The Will of

John Shakespear, 1730 - 1768

of Preston Bagot

In the Name of God Amen. I John Shakespear of Preston Baggot in the County of Warwick Yeoman being weak and infirm in Body but of sound Mind, Memory & Understanding and Calling to Mind the Uncertainty of this Transitory World and the Certainty of Death do make and ordain this my last Will & Testament in Manner and Form following/ to wit/

First and principally I will and desire that all my just and legal Debts, funeral Charges & Expenses be defrayed and paid and my Body interred in a decent and Christian like Manner at the Discretion of my Executrix & Executors hereafter nominated and appointed and as touching such personal Estate wherewith it hath pleased God to bestow upon me I give and dispose thereof as follows. I give and bequeath all the Rest Residuum & Remainder of my personal Estates Goods Chattels Cattle & Credits of what Nature & kind soever & wheresoever after the payment of my just & legal Debts funeral Charges & Expenses and the incidental Charges & Expenses attending the Probation of this my last Will & Testament and all other incidental Charges & Expenses my Executrix & Executor & Trustees shall be at in the Execution of the Trust in themreposed. I give and bequeath same unto my beloved Wife Mary Shakespear and my Three Sons, William Shakespear John Shakespear & Thomas Shakespear to be equally divided amongst them. And I do hereby nominate and appoint my beloved Wife Mary Shakespear & my Friend John Whittington Trustees & Guardians to my said Three Sons till they arrive at the age of One & Twenty Years & if any one of them shall happen to die my Desire is that my said Trustees & Guardians shall set out to Use upon the best Securities they can get all my Three Sons Shares and set them apprentices to such Trades or Business as they shall think most proper as they arrive at their proper Ages of Maturity to be set out apprentices and furthermore my Desire is that the Interest Money arising from the Surplus Money of my said Sons Shares be applied & employed in the Maintenance Education Clothing & Breeding them till each arrives at their Age of One & Tweny Years and then my Desire is that each of them shall receive their respective Shares at their arrival thereat and hereby nominate and appoint my beloved Wife Mary Shakespear and my Friend John Whittington within mentioned joint Executrix & Executor of this my last Will and Testament hereby revoking and disannulling all former Will & Wills by me heretofore made ratifying and Confirming this alone. In Testimony whereof I have unto this my last Will contained in these two Sheets of paper to each of them set my Hand & Seals this 28th Day of August 1768

 

Signed Sealed Published and declared by the within named John Shakespear the Testator as and for his last Will and Testament in the presence of us who at his Request& in his presence have hereunto subscribed our Names as Witnesses in the presence of each other
