30th. July 1594

James Fielden of Bothomley

I James Fielden of Bothumley pyshe of Rachdall yeoman, make this my last will.

Yt is my will yt James Fielden my Uncle shall occupye the one halfe of one close called the blacke Karre now in the occupacon of Cisley Fielden, the wyffe of James Fielden, deceased, for lyffe of the said James Fielden, and after the death of the said James, yt shall be occupied as the rest of my land is.

Also yt is my will that yf Issabell Fielden, my wyffe, be now wyth child wyth a sonne, that then, my said sonne shall be my sole heir and have my whole lands and shall enter upon the same when 21 and when 21 he shall paye unto Mary Fielden, my daughter, £20.

And yf my wyffe be with child wythe a daughter, then yt is my will that all my lands shall be devided betwixt them.

Further yt is my will that Issabell my wife shall have the bringing upp of my children and the occupacon of my lands until my children accomplish 21, yf my said wyffe so longe doe lyve and kepe her sole. And yf she depart this lyffe or marye, yt is my will that James Fielden, my Uncle and William Schofield, my brother in law shall have the rule of my said children and lands until my said children accomplish 21.

Further yt is my mynde that the dwellinge house which my grandmother now dwelleth in the barne amd one close which she now occupyethe called Acker, shall remain unto my wyffe after the death of my grandmother, to be occupied as my land ys before appointed, and that James Fielden, my Uncle, hath confessed or promised that my wyffe and children shall enter upon the said dwellinge howse, barn and close, without any disturbance or trouble of him, the said James.

And for my moveable goods, yt is my will that they be devided into three pts, one pt thereof I give unto Issabell, my wyffe, the second pt I give unto Mary my daughter and such child as my wyffe is with child with, and the pt beinge mine owne, I give unto Issabell, my wyffe, Mary my daughter and such child as my wyffe is wyth child wythall.
