This is the last will and testament of me, James Crossley of Midgelden Clough in the Township of Todmorden and Walsden in the Parish of Rochdale in the County of Lancaster, Weaver.

 

Whereby my will and mind is that all my debts, funeral expenses with all the necessary charges and expenses which may be incurred in and about the proving and execution of this my will, shall be all first paid off and discharged out of my whole substance or estate by my executors hereinafter named and appointed, together with their own reasonable wages and expenses for their trouble in and about the execution of this my will.

 

And then I will my executors or the survivor of them or the heirs and assignees of the survivors to put and place out at interest on some good security or securities the sum of two hundred and fifty pounds, and the interest dividends and annual produce thereof I will them to pay unto Sarah, my well-beloved wife for and during her natural life. And so soon after my said wife's decease as the same can be collected and got in by my executors, I give and bequeath the said principal sum of two hundred and fifty pounds equally unto and amongst my five children, namely; Mary, John, James, Ely and Betty, or the survivor or survivors of them, share and share alike, charged nevertheless with the payment by them in original shares of my wife's funeral expenses.

 

And as touching the residue or remainder of my property over and above the said sum of two hundred and fifty pounds, in case there shall happen to be any, subject to the proviso hereinafter mentioned, I give and bequeath the same equally unto and amongst my five children before named, or to the survivor or survivors of them, and I will the same to be paid to them at the end of three months next after my decease.

 

 

Provided always, nevertheless, and it is my will and mind that she, my said wife, shall have the use and usage only of the bedstead and bedding on which we used to lie, for and during the term of her natural life, but not to sell or dispose of the same anything hereinbefore expressed or implied to the contrary in any wise notwithstanding.

 

And lastly, hereby revoking and making void all former and other wills by me heretofore made, I do publish and declare this to be my last will and testament, and thereof do nominate, constitute and appoint my said son, John, and my son-in-law Ely Sutcliffe of Ewood Mill, joint executors of this my will, hoping they will faithfully execute the trust I have in them.

 

Given unto my hand and seal this twenty-fifth day of January in the Year of Our Lord One Thousand Eight Hundred and Thirteen.
