. There is a John Kerby, 19, living with the George Hennegar family, as a labourer. This could be Caroline’s son. · IF, Francis Kirby was Caroline’s husband, then she was deceased before 1840. Possibly when Mary Matilda was born. · But where was Elizabeth? She would have been only ten years old! · Found in Will Book 4, Page s 157-159, 27 Nov. 1865, is the report of the estate settlement of John Kirby, deceased, which names the legatees as: James Kirby, Thomas Kirby, Francis Kirby, Thomas Kirby being the guardian for the minor heirs of Carrey Broomfield, dec’d, John C. and Hannah Jones (formerly Hannah Kirby), Elisha Kirby and Robert Kirby. The settlement also states that Elisha and Robert live out of the state, so it is assumed that Frances Kirby still lived in TN, but not in Warren County. · Again, James Durham’s will he mentions “heirs and representatives,” heirs would mean her children, only one of which he provides for, and could infer that her husband was still living. · An interesting letter from a lady in Las Vegas, NV who was looking for information on the Kirby family, mentioned “Grandma Christiana who married a man her father didn’t like so he disinherited her.” This story was about Christiana Hogan, mother of James Sanders, husband of Juliann Durham Sanders, and presumably with no direct antecedents to the Kirbys. But the old family story survived. I tried to get more information from this Kirby descendant with no success.
