Theft against Lazarus Prangley

Hi,
I came across this information on Lazarus Prangley, born I think Corsley 1823, researching my own family and decided to send it to you - it might be of interest to Prangley families. It concerns a court case in which Lasarus is the victim. It is my translations of the court witness statements. My ancestor, Caroline Cray, was the perpetrator. I hope by sending it to you my family can some what make up for any suffering of yours. Caroline was transported to tasmania for a second conviction not long after this one.

Dispositions in Felony. Wells Adjourned Sessions 8 July 1844. Frome Division Somerset to wit the joint & separate affirmations and dispositions of Lazarus Prangley of Corsley Labourer and William Davis of Frome Selwood Labourer and Stephen Collins of the same place Constable taken upon oath before us two of her majesty�s justices of the peace in and for the said County this fifteenth day of May 1844.

Lazarus Prangley sworn �I came this day to Frome Market and was stopping in the yard of the Castle Inn when Caroline Cray came up to me and asked me if I would go and pay for a pint I said No I shan�t go in � she said I should I said I would not � then Hannah Webb who was with her said you shall go in and if thee doost not go in we will have thy hat. I said I would not go in at all she took my hat and ran so far as the front door of the Castle with the hat in her hand. Caroline Cray stood by me I said I would not go after my hat I told Caroline Cray that the hat had nearly three shillings worth of goods in it I had bought some Club ribbons about an hour before wrapt up in paper which I put into a handkerchief and the whole was in my hat when Hannah Webb took it away � I had another handkerchief loose in the hat - Caroline Cray said Hannah Webb would bring back the hat Caroline Cray then ran and over took Hannah Webb and took the hat from her and brought back the hat to me � she put her hand into the hat and took out the bundle with the ribbons and put them under the shawl and she brought back one handkerchief and the hat � she said nothing was taken out of it � that a handkerchief was in it and she brought it to me again � a third girl came along and tried to stop me when Caroline Cray and Hannah Webb ran into a passage. I stayed at the entrance to the passage and sent for a Constable who came and found them. I did not get my ribbons which cost me two shillings and three pence halfpenny. I followed them and called up on them to deliver up my things but both of them said if I said anything about it they would hit my brains out � they both kept together till the Constable came I had my hat before I left the Castle but followed them up Catherine hill into Blunt Street a quarter of a mile calling upon them all the way to give up the other things I never moved a yard from the pavement at the Castle yard when I was with them Lazarus Prangley X

William Davis being sworn upon his oath saith as follows �I saw Hannah Webb this morning with a hat in her hand, Caroline Cray was near her I saw her heave up the handkerchief in the hat I went on up the hill but do not know what she did with it I saw Lazarus Prangley and heard him ask them for the ribbons � he sent me for the Constable and said he would give me a shilling� The mark of William Davis X

Stephen Collins Sworn �I was called in this morning and went into a passage in Blunt Street. Lazarus Prangley was at the door. I found Caroline Cray in the Ash house hid behind the wall. Hannah Webb was in one of the houses when I took Caroline Cray, Hannah Webb said she would go with her I searched them both but could not find the ribbons� Steph Collins Sworn by Lazarus Prangley William Davis and Stephen Collins before us.

Alfred Moore of Frome Selwood mason being sworn before me one her majesty�s Justices of the Peace in and for the said County upon his oath saith as follows �I was passing by the Castle Inn Frome yesterday afternoon when I saw Lazarus Prangley talking with three girls just outside the Inn � one of the girls I knew to be Caroline Cray and I should know the other two � I heard one of them / not Caroline Cray / say �we will have thy hat� the then took off his hat and she and Caroline Cray ran up the hill with it. The other had ___ hands in it. When they had gone about ten yards, one of the girls held the hat in her hands to Caroline Cray who took out a parcel in a handkerchief which she opened and I saw some ribbons � she then took out the ribbons and put them in her bosom (?) she then stayed where she was and the other girl carried down the hat and gave it to Lazarus Prangley who said you had better bring back the things which you had from my hat. She then went and joined Caroline Cray and he followed them up Catherine Hill when the other girl said If thee doest come after me anymore I will knock thy brains out. Lazarus Prangley then said I wish I could see a Constable I said I wish you could � the two girls both threatened to kick me - Caroline Cray then said I will go and look for one and cut down into the Masons Arms and the other two remained outside � she came out again in a minute or two and they all went towards Badcox (?) and were followed by Lazarus Prangley. I left them there I saw the ribbons were red blue and white. Alfred Moore. Sworn 16 May 1844 before me.

18 Dec 1502 GD176/21  Declaration by John Cuthbert, burgess of Innernes [Inverness]. "Sen meidfull and meritable it is to beir leill and suithfast witnessing to the werite and specially in causis quhar the occultatione of the werite ma gener skaith or prejudice till innocentis, herefoir it is that I, the said Jhone Cuthbert, beris witnessing to the werite, testifeis and declaris" that on 18th December 1502 he passed at the requisition of William Makyntoisch [McIntosh], the son of Lachlan Makyntoish [McIntosh], and with him to the principal chemeis of the lands of Dunnauchtane moir [Dunachton-mor], with the mill, Dunnauchtane beg [Dunachton-beg], Dullywert [Dalnavert], Kynraranakellze [Kinrara-na-Kelze], and the third part of Pittowry [Pittourie], where William Makyntoisch presented to him the immediately preceding precept (which is herein inscribed at length), and desired him as one of the bailies therein named to give him sasine of the said lands. And this he did in presence of Sir John Makky [McKay] and other witnesses, and in token thereof he appends his seal. The seal is still appended.

20 Feb 1534 GD176/34   Letters of Reversion by Donald Makfersone [McPherson], son of the deceased Beanus McFersone [McPherson] and Margaret McFersone [McPherson] Strachachin [Strachan], his spouse, to whom Thomas Ewinsone [Eunson], one of the portioners of Twllych [Tullich] and Elrick [Elrig], has sold his half of the lands of Elryk and a quarter of his lands of Twllych, in the lordship of Strathnairn and sheriffdom of Inverness, promising that whenever the said Thomas or his heirs or assignees shall pay to them �40 on the high altar within the parish kirk of Inverness and choir thereof, or in the event of their not appearing to receive the same upon twenty days' warning, shall lodge the same in the hands of the alderman or bailies of Inverness, he or they shall have free regress to the said lands, giving to the said Donald and his wife and their heirs a nine years' lease thereof for the yearly duty of three merks and a half. In testimony whereof the said Donald affixes his own seal (a shield displaying a lion rampant; legend, S. Donald Macfersone), and has caused his wife obtain the seal of William Cuthbert, burgess of Inverness (which is also affixed-a round seal with an arrow and cross crosslet within a ring). Dated at Inverness, 20th February 1534; witnesses: Sande Bailze [Baillie], alderman of Innernis [Inverness], John Cuthbert of the Ald Castelhill [Auld - Old Castlehill], William Cuthbert, his son and apparent heir, Alexander Gordone [Gordon], Alexander Hutouneson [Hutchison] and Mernye Brachane [Brechin]. 4 May 1539 GD176/36  Precept of Sasine following upon this charter GD176/35, directed to William Cuthbert, burgess of Inverness, and Donald Makfersone [McPherson], as his bailies, to give sasine; and ordaining whichever of them gives sasine to append his seal on the second tail.

12 Dec 1576 GD176/112 Contract between Lachlan McIntoische [McIntosh] of Dunnachtin [Dunachton], as donator of the ward, marriage, nonentry and relief of the heirs-female of the deceased George Strachane [Strachan] of Cullodin [Culloden], and Margaret Straychan [Strachan], one of these three daughters and heirs, and Huchon Ross, son of the deceased James Ross, sometime in Lyonach [?Leanachan], her contracted spouse. She has contracted herself, without the consent of the said Lachlan, in marriage to the said Huchon, and carnal copulation has followed, in consequence whereof he has legal right to the double or even the triple of her dowry. This is valued at �500, and he restricts himself to the double, which is �1000. As they are unable to pay this they bind themselves, upon the said Margaret becoming served heir-portioner to her father, to dispone her third of the lands and mill of Cullodin, with pertinents, to the said Lachlan; and he is to give them 500 merks, of which he gives them 200 presently, is to pay them 100 more on receiving the foresaid disposition (as cautioners for which he names James Patersone [Paterson], provost of Inverness, and Donald Roye [Roy] McCuill [McCoull] in Essie [Essich]), and for the other 200 he is to infeft them in a plough of land, called eight oxengang land, of the lands of Easter Cullodin, to be held by them of him blench and under reversion on payment of the said sum of 200 merks. Should they fail in performing their part of this contract the said Margaret Strachan and her contracted spouse promise to pay the sum of �1000, and that within half a year after demand. 23 Jun 1579 GD71/3 Discharge by Agnes Patersoune, relict of Thomas Ross of Preisthill, in favour of Andrew Munro of Newmoir, Andrew Munro of Nig and William Ros of Logy, as cautioners for William Ross of Preisthill, of sum of money for discharging the said Agnes of her liferent in the lands of Ulladel. Witnesses: George Ros, Alexander Cuthbert, James Waus, George Waus, and Peter Waus, burgesses of Inverness, and Robert Waus, notary-public.

31 Jul 1582 GD176/130 Retour of the Service of Duncan Makconquhe [McConnachie] Dowe [Dow], as son and heir of the deceased Paul McConche [McConnachie] Dowe [Dow] in the half lands of Tullycht [Tullich] and Elerik [Elrig] which are held in chief of Thomas Fraser, portioner of Moneak [Moniack], and his heirs in feu-farm, exped in the tolbooth of Inverness on 31st July 1582. In presence of William Bane [Bain], sheriff-depute of George, Earl of Huntlie [Huntly], sheriff-principal of Inverness, and the following jury, viz. 10 Sep 1593 GD176/162 Bond by the town of Inverness for the prosecution of George, Earl of Huntlie [Huntly] and his accomplices. Lachlan McYnthosche [McIntosh] of Dunnachtyne [Dunachton], as one of the commissioners with Andrew, Lord Ochyltree [Ochiltree], and John, Earl of Atholl, for the prosecution of George, Earl of Huntlie [Huntly], and his accomplices for the slaughter of the Earl of Murray [Moray], understanding that the said Earl of Huntlie is convocating for the pursuit of him and his kin and followers and to seize the house of Inverness, which was delivered by the King's command to John, Earl of Atholl, has charged the provost, bailies and council and community of Inverness to render to him their house and fortalice of Inverness called the Steeple, for the defence of the town and lieges, and the provost, bailies, council and community have all in one voice declared that they will defend and keep the foresaid Steeple against the invasion of the Earl of Huntly; and if they do not so that then they will accept the deadly feud of the said Lachlan; Dated at Inverness, 10th September 1593; Witnesses: William McQueyne [McQueen] of Correbroche [Corrybrough], John McPherson in Breyne [Brin], James Innes in Hulleryt [Urlarust], Duncan Thoshe [Tosh] of Pitgany [?Pitgaveny, Elgin], and others. The burgesses, being sworn, found that the late Alexander McThomas Roy, indweller in Invernis, grandfather on the father's side of Thomas Fraser, burgess of that burgh, died vest and seised in a rood of burgage land with houses, yard and malt kiln lying in Inverness on the west side of the water of Nes, between the lands of John Robertsoun, wright, on the south, the lands of Alexander M'Gillemartin and the lands of the late Alexander McThomas Roy on the north, the lands of Sir James Duff on the west, and the common vennel on the east, and also in a paticate of burgage land with houses, etc lying in said burgh on the west part of the water of Nis between the lands of Finlay McConel Du on the south, the common vennel on the north, the lands of John Cuthbert on the west, and the barn pertaining to Alexander McThomas Roy on the east: That the said Thomas Fraser was the lawful grandchild and heir of the said Alexander McThomas Roy, in the said subjects which are held of the King in burgage for payment of burgh mail aucht and wont and for payment of 3s furth of said rood of land to the chaplain of the Holy Cross, and now the the provost and bailies, councillors and community of said burgh: Whereupon the said William Campbell as one of the bailies of said burgh proceeded to the ground of said lands and gave sasine thereof to the said Thomas Fraser. 12/9/1655 GD176/440  Decree of a Justice Court held at Inverness on 12th September 1655, absolving William M'Intosh [McIntosh] from presenting Lachlan Makintosch [McIntosh] of Daviot, and Alexander Makintosch [McIntosh], his brother, to justice to answer for the rape and ravishing of Katharine Cuthbert, lawful daughter of James Cuthbert of Draikies [Drakies], upon "ane fast day being Sonday" in 1645, and for the murder of Alexander Davidson, his servant, in November 1647, they being neither vassals, servants, nor tenants to the said William. Also a number of papers narrating the pleadings in the case, in one of which it is narrated that the damsel was a child of twelve years of age, and was violently taken from her father while on the way to the church with him. She was only recovered from their hands when the country rose against them.

Fastii Ecclesius v6, p443 - Hugh ROSE, born about 1633, eldest son of David R of Earlsmill and Christian CUTHBERT; educated at King's College, Aberdeen; MA 1653; lic by presbytery of Forres, 23 FEB 1659; called 24 AUG 1659; ord (assistant and successor) 4 JAN 1660; did not take the test in 1681 owing to illness, and doubts being entertained whether the charge had become vacant or not, he was, for further security, pres. by Colin, Bishop of Moray jure devoluto in 1682 and inst. 1 MAY 1683; died unmarried 7 DEC 1686.  His brother James, sheriff-clerk of Nairn was served heir to the lands of Termet 22 APR 1690.

on 18 JAN 1560-1, Jasper Waus (then Provost) and George CUTHBERT were ordered to pay the minister's fee.

Fastii Ecclesius v6 p 472, CUTHBERT, Sir David  - Sir David CUTHBERT, held the chaplainry of Our Lady of the High Altar at the Reformation and the Vicarage of Wardlaw before 1567.  He was a prominent citizen of Inverness and was adm a burgess and guild brother in 1567, but continued to draw the revenues of his Inverness chaplaincy.  He was alive in 1593, and was probably the last survivor of the pre-Reformation clergy in Inverness.
