A PERFECT LADY”

TAUNTON HUSBAND AND ANOTHER WOMAN

LETTER TO HIS WIFE

A Taunton man told the magistrates of a Matrimonial Court on Wednesday that he would never live with his wife again and that he wanted to marry a girl in Hull who was going to have a child by him.

Mrs. Phyllis Priscilla TOLLER, of 70, Eastleigh-road, Taunton, applied for a maintance order on the grounds of desertion against her husband. Frank TOLLER, described as an Admiralty overseer of Essex-street, Hull.

Applicant was represented by Mr. F. W. WILLMOTT, and the husband by Mr. C. B. PARDOE.

Mr. WILLMOTT said the couple were married in 1937; there were no children. They lived happily at Taunton until 1940, when the husband was employed at Plymouth. In 1941 he was transferred to Hull, and came home about every five weeks. They stayed together at Hull for two or three months.

EXTRAORDINARY LETTER.”

On April 24th the husband sent home his washing and allowance, followed two days later by an extraordinary letter in which he said that he had made up his mind not to live with his wife again.

He wrote that he had been keeping company with a girl who was expecting a child by him, and hoped that his wife would commence proceedings for divorce to give the child a name.

Mrs. TOLLER went to Hull in the hope of effecting a reconcilliation. On her return to Taunton defendant wrote: “You have met Ellen and seen what a perfect lady she is. She has told me that she loves me, and I can only wish I could have gone to her as a single man. I am very deeply in love with her and will do everything possible for her future happiness.

I understand you gave Ellen the impression that I was coming back to you at Taunton and starting our life all over again. You know this is a lie. The suggestions were your own.”

A DENIAL.

Applicant gave evidence in support of Mr. WILLMOTT's statement. She denied in reply to Mr. PARDOE that she had refused to live with her husband at Hull because she could not have a home of her own. She was willing to live with her husband if he gave up the other girl.

Applicant's sister, Miss Kathleen ROSEWARN, and her father, Mr. Charles ROSEWARN, who had visited Hull with Mrs. TOLLER, also gave evidence.

Defendant said he frequently wrote asking his wife to live with him at Hull, and because of her refusal he stopped sending her money in February or March.

In view of what had happened he would never live with his wife again. He had always been fond of children. He was proud of the fact that he was going to become a father, and wished that he could marry the other girl to give her and the child his name.

MAINTENANCE ORDER.

In reply to Mr. WILLMOTT, TOLLER agreed that he had not tried to obtain a home for his wife in Hull but had asked her to share a house with a family with whom she said she could not live happily.

The Bench, Alderman F. W. PENNY presiding, allowed Mrs. TOLLER a maintenance order of 50s(?) a week, with an advocate's fee of £3(?) 3s(?).
