THIS IS THE LAST WILL AHD TESTAMENT
of me WILLIAM GROSVENOR SHAKESPEAR late of Birmingham in the County of Warwick
but now of Number 7 Regent Terrace Penzance in the County of Cornwall Gentleman I
appoint my friends William Overton of Walsall in the County of Stafford Merchant and
Samuel William Hughes ofFillongley in the County of Warwick Farmer and my niece Florence
Mary Overton (hereinafter called "my trustees") to be the EXECUTORS and EXECUTRIX
and Trustees of this my Will and I give to them the Sum of twenty five pounds each for
their trouble in acting as such Executors and Executrix and Trustees I give and bequeath
all my personal estate whatsoever and Wheresoever unto my trustees upon trust to sell
call in and convert into money my said personal estate or such part thereof as shall
not consist of money and with and out of the moneys produoed by such sales calling in
and conversion and with and out of my ready money to pay my funeral and testamentary
expenses and debts and the legacies bequeathed by this my Will or any Codicil hereto and
to stand poesessed of the residue of the said moneys upon trust in the first place to
set aside a sum of two thousand pounds And I direct my trustees to stand possessed of
such sum of two thousand pounds in trust for such of my nephew Grosvenor Overton and my
nieces Florence Mary Overton Bessie Overton and Mable Overton children of my late sister
Jane Overton as shall be living at the time of my decease and who being a male shall
attain the age of twenty one years or being a female or females shall attain that age
or marry under that age Provided alwaYs that if any of them my said nephew and niece
shall die in my lifetime leaving a child or children who shall survive me and being a
son or sons shall attain the age of twenty one years or being a daughter or daughters
shall attain that age or marry under that age then and in every such case the last
mentioned child or children shall take (and if more than one equally between them) the
share which his her or their parent would have taken of and in the said sum of two
thousand pounds if such parent had survived me and attained the age of twenty one years
And I direct my trustees to stand possessed of the ultimate residue of my said trust
moneys after so setting aside the sum of two thousand pounds as aforesaid in trust for
my niece Mary Jane Hughes wife of the said Samuel William Hughes absolutely I declare
that all the said legacies bequeathed by this my Will including the said trust fund of
two thousand pounds shall be paid or set aside free from legacy duty And I declare that
my trustees may at their own discretion raise and by way of Mortgage if necessary any
part or parts not exceeding together one moiety of the expectant share of any infant
child under this my Will and apply the same for his or her advancement preferment or
benefit as my trustees shall think fit I give and devise my Farmlands with the messuage
or farmhouse and outbuildings thereon situate at Fllongley in the County of Warwick
and known as Tippers Hill Farm and also the strip of garden ground adjoining thereto
which I purchased from the Churchwardens and Overseers of the poor of the Parish of
Fillongley to the uses following that is to say to the use of my nephew Grosvenor
Overton during his life without impeachment of waste with remainder To the use of the
first and other sons of the said Grosvenor Overton successively according to seniority
in tail general with remainder To the use of the first and other daughters of the said
Grosvenor Overton successively according to seniority in tail general with remainder
to the use of my said niece Florence Mary Overton in fee simple I give and devise all
those pieces or parcels of land with the outbuildings thereon called The Parks Farm
And also the two pieces of land which I bought from Garners trustees adjoining the said
Parks Farm with the dwellinghouse and outbuildings erected thereon All which premises
are situate in the Parish of Fillongley and are now in the occupation of the said
Samuel William Hughes and are in this my Will treated as constituting one properties
called "The Parks" To the uses following that is to say To the use Of my said niece
Mary Jane Hughes during her life without impeachment of waste with remainder To the
use of her husband the said Samuel William Hughes during his life Without impeachment
of waste with remainder To the use of the first and other sons of my said niece Mary
Jane Hughes successively according to seniority in tail general with remainder To the
use of the first and other daughters of the said Mary Jane Hughes successively according
to seniority in tail general I devise all my real estate whatsoever and whersoever
not hereby otherwise disposed of unto the said Mary Jane Hughes in fee simple And I
hereby revoke all former Wllls and testamentary dispositions made by me IN WITNESS
whereof I have hereunto set my hand this twentieth day of June one thousand nine hundred
and two - W G SHAKESPEAR - Signed by the said Testator William Grosvenor
Shakespear as and for his last Will and Testament in the presence of us both present
at the same time who at his request in his presence and in the presence of each other
have hereunto subscribed our names as witnesses (the wOrds "my right heirs" in the
thirteenth line of the third page hereof having been first struck out and the words
"the sald Mary Jane Hughes" substituted therefor) - R A ROTHERHAM Solr Coventry

ON the 5th day of November 1904 Probate of this Will was granted to William Overton
Samuel William Hughes and Florence Mary Overton spinster the Executors


DEATH ON OR AFTER 1st JANUARY, 1898.
Will.

BE IT KNOWN that William Grosvenor Shakespear
of Penlee Villa Redinnich Penzance in the County
of Cornwall formerly of 7 Regent Terrace Penzance aforesaid
died on the 18th day of May 1904
at
Penlee Villa aforesaid

AND BE IT FURTHER KNOWN that at the date hereunder written
the last Will and Testament

of the said deceased was proved and registered in the Principal Probate
Registry of His Majesty's High Court of Justice, and that administration
of all the estate which by law devolves to and vests in the personal
representative of the said deceased was granted by the aforesaid Court
to
William Overton of Walsall in the County
of Stafford Merchant Samuel William Hughes
of Fillongley in the County of Warwick Farmer
and Florence Mary Overton of Walsall aforesaid
Spinster the niece the Executors
