He filed pension application 28 Jul 1890 claiming service only as pvt in CO G, 3rd TN MTD INF REGT under Lt Col Joseph Divine. After delays in processing his claim, he later added prior service in Capt Goldman Bryson's CO of volunteers. The Payne-Boyd Muster Roll of latter company records that Benjamin F. Payne was captured in action 3 Nov 1863. Lt Clapp who investigated this roll recorded on 17 Aug 1871 that Payne was 1st Sgt in Bryson's CO and was never captured.

B. F. Paine stated in his claim that Rebels had captured his youngest brother (Preston "Press" S. Payne) and killed him 30 Nov 1863 near Coker Creek, TN.

Pension was issued 28 Jul 1890 at $8 monthly, increased to $15 on 20 May 1907, and to $12 on 13 Apr 1904. His widow was granted a pension of $8 monthly, later increased to $12.
