Oliver Cromwell and had to leave native land when the "Protector"

little Hayhurst on the way? That way, they wouldn't have had to confess the sin of
fornication.

Will of Benjamin Hayhurst.
Uncle Lon and (The
source of this inf) visited this
cemetery about 1972-73. Mrs. Holbert is
a
Hayhurst
descendant (Orlando, I believe). Since
Orlando backed Eliza in the lawsuit
over the will and won, Mrs. Holbert showed little interest in her relatives on the Garee side of the
family. The cemetery was in sad shape;
stones fallen over, etc. Uncle Lon set
Ben's stone back on its base, but when
Chris Ramsey and I were there a few years later, many more of the stones were
gone and the graveyard was in the middle of a cattle pasture. I doubt if there's anything at all left now
(1993). "Now and
Then" may be the only source for some of the stones
there that have been
destroyed.
Was a private in Capt. Jesse Ice's Co, Va. Militia,
commanded by Col. Connell, during the
War of 1812. Service and Pension
records are in the National Archives, Washington, D. C.
Second wife: Eliza J. Criss, m. 9/28/1865 in Marion
Co. He was 75 and she
was 24 and Uncle
Lon says she probably married him for his pension.
Children: Romanza, m. ? Jolliffe, a relative of his first
wife, Elizabeth.

One hell of a mess
over his will after he died. Grandma
Nancy Ann Garee
and some of his other kids didn't like the way he left so
much to his
widow and her two kids, so they contested the will. It's all in his will file in Marion Co.,WV.
