LAST WILL AND TESTAMENT OF JOHN FIELDEN

This is the Last Will and Testament of me, John Fielden of Warland in the parish of Rochdale and County of Lancaster, farmer, as follows.

I do give and bequeath the sum of three pounds to be equally divided amongst all those my grandchildren, the children of my son Abraham, now deceased.

 

And also the sum of three pounds to be equally divided amongst all those my grandchildren, the children of my daughter Susan by John Shackleton, she being also dead.

 

And I do give and bequeath unto my son in law, the said John Shackleton, the sum of one shilling.

 

And also to my daughter in law, Betty Fielden, the sum of one shilling to be paid to them separately and respectively in twelve months next after my decease.

 

And I so further will and direct that my wife Mary be permitted to take the profits and interest of all my estate and effects for her own maintenance and support during her life, and in case that should prove insufficient for her necessary support, that she be permitted to take so much of the principle as will make up the deficiency. And that after her decease, all my just debts, funeral and other expenses, being first paid, all the rest and remainder of my personal estate and effects whatsoever and wheresoever the same, may then be found, shall be equally divided amongst and between my children, namely Nicholas, John and Mary Fielden, share and share alike.

 

And I do give and bequeath the same accordingly and do nominate, constitute and appoint my sons John Fielden and Nicholas Fielden jointly to be executors of this my last will and testament.

 

In Witness whereof I do hereunto put my hand and seal, the seventeenth day of July in the year of our Lord one thousand eight hundred and seven.

And I do give and bequeath the same accordingly being first interlined? In the presence of us who at his request in his presence do hereunto subscribe our names as witnesses.
