JACOB HOOTS WILL

Record of Wills, Book 3, p. 45, Dobson Courthouse, Surry County, North Carolina

This nineteenth day of February, in the year of our Lord one thousand eight hundred and one, I Jacob Hoots of Surry County and State of North Carolina being of a perfect mind and memory do make and ordain this my last will and testament touching such worldly Estate where it has pleased God to bless me with in this life which I give devise and dispose of in the following manner; in the first place it is my will that all of my just debts and funeral charges be paid.

Secondly, I lend unto my beloved wife on hundred acres of land where on I now live with the dwelling houses and all out houses with the house and kitchen furniture induring her being my widow and after her decease the hundred acres of land to go to my son Daniel Hoots also one horse, two cows, four sheep, and four hogs of her own choosing also one womans saddle and bridle and after her decease it is my will that my daughter Mary Hoots shall have one feather bed, furniture and also Margaret one feather bed and furniture and the rest of the house and kitchen furniture to be equally divided between my two daughters Mary and Margaret Hoots one iron pot to said Mary and one kettle to said Margaret Hoots to them and their heirs forever.

Thirdly Item, I give unto my son John Hoots one hundred acres of land Whereon he formerly lived and whatever he has of mine in his possession to him and his heirs forever.

Fourthly Item, I give unto my son Anthony Hoots one hundred acres of land whereon he now lives and also whatever he hath of mine in his possession to him and his heirs forever.

Fifthly Item I give unto my son Peter Hoots one hundred acres of land lying ajoining the lines of George Bates, and and Jacob Garner on Harmons Creek and also what he hath of mine in his possession to him and his hears forever.

Sixthly Item, I give unto my son Henry Hoots one hundred acres of land of the old tract and also whatever he hath of mine in his possession to him and his hears forever.

Seventhly Item I give unto my son Daniel Hoots one young black horse saddle and bridle to him and his heirs forever.

Eightly Item I give unto my three Grandsons Viz David Hoots and Jacob Hoots (the sons of Jacob Hoots deceased) and Jacob Hoots (the son of Phillip Hoots deceased) one hundred and fifty acres of their land joining Peter Hoots hundred acres to them and their heirs forever.

Ninthly Item My will is that my wagon and gears and the residue of my cows hogs and sheep, one mare and two colts one loom one dutch fan and also all of my plantation tools (viz) to Henry Caul, John Hoots, Anthony Hoots, Peter Hoots, Hen. Hoots, Daniel Hoots, to them be equally divided.

Tenthly Item I give unto my beloved wife Margaret Hoots the Indian canoe in the creek the grain now in the field to be secured by my sons and to give my wife the third part of the crop.

And lastly I do constitute make and ordain Fredrick Shores John Hutchens my whole executors of this my last will and testament utterly disallowing all my former will made.

In testimonial I have hereunto set my hand and affixed my seal the day and date above written.

State of N.C., County of Surry, August Session 1801

James and Rachel Todd the subscribing witnesses to the foregoing last will and testament of Jacob Hoots (deceased) and made oath that they saw said Hoots sign publish and declare the same to be his last will and testament that he was of sound mind and disposed mind and memory which was ordered to be recorded.
