Johnson, friend, loyalist expert, reenactor, past President of the United Empire Loyalist Association of Canada. In 2020, Shelley Banks added quite a bit more so it was time to reorganize the page and try to collect as much as possible about the children of John Fairman UE and his wife Elizabeth Robertson. The focus here is to raise some questions and try to best answer them. Shelley Banks has done a lot of work on the Fairman family and has an excellent tree and source links on Ancestry. How early was John Fairman involved in the Rev War?
The Commissioners for Conspiracies name a John Fairman among others in 1778 reporting that they took up arms with Burgoyne in 1777. This may be the same John Fairman.

John Fairman was with the Loyal Rangers who were established in 1781. John Fairman is a Loyalist and as a Sergeant he was granted 600 acres in Thurlow Township on the Bay of Quinte. For some reason John Fairman is not named in any of the found records of the Loyal Rangers. However he was granted UE status and land as a sergeant so his war record as reported was not challenged.

What proof is there that John Fairman married Elizabeth Robertson?
There is a 1781 baptism for a Hugh Fairman whose parents are John Fairman and Elizabeth Robertson at the First Reformed Church of Schenectady, NY. Is this the same family still in NY in 1781 and baptizing their child while there? Perhaps there is other evidence.

How many children did John and Elizabeth have?
In an 1833 petition in the Upper Canada Sundries, son Hugh states, as an aside, that, "my father was a Loyalist and one of the first settlers in this County and brought up 8 sons." No mention is made of daughters. Therefore 8 sons and one known daughter make up 9 children who survived to adulthood.

It so happens that 7 sons and 1 daughter petitioned successfully for land as children of John Fairman. Children had to be 21 years of age to petition so a rough idea of birth date can be determined. The one daughter is Nancy and the 7 sons who petitioned are John, Robert, Hugh, Henry, George, David and Thomas. see their sections below for details.

William appears to be the one missing son?
This researcher places considerable importance on the number of 8 sons as reported by Hugh who was about 30 years old at the time. John Fairman Sr kept an account with Samuel Sherwood who was a part time merchant starting in 1789. He allows some of his older children to make purchases under his account. Sherwood names Nancy, Robert and William but only records directly that Robert is a son. John Jr has his own account and is assumed to be the oldest child.

See one of the pages of Samuel Sherwood's account book and you will see entries for Robert and William doing work as credit for their father's account. It certainly looks like William is part of the family.

William appears to be the missing son. Why is there no petition from him asking for a grant as a son of a Loyalist? Perhaps his petition has gone missing - that happened. He did receive a grant in Huntingdon Tp, Hastings, in 1802 and promptly sold it and this may have been as a SUE. When the Archives reopens after Covid restrictions are lifted the Ont Land Records Index (OLRI) will be examined. The OLRI records the original grantee for all land in Upper Canada and the reason for the grant. William got a grant so the grant should be in the OLRI and the reason would be shown.

Regardless, William marries Phoebe Harris and they settle in Thurlow. It has been reported that descendants of William have DNA matches with descendants of other siblings in this family.

Shelley Banks writes, "I think William Fairman was missed by researchers as a member of John’s family, (although he’s mentioned several times, with no attached family, in the Thurlow local history, Rambling River, which cites earlier documents), because William left Thurlow in the late 1840s to move to Rawdon Tp - and the Rawdon 1851 census did not survive. Then he died before the 1861 census, so to anyone looking at census records for Fairmans, he simply did not exist."

Richard Fairman is a grandson.
Richard Fairman was born in the Province about 1798 and in 1819 he petitions for a lot in Belleville. He does not state he was born in Thurlow nor does he petition as a son of a Loyalist. Richard is named as a grandson of John and Elizabeth Fairman in an 1806 land deed..

What about William Fairman of the 29th?
In 1791 a William Fairman of the 29th Regiment successfully petitions for a grant. In records, he is named as a Discharged British Soldier. He settles in Marysburgh. Later he petitions for a military grant and is granted lot 42, Con 3, Sophiasburgh. It has been concluded that he married Catherine Rosecrance in 1789. She is sometimes called Katreen or Katy. William sells his Sophiasburgh lot in 1804. This William is not the same man as William Fairman named in Sherwood's account book under the account of John Fairman of Thurlow.

A Catherine or Katy Fairman has three illegitimate children with John Cronkhite of Amherst Island. This researcher concludes that the marriage broke up and William sold the farm and Catherine moved to Amherst Island. Land records as early as 1814 name Wiliam's wife as Hannah which is likely a second wife after the death of Catherine.

2. JOHN FAIRMAN Sr UE

1778 COMMISSIONERS FOR CONSPIRACIES
15 Apr 1778, Col Gordon & Capt Collins appeared before this board & requested that Robert Russell, Roger Hyatt, John Smyth, Archibald McNue-McNight, James Robison, John Fairman, George Gardiner, Jonathan Tuttle, Stutly Seraton, George Gardner & George Bolton, persons now again residing in Ballston, after having taken up arms against the United States with Genl Burgoyne, & from appearances they judge that the above persons will return to their duty. Thereupon resolved that Col Gordon and Capt Collins be requested to cause the said offenders to appeear before them to enter into Bail for their future good conduct. A copy of a recognizance for that purpose was furnished them.

REV WAR RECORD
Peter Johnson, Loyalist expert, emails "that John FAIRMAN is found in Gavin Watt's book on the Burgoyne Campaign (Vol 2). Notably he is not in Gavin's book on the Loyal Rangers. His 1790 Petition refers to him being a Sergeant in the Loyal Rangers. As far as I can tell, this is a bit of a stretch. Apparently there is no record of him serving as a sergeant let alone in the LR. If one could find definitive proof he served in the Loyal Rangers that would be a big find. Rather he served as a corporal in Capt. Hugh Munro's Coy of McAlpin's Corps in 1777. This was in the Bateau Service. This  time pre-dates the formation of the Loyal Rangers. The Bateau Service he was in dates from the time of the Burgoyne Campaign."

1789-95 SAMUEL SHERWOOD ACCOUNT BOOK
John Fairman gets an account under his own name 11 Feb 1789 and has numerous entries through to 6 Aug 1795. Sherwood continues recording transactions till 1810. Children Robert, Nancy and William are named in transactions under their father's account. John Jr has his own account.

1811 PETITION
This is a lengthy petition about the matter summarized below in the Land Book. A number of affidavits are part of the petition. Image 912 is interesting as it is a 1787 warrant for half of lot 9 and all of lot 10 in Con 1 and 2 of Seigneurie 9 [which became Thurlow].

John Fairman the Elder of Thurlow Yeoman, has settled the E 1/2 of lot 9, Con 1, Thurlow and by some mistake the E 1/2 was claimed by the late Archibald Chisholm. John Fairman had been granted half. Henrietta Chisholm, widow, agrees to surrender the claim and accept a grant for the W 1/2 of lot 9.

In John's 1797 petition, he states he is 27 in 1797 thus born abt 1770.
In John's 1816 petition he states he 42 thus born about 1774.
John is recorded as the first child given that he is born early, named after his father, and is the only child to get an account of his own with Samuel Sherwood in 1796.

25 Mar 1816, York, petition of John Fairman of Sophiasburgh, carpenter ... was born in the State of New York from which he came to Canada in 1784 to this Province and has resided here ever since. 3d. WILLIAM FAIRMAN (abt 1777-1855)

BORN
  1. A petition for William as a SUE has not been found.
  2. He first shows up in Samuel Sherwood's account book in 1794 probably as a teenager. If he is 17 at that time then he was born about 1777.
  3. In 1802 William Fairman of Thurlow, yeoman sells his lot 8, Con 1 in Huntington that he was granted in the 42nd year of the reign of George III which is the year 1802. If he is the minimum 21 years of age when granted the land he would be born about 1781 or earlier.
  4. In 1836 inhabitants of Thurlow petition for a resolution to survey issues. An affidavit from William Fairman says the surveyor stayed at his parents house and he states "that he was of sufficient age to understand matters ..." If he was 12 years of age in 1788 then he was born 1776. See the whole petition on this separate web page on this site.

1789-95 SAMUEL SHERWOOD ACCOUNT BOOK
Shelley Banks noticed that in Samuel Sherwood's account book there are quite a few entries of accounts with John Fairman Sr starting in 1789. Often his known children are entered making purchases under their father's account or getting credit for work done on behalf of the account. These are Robert, Nancy, John [Jr] between 1791 and 1795 and William is named in 1794/95.

MARRIAGE
No marriage record has been found. William married Phoebe Harris before 1806 when one of their children is baptized. In 1842 Phebe petitions for land successfully as a DUE, "Phebe Fairman, wife of William Fairman of Thurlow Tp, is the daughter of David Harris." See the 1842 petition below.

Shelley writes in an email, "Phoebe’s age is well documented, and her records work out to a birth in 1788 or 1789. Likely 1789, as her parents were married by Rev Langhorn in Dec 1788. Although there are examples of much older men marrying very young women at this time, it’s possible Phoebe and William were only 10 or so years apart."

There is evidence, supported by DNA matches, that this William Fairman, who married Phoebe Harris, was a son of John and Elizabeth Fairman. William Fairman is named presumably as a son in Samuel Sherwood's account book. Researcher Shelley Banks provides this information. Shelley writes in an email, "He and Phoebe had at least eight, and perhaps 10 or more, children between 1806 and 1831 - but that likely says more about her age than his."

1842 PETITION DUE
30 Dec 1842, Belleville, petition of Phebe Fairman, wife of William Fairman of Thurlow Tp, is the daughter of David James Harris, late of Ernestown, that she has never received lands ... prays for 200 acres as DUE. Approved 12 Jan 1849. [Her father's name is stated to be James in the Quarter Sessions affidavit at the bottom of the page. However the father's name is recorded as David on the notes on the back of the petition.]

Shelley writes in an email  that "William was farming on his own (with Phoebe, but their sons were elsewhere) when he died in 1855 - age unknown, but perhaps closer to 75 than 85 then, if farming alone, which might mean being born closer to 1780 than 1770."

It also, by the way, means that the Mary FAIRMAN who married Cornelius KELLY is also not George's daughter.

GRANDSON OF JOHN & ELIZABETH
Shelley Banks found the record above that states Richard is a grandson of John and Elizabeth Fairman. "His father would be one of the older sons such as John, Robert or William or an unmarried daughter like Nancy. In the land record above, it states that John and Elizabeth Fairman sold land to their grandson Richard Fairman. So his being their grandson is fact. This is the only record I’ve seen that connects them in any way to Richard, and it fits with the fact that Richard did not apply for land as SUE, but instead as a good local resident."

WILLIAM POSSIBLE FATHER OF RICHARD
Shelley writes that: "My guess is that William Fairman was likely Richard Fairman’s father, based on:
  1. The Thurlow land being adjacent to William's land.
  2. William being one of the brothers who could have been Richard’s father, based on what we now know.
  3. Richard’s sons’ names echoing those of William’s daughter Catherine: Oran, James, Samuel, Royal... (The only Royal Fairmans I can find were in William’s and Richard’s families - and Amy Ann’s ... )
  4. Questions raised by the sale of land to Richard from his grandparents, John and Elizabeth Fairman. For some reason, despite how young Richard was, they thought he needed his own land - but they don’t seem to have felt the same way about their other grandchildren, as least not from land records I’ve found... Further, the original transaction took place 23 Jan 1806, when Richard would have been only about 8 years old or older. Why then? Why not when he was 21? What changed c1805/6?
  5. But of course, none of those four points is proof that the Richard Fairman who says he was born in the US on censuses, and who married Catherine Docksteader, was the same Richard Fairman as John and Elizabeth’s grandson from Thurlow. However, my DNA matches with descendants of Richard and Catherine Docksteader Fairman suggest that Richard Fairman was part of the Thurlow Fairman family, thus the two being the same man."

5. WILLIAM FAIRMAN, PRIVATE IN 29TH & CATHERINE ROSECRANCE
William Fairman of the 29th was a discharged British Soldier who settled in Marysburg.  Peter Johnson, Loyalist expert states that, "this is in keeping with a number of other British and German Regulars." He continued to live in Marysburgh and had a land grant in Sophiasburgh and Hallowell. However William and wife sell their 200 acre Sophiasburgh grant in 1804. His wife was Catherine Rosecrance and it appears their marriage was on the rocks and she was living with John Cronkhite and having children with him as early as 1800. In an 1814 land deed William's wife is named Hannah. Since divorce was rare and required an act of Parliament it is reasonable to assume that Catherine had died and William remarried.

SAMUEL ROYAL FAIRMAN
Samuel Royal Fairman, born 17 Oct 1823 in Ontario, died 29 Oct 1904 in St Clair, St Clair County, MI. He married at age 26 and had 3 children of whom 2 were still living. At the time of death he was "married". His parents were Richard Fairman, born NY and Catherine Dockstaeder [Dockstader] born NY. Informant was R. B. Fairman. [Note: John French has researched this family and has other records about the parents; Richard and Catherine.

1841 DEATH
Jany 12th James Fairman Senr.* aged sixty seven years, died at Fort Erie on the ninth day of January in the year of our Lord one thousand eight hundred and forty one and was buried on the twelfth following by me, John Anderson, Rector of Waterloo. Witness to the interment Kenneth Reid.
