The Frederick Post; rederick, Maryland; Wed., Jan. 4, 1933 (www.ancestry.com)
MURDER CHARGE IS LAID AGAINST R.R. DETECTIVE
M.E. McGaha Released on $5000 Bail For Grand Jury
A coroner's inquest into the death of John Thomas Scheetz, 17-year-old Point of Rocks boy, was concluded Tuesday afternoo and Detective M.E. Mcgaha, of the Baltimore and Ohio Railroad police, was formally charged with murder in connection with the slaying of the boy, who the policeman admittedly shot on December 14.
The charge was asked for by the tate's Attorney Walter E. Sinn at the conclusion of the proceeding in the inquest and granted by Magistrate Alton Y. Bennett, acting coroner in the case. Bail was set at $5000 and was arranged by the detective, who was then released, pending action of the February term of court.
Young Scheetz died at 7:45 o'clock Tuesday mmorning at the Frederick City hospital following a turn for the worse Monday night which resulted from complications which set in following peritonitis as a result of the gunshot wound in the abdomen. He was thought to have a fair chance for recovery until complication set in which made his recovery unlikely after Monday evening.
At the inquest conducted by Magistrate Bennett State's Attorney Sinn and Sheriff Charles W. Crum the only witness to testify was Vernon Harper Point of Rocks who was with Scheetz when Detective Mcgaha caught them taking coal along the tracks and shot the deceased.
Harper testified that he and Scheetz were sitting along the state road at Point of Rocks near the railroad tracks on December 14 and had several bags of coal with them which he said they had picked up along the tracks. He said Detective Mcgaha suddenly appeared and shouted to them to stay where they were. The boys Harper said, jumped and ran across the tracks with Mcgaha in pursuit and the witness testified tht the detective fired three or four times and he heard the bullets whiz past him. He glimpsed that Scheetz was struck but continued to run until he was behind a car where he said he looked back and saw Detective Mcguha making every effort to help the injured youth.
Mcgaha did not testify at the inquest and following Harper's testimony, the murder warrant was issued. The coroner gave as his verdict that Scheetz came to his death as a result of a gunshot wound inflicted by Mcgatha. Scheetz gave no death bed statement. State's attorney Walter E. Sinn said and added that a statement which the youth made some time before his death would not be admissable as evidence.
Accident Says Detective
In the investigation conducted by railroad authorities into the shooting Detective Mcgaha maintained that the shooting was accidental and that he was protecting railroad property consisting of a stalled coal train when his pistol was discharged.
Mcgatha insisted according to authorities, that he had gone to the stalled coal cars at Point of Rocks following complaints of frequent theft of coal for sale in the community. When he reached the cars, he was quoted as having stated, eight boys and men jumped from the cars and started to run disregarding his orders to them to halt. He said he ran toward them after firing his pistol in the air, but as he went tp climb the safety fence along the tracks he slipped in the soft mud and his pistol was discharged.
Scheetz wounded by the shot, fell near the tracks and Mcgaha seeing his condition summoned an ambulance to take him to the emergency hospital in Brunswick. From there he was brought to the hospital in Frederick.
Eight bags of coal were found alongside the tracks, said by the officer to have been dropped by the fleeing persons. Further investigation disclosed authorities said, that the coal was not to have been taken to their homes for fuel bur was to have been sold. Much coal has recently been bootlegged in the neighborhood for about $2 a ton, it was stated.
Funeral Friday
The funeral of young Scheetz who was aged 17 years 3 months and 21 days will be held Friday afternoon at two o'clock at the Methodist Episcopal church, Point of Rocks.
The youth is survived by his parents, Harvey and Annie M. Scheetz, and the following brothers and sisters, Howard E, Scheetz at home, Mrs. Robert Stallings , Washington D.C., Dorothy, (unreadable), William, Lorraine and Hilda Scheetz, all at home.
Internment will be made in St. Paul's Cemetery, near Point of Rocks. M.R. (unreadable) and Sons funeral directors.
