The Last Will and Testament of Francis Osborne

(1795-1882)


In the name of God amen, I Francis Osborne of the town of Glenville, Schenectady County and the state of New York being of sound mind and memory and of the age of eighty three years of age, do hereby make, ordain, publish and declare this my last will and testament in manner following that is to say.


First
I order and direct all my just debts and funeral expenses to be paid and order and direct my executors herein after named to erect at my grave a good head and foot stone as soon as possible after my decease.


Second
I give and bequeath to my wife Catharine all the fowls, farm products and one cow that shall be on my farm and premises at the time of my decease.


Third
I give and bequeath to my wife Catharine all my household furniture, beds and bedding for and during her natural life and after her decease the said household furniture, beds, etc., is to be distributed as part of my residuary estate.


Fourth
I give and bequeath to my son William Osborne the sum of three hundred dollars to be paid to him in one year after my decease.


Fifth
All the rest and residue of my estate both real and personal I give, devise and bequeath to my executors herein after named in trust as follows. That as soon as practicable after my decease that they sell my real estate either at public or private sale as in their discretion shall be for the best interest of my estate but the said real estate shall not be sold until after the decease of my said wife Catharine and that they then divide the proceeds of my said real estate into seven shares- One share of said estate to be paid to my daughter Maria, wife of William J. Stevens, one share thereof to be paid to my daughter Angelica Duell, wife of James Duell, one share thereof to my daughter Sarah, wife of Daniel Stevens, one share thereof to my daughter Elizabeth, wife of Daniel Bradt, one share thereof to my daughter Catharine, widow of Benjamin Ostrander, one share thereof to my son William Osborne, one half share thereof to my grandson Francis Osborne, son of my son Harmon Osborne and one half share to my grandson William Osborne.

My personal estate that may remain I order my executors to divide as soon as possible after my decease into seven shares and that they pay over the shares thereof in the proportions and to the persons as above stated as to the distribution of the proceeds of my real estate, which distribution is to be made as soon as practicable after my decease.

Lastly
I hereby nominate and constitute and appoint my son Harmon Osborne and my son in law William J. Stevens to be executors of this my last will and testament and fully empower them to grant and give conveyance or conveyances of my estate real and personal for the purpose of carrying out the provisions of this my last will and testament and I do hereby revoke all other and former wills by me at any time heretofore made.
