James ROOKLEY, Kentisbeare, labourer, was summoned by William HAWKINS, Kentisbeare, farmer, for assault. Complainant said on the 30th Oct. last defendant was doing some draining work for him. He went and inspected it and found fault with it, when some strong language was used by defendant, and he took a large pick which he used in the work and threatened to knock his (complainant's) brains out. Defendant admitted the charge, but said great provocation had been given him by the complainant. The Bench inflicted a fine of 10s and costs, and said if Mr. HAWKINS still pressed an application previously made to bind the defendant over to keep the peace, they were willing to do so. Complainant said he was in fear of some great bodily harm from defendant. He was therefore bound over in his own recognizances of £20 to keep the peace for six months.
