Jeremiah Bailey of the town of Catlin Chemung Co being duly sworn says that a copy of the within citation was served by him on Linus Bailey and Lewana Far the 22nd of June inst. and also on Willard Bailey the 23rd day of June inst. being known to him personally to be the persons named in the written citation. Alexander Ganung being duly sworn says that on the 24th of June 1859 served a copy of the written citation on Abaigail Boyer personally known to be the person named in the within citation. To Wilson Bailey take note.
That on the probate of a certain will said to be the last will and testament of John Bailey bearing date Aug. 8, 1856,  the following point, will be forever  viz.
1- That prior to the year 1856 the said John Bailey became  enfeeble in body and in MInd.
2- That the said will was not written in whole as the said John Bailey directed.
3- That Bela Sanford aided in the framing of said will.
4- That prior to the year 1856 the said John Bailey frequently said that Wilson Bailey was determined to
     drive him of to get what he has and that Wilson Bailey had threatened his life.
5-  That the year 1856 down to his last sickness the said John Bailey  became afraid so that he kept his      doors and windows blackened and weapons of defense by his bed.
6-  That the said John Bailey frequently said that that it was them threats that he made his will that is  was not as he meant to have it done.
7- That thense his last last sickness down to his death the said John Bailey frequently called for them   papers in the hands of Sanford for he wanted them destroyed. and was told they were destroyed after  which the said John Bailey gave the directions that he wanted his children to share alike.
8-  That Wilson bailey and others told Rosena Bailey that if he John Bailey called for the bill at any time  tell him that it was destroyed and she had told him so.

ELIJAH TRACY To the Surrogate of the County of Schuyler the Petition of Caroline Tracy of the town of Dix in the county of Schuyler. That Elijah Tracy late of the town of Dix in said County of Schuyler deceased died in the said town Dix on or about the 10th day of January in the year of our Lord one thousand eight hundred and eighty six. being at the time an inhabitant of The County of Schuyler that he died. leaving a last will and Testament, which is now produced in the Surrogate Court of Schuyler before me the said Surrogate, which bears date the 16th day of December in the year of our lord one thousand eight hundred and 78 and by which said last Will AND testament the said deceased nominated and appointed Caroline Tracy executrix .
The following named person  are heirs at law and next of kin of the said deceased, and their respective ages and places of residence are as follows, viz. Jane O Rappelee, Phebe Coil and John F. Tracy all of Full age and reside in Schuyler county and state of New York.

Be it  Remembered that one the 21st day of June, 1886 the last will and Testament of Elijah Tracy, late to the town of Dix in said county, deceased, (being the annexed written instrument,) was duly proved before the said Surrogate as a Valid Will to pass real and personal property; which said last Will and Testament of said deceased, with the proofs and depositions taken thereon, are recorded in this office in Liber 9 of Wills at page 499. In Testimony Whereof, we have caused the seal of office of our said Surrogate to be hereunto affixed. Witness, Martin J. LAST  LAST WILL AND TESTAMENT-ELIJAH TRACY
In the name of God, Amen. I Elijah Tracy of the town of Dix, County of Schuyler,---being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last will and Testament that is to say..First After all my lawful debts are paid and discharged, I give and bequeath unto Caroline Tracy my wife  all the real Estate of which may be seized of at the time of my decease.
Second, I will and bequeath unto my wife Caroline Tracy all the personal property that I  may have at the time of my death.
Third, I will that my wife Caroline Tracy pay unto my Daughter Phebe Coyle the sum of One hundred dollars to be paid at any time when convent for her to pay that sum. Fourth the above bequests to Caroline Tracy are for her use and she has the right to do with and dispose of The same in any manner that she sees fit to do. Likewise, I make constitute and appoint Caroline Tracy to be executrix of the last will and testament hereby revoking  all former wills by me made. On  other papers were also Matters in the guardianship of  the two children of Philander J. Baker and Elizabeth Baker.
It mentions that relatives of the said minors residing in the county of Schuyler are the Paternal grandfather Daniel Baker and their paternal uncles Hiram Baker, Johnson Baker and Wesley Baker  and the maternal  uncle Lockwood Brush.
Each had to pay in personal property  to the value of about fifty dollars each, as they will aid in helping in the raising of the said minor children.

GUARDIANSHIP OF KING J. BAKER AND HARRIET E. BAKER.

Know all men that Elijah Tracy and John G Tracy are held ------- bound  with King J. Baker and Harriet E. Baker minors under fourteen years of age. In the sum of three hundred each to be paid
to the said minors, their heirs, executor, administrators on -------to which bequeathed. Each of our heirs executors, administrators  jointly and ------firmly by these present. Value with out seals and dated this 5th day of June, 1858.
The conditions of this obligation is such that of the about bounder Elijah Tracy shall and will faithfully in all things discharge the duties of a guardian   to the said minors  according to law and sudden a true and just account of all moneys and other property received by heirs, and of the application thereof and of his guardianship in all respects to any county having co organizer there of when th ---- required then this obligation to be void, else to remain in full force and vested.

In the matter of the Administrations of the goods, chattels and credit
of Philander  J. Baker and Elizabeth Baker Deceased.

To Simeon L Rood, Surrogate of the county of Schuyler.
The Petition of Elijah Tracy of the town of Dix  in said county respectfully showith that he is the General Guardian of King J. Baker and Harriett E. Baker, the minor children of the said Philander J. Baker and Elizabeth Baker, late of the said town of Dix in said county, now both deceased.
That the said Philander J. Baker departed this life in the said town of Dix on or about the 23rd of October 1857, without leaving any last will and testament to the knowledge information on belief of your petitioner. That said deceased left him surviving his widow the said Elizabeth Baker and his two children the said King J. Baker and Harriett E. Baker, both of whom are minors under fourteen years of age. That on the 10th day of November 1857 Letters of administration was granted by the Surrogate of the said county of Schuyler to the said Elizabeth Baker widow of aforesaid.  That on the fifth day of June 1858 the said Elizabeth baker filed her petition to the surrogate of the said county praying the said surrogate to appoint  your petitioner the General Guardian of King J. Baker and Harriett E. Baker minors as aforesaid.  That on the said fifth day of June 1858 the said surrogate did appoint your petitioner the general guardian of the said minors until they shall survive at the age of fourteen years and until another guardian shall be appointed. That on the(blank)    day of August 1858 the said Elizabeth Baker widow and administratrix as aforesaid departed this life in the town of Dix aforesaid without having any last will and testament, to the knowledge information on belief of this departed and leaving certain of the goods chattels and coedite? of the said Philander J. Baker deceased, unadministrated. That your petition has to the best of his ability estimated and ascertained the value of the personal property of which the said  deceased died hopeful? either in her own right or as administratrix as aforesaid and that the same does not exceed the sum of five hundred dollars.
That the said King J. Baker and Harriett E. Baker both of whom now reside in the town of Orange in  said county of Schuyler an the only surviving children of the said Philander J. Baker and Elizabeth Baker deceased. and your petitioner is informed and believes that he is entitled  to administer of the goods chattels and credits of the said deceased  as the guardian of the said minors and he therefore prays that such letters of administration may be granted to him in presence of the state in such corseted? and provided. Dated this 18 day of September 1858.

A Petition dated July 18, 1864.  Elijah Baker had to submit a full account and  notice of all
of the transactions that took place after taking charge of the goods of the minors guardianship.
He states that at the time of Philander Bakers death he was possessed  certain property and certain personal property in the town of Dix for which he held an appraisal contract upon which there was some two or three hundred dollars due and unpaid.
Elizabeth Baker having sold most of the personal property soon after Philander died to pay off the debts. She to sickened and in August 1858 but about ten months after the deceased of her husband she died. It appears that the previous matter of after said death of Elizabeth  Baker she had put certain overdue notes (amounting in  the aggregate to very nearly the amount due upon the land contract) into the house of William Diven Esq. of Reading the agent for the sale of the land, the money collected   upon said notes to be applied upon said contract. These notes it is believed were all subsequently paid and the contract paid up but no deed yet obtained.
Philander Baker in his life time had contracted to sell a small piece off the south side of this farm and received his pay from the same agreeing to give a deed  therefore as soon as he should be able to obtain one. After Elizabeth s death the deed had not yet been given and so Elijah petitioned to have this deed given to the purchaser. Some of the moneys were paid to the doctor to take care of Elizabeth in her illness.
Upon the decease of the mother the children went at once to live with their mothers grandmother who at the time was the wife of Benjamin Ellis where they continued to reside  and have watchful care that children need, during their time to reach the age of being able to go out on their own.

In the death of Herbert l. Brush on Thursday Sept 29, 1949 Montour Falls lost a prominent and respected citizen. He was born Oct. 24, 1876 at York Pa., the son of Eugene L and Annie M. Cole Brush.His wife Delia Rhodes Brush and their son Merle Brush, of Willamsport Pa. survive him. There are two two grandchildren Beverly and Richard Brush of Williamsport. Funeral services were held at 11;30 a.m. Saturday at the Scott Funeral Home in Montour Falls, the REv. William J. Carmell officiating . Burial was in wilwood cemetery, Williamsport, Pa.He received his early education in the public schools at Beaver DAmns and Moreland and he attended Starkey Seminary. As a young man he clerked in the M. N. Weed store in Montour Falls in 1915. He entered into partnership with Charles m Weed in the firm of Mn. Weed INc. and and continued with the department store in Montour Falls until he retired in 1945.  Mr. Brush was a Christian gentleman, devoted to his church and upright citizen faithfully following the path of duty. He was and Elder in the Presbyterian church of Montour Falls until it was dissolved in 1934 when he and his  wife joined the Presbyterian church in this village where he was an Elder at the time of his death.
Mr. Brush's hobby was his business .  He was the ideal manager of the general country store. knowing everyone in the countryside. His quiet humor and friendly understand won him a host of loyal friends who mourn his loss.

I, Franklin Bump aware of the uncertainty of life, do make, ordain, publish  and declare this my lst Will and Testament, in manner and form following that is to say:
First; I give and bequeath to my beloved wife Elenor the use of all my estate of which I may be possessed at the time of my death during her natural life.
Second; After the death of my wife Elenor I give and bequeath to my son Franklin H. Bump and his wife Adelia the used of all the estate both personal and real during their natural lives.
Third' After the death of my son Franklin H. Bump and his wife Adelia I desire and bequeath the estate to be equally divided between my grand children heirs of the bodies of Franklin H. Bump and Adelia Bump.
Likewise, I make, constitute and appoint my wife Elenor and after her death my son Franklin H. Bump to be executrix of this my last will and testament, hereby revoking all former wills by me made.

Delia Bump, wife of Franklin Jr, Alice Johnson, sarah Hooker, Florence Bump, Louise Bump, George Bump, Wilson Bump, William Bump. The said Louise Bump, George, Wilson and William are infants under the age  of fourteen years. Alice Johnson, Sarah Hooker and Florence Bump are infants over the age of fourteen years.

EVERT VOSBURGH
The last will and testament of Everet Vosburgh deceased. Henry Vosburgh,  executor named in the said will appeared before the said surrogate and officer the said will for probate and made satisfactory proof of the residence and of the death of the said tester by the following. Henry Vosburgh of the town of Reading in county of Steuben being duly sworn deposeth and saith that he was aquatinted with the said Evert Vosburgh the above named Testor in his lifetime. That the said Evert Vosburgh died at Reading in said county on or about the 28th day of July 1832, and that he was and immediately proceeding his death an inhabitant of the said county of Steuben. Henry Vosburgh placed his mark.  signed by R. Campbell surrogate of Steuben Co.
Henry stated that the death of Evert Vosburgh in Reading, Steuben county NY on or about the 18th of July 1832. Names mentioned as having been present at the last will signing: John Dow, Daniel Washburn and John Washburn. In the will Heirs are mentioned sons Henry, John, Isaac E., and daughters Magnalane Little, Cornelia Bunce.

The last will and Testament made by Daniel. King J Baker was appointed administrator.
In the matter of the last will and testament of the late Daniel Baker deceased.
This matter being duly called at this hour and King Ja Baker the Executor named in said will having appointed in person and Johnson Baker, Lorenzo W Baker. Sally Baker (widow)and Harriett E Kendall also appeared. Hiram baker appeared and Johnson Baker  held open until 1/2 hour past twelve o'clock.
Mrs. Baker widow asks as to her depositions of subscribing witness taken. On application of Johnson Baker and Hiram Baker, the further hearing often matter is adjoined to Tuesday the 31st. day of October 1871 at 10 o'clock am.

King Baker executor named in said will appeared and also Hiram Baker, Johnson Baker, Lorenzo W Baker, Sally Baker widow appeared. The above named persons appeared on this case being called.
Hiram Baker wishes to make a proposal or two, in regard to the will.
1-To throw the will aside.
2-To pay the debts, and then divide the balance equally between the heirs.
LW Baker object to the first  proposition and consents to the second.
King J Baker objects to both.
Van Allen, attorney for Johnson Baker wishes an adjournment for the purpose of filing allegations against the validity of the will.
On motion of Van Allen no one apposing, ordered that the further hearing of this matter be adjoined to the Wednesday November 15th 1871 at 10 o'clock AM.

November 21st 1871 King Baker took the oath. The Appraiser. (He listed all the belongings of Daniel Baker which amounted to $384.55 total.) Brewster Platt of town of Dix Schuyler county, and Anson Ba(ss)ggard took the appraiser oath. (the listing took in all that was owned by Daniel Baker and it was sold? and or split between the people mentioned)
Sally Baker was awarded one bed, Bedding, stove and cooking utensils. Sox chairs, 6 cups and saucers, 6 plates, 6 knives and forks. I tea pot, sugar bowl and cream cup-1 family bible and books. 2 swine, one white cow.
Court continued open for more than an hour waiting for other parties interested to appear. and no one besides those mentioned appearing.
It was ordered on motion of The council for The executor that said Last will and Testament be upheld.
On the 15th of November King J Baker Executor of Daniel Baker deceased, respectfully shows: that your petitioner King J Baker  was duly appointed and qualified by the Surrogate of the county of
Schuyler, Executor of the said Daniel Baker late of the town of Dix in said county on the 15th day of Novemeber1871. He took the oath required by law, and entered upon the discharge of his duties as such Executor and that eighteen months and upwards have expired since such appointment.
The Creditors of Daniel Baker are SL Rood of Watkins, Robert Bell of Orange, LWesley Baker of Dix.

Last Will and Testament
In the name of God Amen, I, John Van Duyne of Niles. Cayuga County and Sate of New York, being of sound mind and infirmentery, thank Almighty God for the sanity, do make and publish this my Last will and Testament in manner and form following that is to say
First. I do Hereby give, to and bequeath with my Son Henry Van Duyne his heirs and  forever Ninety- nine acres of land to be Surveyed of front the South Side of my lands, situated on lot number nineteen, in the original town of Scipio, now town of Niles, to begin at the south east corner of my land, this being also the South East corner of said lot, number nineteen from thense north so far north that a due will line parallel with the south line to the Owasco Lake shall contain Ninety nine acres of Land as above stated. I hear by give, desire and bequeath with my son Peter Van Duyne, his heirs and always and  forever, One Hundred and ten acres of my land, being also a part of said lot number nineteen, and described and bequeathed to my said son Henry from thense north to the northeast corner of my land, from thence went to the south west corner of land I purchased of Peter Van VanArsdall, deceased and from said corner to continue a due west corner with said line that stake the center of the brook in the land givith-front thence along the middle of said brook to the Owasco Lake, provided however that in case after having been surveyed as I have ordered, Thee shall not be laid sufficient within the described boundaries to contain one hundred and ten acres, their I do Hereby order and direct that from the said VanArsdall corner, the west line of my said son Peters  land shall be extended so far north that in following the center of said brook as aforesaid to the Lake. the content of land shall be one hundred and ten acres and said provided also if by running his west line due west from the VanArsdall corner to the center of said brook and givith the Lake the shall be found to be more than one Hundred and ten acres, their I do Hereby order and direct the four said VanArsdall acres a line shall be extended south so far from said corner that a due west line down to the center of said and brook to the lake shall contain one hundred and ten acres of land at as aforesaid.
Thirdly I do Hereby give and bequeath to my son James Vanduyne or as his name should said James Vantine Vanduyne, and to his heirs and after forever, all the remainder or residue of my land situated on said lot number nineteen(19) aforesaid.
Fourthly. I do Hereby give and  said bequeath to the children of my deceased daughter Margaret. wife of John W Duryee, all the certain piece of’ land situate in the town of Mount Morris, Livingston County, known as a part of lot number Ninety three, to be dived equally to three and share alike, to their lawfully heir forever.
Fifthly, I do also Hereby give, desire and bequeath to my said son James all the lumber and building materials at the saw mill and elsewhere provided by son John deceased, my household furniture, and also my old lumber wagon. Sisthly, I do Hereby give, bequeath and deoi-e? all the remainder of my personal property to my said sons Henry, Peter, and James to be divided share and share alike, in equal portions to them, their heirs and assign.
Seventh-I do Hereby appoint James A Briukerhoff and my son Peter Executors of this my Last will and testament, and as soon as convient and without unreasonable delay after my decease came the several pieces or parcels of land afore described to be surveyed under their direction to establish the lines and several boundaries. I have described for said sons, and in all matters to carry out and execute the several provisions of my will and I do hereby revoke all former wills by me made. The said deceased was at the time of his death an inhabitant of the said County of Cayuga that he has left a last will and testament which is dated the first day of May in the year of our Lord one thousand eight hundred and forty five. That in and by the said will the said deceased appointed your petitioner and George H Brinkerhoff Executors thereof that the said deceased left the following heirs at law and next of kin, to wit, Henry Vanduyne, James Vanduyne of Niles, Cayuga County said petitioner, children of Deceased, George Duryee, Rachel Amerman wife of Isaac Amerman of Mount Morris, Livingston County, Gertrude E Deprey wife of Isiaah C Deprey of Brockport, Monroe County, Henry L Duryee of Cayuga County, Ohio, precise place of residence unknown, grandchildren of the deceased. That the said Henry L Duryee is a minor and has no general guardian, that the said deceased left Mary Vanduyne his widow, who resides in Niles aforesaid. That said, will relates to both real and financial estate. That your petitioner is desirous of proving said last will and testament are a will of real and personal estate, that the same may be recorded as said in presence of the estate in such care made and provided your petitioner there fore prays the Surrogate aforesaid that the necessary steps may be taken before him for that purposed, and that Edison B Marion of Auburn in said County of Cayuga may be appointed special guardian for the said minor heir for the sole purpose of appearing for him and taking care of his whereabouts in the further proceeding in this matter. In the matter of the last will and testament of John Vanduyne, deceased, I was well aquatinted with John Vanduyne of Niles in Cayuga County. I was present when a certain instrument in writing now here shown to me dated the first day of May in the year of our Lord one thousand eight hundred and fifty five, and purporting to be the last will and testament of said deceased was executed. I saw the deceased execute said intestiment of signing his name thereist. I heard him publish and declare the name to his last will and testament. The deceased requested me to become a subscribing to the executor thereof. I did so and signed my name there as such in interest in his presence. The said deceased was in my opinion at the time of execution of said instrument be of sound and deposing mind and Memory, and in a respect competent to make and publish last will and testament and to death of estate, that he was of full age and under no restraint that I knew of. The said deposition further says that James E Brinkerhoff the other subscribing to said will is dead that he said the subscribed his name to said will in the presence of deceased and the same time subscribed the same in writing.

The petition of Jacob VanDuyne respectfully sheweth that Dennis VanDuyne then an inhabitant of the county aforesaid died in the town of Cameron in the county aforesaid on or about the 3rd day of March 1832, that he left Polly VanDuyne his widow who had duly renounced her right to letters of administration on the estate of the deceased and your petitioner, and Dennis VanDuyne, Littia the wife of Joseph Howell, Anna the wife of Jonathan  baileys, Phebe VanDuyne, hannah VanDuyn, Daniel VanDuyne, Hannah VanDuyne, David VanDuyne, and Eleanor VanDuyne, his children surviving: that he died from sickness and left no will so far as your petitioner has been able to discover or has  heard: that in the opinion of your petitioner the whole of the personal property left by the said Dennis VanDuyne  will not amount in value to more than two hundred dollars.  Your petitioner therefore prays that letters of administration may be granted according to law. In the matter of the proof and probate of the last will and testament of Peter VanDuyne
Be it remembered that on the 25th day of October 1880 Watson L Vanduyne and Mary A Rosa Executor named in the las will and testament of Peter VanDuyne late of the town of Niles in the county of Cayuga NY appeared in open court before the surrogate of said county made an application to said will which relates to the real and personal estate and in each application said surrogate ascertained by satisfactory evidence  that the said deceased departed his life n or about the 13th day of October 1880 and who his heirs at law and next of kin with the respective places of residence citation was on the 20th day of November 1880 satisfactory evidence.                                           WILL
 In the name of God amen. I Peter VanDuyn of town of Niles in the county of Cauyga and State of New York being of sound mind and memory and considerable uncertainty of the frail infirmentery life do make and publish and declare this to be my will and testament, that is to say,
First after a debts are paid and discharges, I give to my wife Mary Ann VanDuyne all my household furniture and other articles used in housekeeping. I give to my said wife the entire control over occupancy of all my real estate during the time of her life she pay all the taxes of every kind known, and of the income from the 8 acres. she is to be comfortable without maintaince for her to  support her living comfortable.Third to reserved out of my farm the following described piece of land for a family burying ground on all times, beginning a the point in the center of the highway on the line between my land and George M Duryea and  thence east along his lands and to the lands of P A Mc Dowell to the north east border of the burying grounds as now fenced. Thence south four rods thense west parceled to the first described line to the ot he -------  thense north along the center highway to the place of beginning together  with one hundred dollars out  of my real estate to keep the same in repair. Fourth at the decease of my or where she shall cease to be my widow, I  hereby empower and direct my executors to sell and dispose of my real estate as soon as it is said or done for the best interest  of the estate and give the necessary title to convey the same and of the one hundred dollars above mentioned. They are to keep at interest and expected in repairs on said grounds where necessary to be done to divide the proceeds together with the proceeds of the sale of personal property not above bequeathed equally to my children or their legal survivors. Likewise I make  and appoint Watson L .VanDuyn and Mary A Rosa to be executors of this my last will and testament hereby working all previous wills by me made. I subscribe my name and fix my seal the 24 day of September in the year of Our Lord one thousand eight hundred and Eighty. Peter VanDuyne. LS.

The petition of Jerome B Smallage of the town of Bath, Steuben Co. NY shows that Eliza Vosburgh late of the town of bath died in the town of Bath 30th day of September in the year 1877 that she died leaving a last will and testament dated ninth day of September 1877.
The following names are all heirs of the said deceased and their places of residence.
Alonzo Vosburgh, William Henry Vosburgh, Ellen Vosburgh, Martha Vosburgh, John Vosburgh, Fanny Vosburgh, and Rosa Vosburgh, children of said deceased all residing  in the town of Bath. Elizabeth Vosburgh daughter residing at Gloversvill, Fulton County NY, and margaret Witness a daughter residing in the town of Camerson Steuben Co. NY., said deceased left Henry Vosburgh her husband her surviving residing in said town of Bath. That all persons above named are of full a ge, except the said Ellen Vosburgh, Martha Vosburgh, Samantha Vosburgh, Mary Vosburgh, John Vosburgh, Fanny Vosburgh and  Rosa Vosburgh, daughter residing in the town of Cameron Steuben County NY: said deceased left Henry Vosburgh, her husband her surviving, residing in said town of Bath. all the persons named are full age, except the said Ellen Vosburgh, John Vosburgh, and margaret Witney, who hare minors having no guardian on said heirs.  The property  does not exceed two thousand dollars in value.  signed March 18, 1878.

In the matter of probate of the Last will and testament of Eliza C Vosburgh. John S DePue being sworn as witness and examined in the above matter. I knew EliZa c Vosburgh late of the town of Bath in Said county. I am subscribing to the instrument date of ninth September, 1867. she placed her mark and it was witnessed by JOhn s Depue, make in the presence of Susan A Whitehead who was also witness. This interment was dated May 6, 1878.
Susan A Whitehead was  sworn as being the witness of signing of will dated Ninth day of September 1877.  She seen Eliza sign her mark.  Susan A Whitehead signed her name.

Daniel Cady Executor to Gerrit Smith/  Peter Smith of Peterboro late of the city of Schnectady deceased died on the twelfth day of June in the year of our Lord one thousand eight hundred and thirty four duly make and publish his last will and testament. I give unto my son Peter Sken/Gken, Smith, and Garrett Smith and Daniel Cady and Richard M Livingtons all my real and personal estate, all such debts due and demands as shall be for to me at the  time of my death from my son Gerret from him jointly or jointly. After my debts are paid and pay unto my wife three hundred and sixty dollars at the end of every six months during her life on condition that she shall within six months after my death release to them all right of dower and claims of dower. To the six children of my deceased brother, one hundred and sixty acres of land in the township number eleven or twelve on the old military tract and in case either of the children shall died leaving issue living at the time of my death then one hundred and sixty acres to be conveyed to such issue and in case any of the six children that died not leaving issue at the time of my death then the whole nine hundred and sixty acre be equally divided between the survivors and my said trustees are to pay twenty five thousand dollars to such and deemed by my trustees that it may perhaps be paid at a rate of five thousand dollars yearly for five acres must after my death and they are also to pay to each of my grandchildren with in six months  after they shall respectively come of age. Four hundred dollars and the remainder of my estate real and personal excepting as aforesaid I give shall be divided  into three equal parts one of such parts shall be paid in money to my son Peter Ethan Smith his heirs or assignees, on of such parts shall be divided equally between the children  of my deceased daughter and the other of such parts shall belong to my son Garriet and I appoint my said son Peter Garritt Daniel Cady and Richard M Livingston executor of this my will and testaments except as to the debts which shall be due to me from my son Garriet at the time of my death and it shall be in the description  of my executors above named either to sell my real estate or any part there of to be divided and money the same or any part through in the same proportions to and the persons who would be entitled. Where the same last will and testament has been duly proved before and the surrogate of the city and county of Schnectady.(Land was in township eight Watkins purchase and the adjoining 630 acres in the south west corner of said section. And your petitioner shows the value of the personal property not to exceed Eight Hundred Dollars.
