Abstract of a deed relating to the title to freehold hereditaments in Belmont Place at Robin Hood’s Bay in the County of York the property of the trustees of the Will of Sir Charles William Strickland Bt deceased

28 March 1877 BY INDENTURE made between John Lightbody then late of Robin Hood’s Bay in the township of Fylingdales in the County of York but then of Kirkcaldy in Scotland Surgeon of the first part Sir Tatton Sykes of Sledmere House in the County of York afsd Baronet and The Reverend Charles Hudson of Trowell Rectory in the County of Nottingham Clerk in Holy Orders of the second part and Charles William Strickland of Whitby Abbey in the County of York afsd Baronet of the third part

AFTER RECITING that by an indenture bearing date 1 Nov 1870 and made between Moses Bell of the 1st part John Emmerson of the second part and John Lightbody of the third part and hereditaments thereinafter described were conveyed unto and to the use of John Lightbody his heirs and assigns for ever

AND RECITING the abstracted Indre of Settlement of 7 September 1868

AND NOTICING the death of Sir George Cholmley on the 23rd December 1874

AND STATING that the hereditaments thereinafter described were convenient to be held and enjoyed along with the Whitby Estates comprised in and settled by the Indre of Settlements and Sir C.W.Strickland who under or by virtue of the limitations contained in the Indre of Settlement was tenant for life of the Whitby Estates being therefore desirous that the same hereditaments should be purchased by the Trustees of the Indre of Settlement in pursuance of the power for that purpose in the same Indre contained did by writing under his hand request Sir Tatton Sykes and Charles Hudson Had accordingly agreed with John Lightbody for the absolute purchase for the sum of £400 of the same hereditaments and the fee simple and inheritance thereof in possession free from all incumbrances And Sir C.W. Strickland had also requested that the hereditaments might be conveyed to the uses and in manner thereinafter by reference limited and declared of and concerning the same

IT IS (by the now abstg Indre) WITNESSED that in conson of £400 to John Lightbody paid by Sir Tatton Sykes and Chas Hudson out of moneys raised by them for that purpose under the power contained in the therein before recited Indenture of Settlement (The rect acknged) The John Lightbody at the request and by the direction of the said Sir C.W.Strickland testified &c did thereby grant and convey unto the said Sir Tatton Sykes and Chas Hudson and their heirs

FIRST ALL that plot of ground (being part of a parcel of ground commonly called or known by the name of Little Pitts situate in Robin Hood’s Bay afsd in a place commonly called Belmont Place containing in breadth at the South West and thereof 25ft 6ins and on the North East and thereof 24feet and in length on the West side thereof 26 feet 6ins and on the East side thereof (including the road as far as the same extended to the property then late belonging to Francis Bulmer deceased measuring in length 7ft 6ins) 34 feet were the same several measurements and quantities respectively more or less Boundering on a back street or road called Bloomswell on or towards the South West on other property then late belonging to William Storm and secondly thereinafter described and expressed to be thereby granted on or towards the North East; on a dwelling house then late belonging to George Granger but then or then late to Nathan Hewson on or towards the West; and on a Garden then late belonging to Francis Bulmer deceased but then to the Parties thereto of the second and third parts on or towards the East

AND ALSO ALL those two messuages or dwelling houses and all other erections and buildings erected and built and then standing on the said piece or ground thereinbefore described

ALL which sd heredits first thereinbefore described were then late in the several occupations of Moses Bell and William Storm and one whereof was then occupied by Stephen Crosby the other being unoccupied

AND all other the heres comprised in a certain Indre bearing date 17th April 1852 and made between William Storm of the one part and Moses Bell of the other part and expressed to be thereby appointed and granted

BUT except and reserved out of the now-abstg Indre and the Convce intended to be thereby made all such rights of road way and passage as were excepted and reserved by the therein lastly mentioned Indre

SECONDLY ALL THAT plot containing in length from North to South 12 feet 2ins or thereabouts (the extreme N.W. end thereof being in a straight line with the back part of the building called the Esplanade) and in breadth from East to West (including a road or passage 4ft 9ins wide then lately formed and made by the sd Moses Bell) 22ft 4ins or thereabouts were the same several measurements and quantities more or less situated in Little Pitts in Robin Hood’s Bay afsd in sd Belmont Place

Boundering on the sd Garden and pres then late belonging to Fra: Bulmer and then to the sd Parties thereto of the second and third parts on or towards the East; on heres first thereinbefore described on or towards the South; on the dwghse and propy then late belonging to George Granger but then or then late Nathan Hewson on or towards the West; and in part on a parcel of ground then late belonging to John Emmerson but then or then late to Nathan Hewson and in the remaining part of the hereditaments thirdly thereinafter dscrd on or towards the North

AND ALSO so much and such part of the wall immediately adjoining the sd garden then late belonging to Fra: Bulmer deceased (and which separated the sd garden from the thereinbefore mentioned road or passage 4ft 9ins wide) as was co-extensive with the sd Plot or piece of ground expressed to be thereby granted

AND ALSO all that messuage or dwelling house and all other erections and bldgs redected by the sd Moses Bell on the sd Plot or piece of ground secondly thrnbfe described

ALL which sd heres 2ndly thereinbefore described were then late in the occupation of Joseph Burnett and were then unoccupied

AND all other the hereditaments comprised in a certain Indre bearing date 6 Nov. 1852 and made between John Emmerson of the one part and Moses Bell of the other part and expressed to be thereby appointed and granted

BUT except and reserved out of the now abstg Indre and the Conveyance intended

to be thereby made all such rights of road way and passage as were excepted band reserved by the same lastly therein mentioned Indre

THIRDLY ALL that piece or parcel of ground situate in Little Pitts in Robin Hood’s Bay afsd and then or then late in the occupation of Moses Bell

Boundering on the sd Garden and pres then late belonging to Francis Bulmer deceased and then to the Parties thereto of the second and third parts on or towards the East; on the heres secondly thereinbefore described on or towards the South; and land then or on late of Nathan Hewson on or towards the West; and on lands then formerly alleged to belong to George James Watson Farsyde deceased on or towards the North

TOGETHER with a free and perpetual right of way and passage to and for the sd parties thereto of the second part their cestuis queuse and assigns and their agents servants tenants and under tenants and the occupiers for the time being of the said piece or parcel of ground thirdly thereinbefore described and any messuages and other buildings for the time being erected thereon through over and along across or upon a certain road or passage 4 feet 9ins wide leading from the street or road called the Back Road from Bloomswell in a North Easterly direction to the sd Piece or parcel of ground

AND TOGETHER also with all he outhouses &c

AND the reversion &c

AND the estate &c

TO HOLD the pres with the appurtenances unto Sir Tatton Sykes and Chas Hudson & their heirs

COVENANTS by John Lightbody for himself and his heirs but for and against the acts and defaults only of himself and all persons claiming or to claim through under or in trust for him with Sir Tatton Sykes and Charles Hudson their heirs cestuis que use and assigns

And for further assurance
