Mr. Wilson deponed -I commenced business in Tranent along with my brother in the year 1859. I was for seven years in partnership with him. When I went into partnership, I had £500 of my own, and a property worth £300, and I succeeded to £500 at my father's death in 1860. I ceased to carry on business along with my brother in the year 1868. I took nothing out of the business with me. The books of the firm lay for some time before Mr W. Watson (deceased), writer in Haddington, and they were afterwards, on behalf of the partnership, laid before Mr Lindsay, accountant in Edinburgh. Mr Lindsay found that there was a sum of £305 due me. That sum was never paid me by my brother. I afterwards made him a further advance of £300 in various sums. My agents, Messrs Paterson & Cameron, S.S.C., Edinburgh, agreed to get me a disposition in security over some property in Tranent, belonging to my brother and his wife for the whole sum due to me by my brother. I understood I was to draw the rents of the property, and after deducting the interest due on my debt, to hand over the balance to my brother. The disposition in security was prepared and extended but never signed. Mr CAESAR moved an adjournment of the examination to allow him to make further inquiry into the affairs of the bankrupt. I do hereby nominate and appoint my said Trustees above named ... First ... pay all my just and lawful debts death bed and funeral charges, Second ... pay all such legacies ... by any Codicil thereto ... Fourth ... convey and make over to the said William Wilson ... the tenement of houses and land in the Town of Ormiston second above disponed, as also the foresaid lease of the Park third above disponed ... together with the whole garden and other implements which may be upon the said lands at the time of my death ... and also two horses and one cow ... under the condition that he shall make payment at the first term of Martinmas after he shall have sown and reaped a Crop, of the sum of sixty pounds Sterling to each of my following children namely Ann Wilson spouse of Robert Wight Draper and Hosier at Dalkeith, Andrew Wilson, George Wilson and John Wilson ... my son Alexander Wilson having already received from me sums equal to the above sum of Sixty pounds provided to my said other children the sum to be paid him by his said brother William Wilson is hereby restricted to Five pounds Sterling ...
