James Fluck of Aston Ingham, Herefordshire, laborer

 

In the name of God Amen I James Fluck of the parish of Aston Ingham in the County of Hereford Laborer do publish and declare this my last Will and Testament I give and devise unto my Son in Law John Green otherwise Hooper of the parish of Aston Ingham aforesaid Tailor a Cottage Garden and close of Land containing about half an Acre (be the same more or less) situate in the Parish of Aston Ingham aforesaid and in the occupation of the said John Green otherwise Hooper To hold the same unto and to the use of the said John Green otherwise Hooper his heirs and Assigns for ever Subject nevertheless to the payment of the Legacy or Sum of Fifteen pounds to my Wife Mary Fluck at the expiration of twelve months from my decease And I do hereby expressly charge the said Cottage Garden and Land with the payment of the said Sum of Fifteen pounds And by my said Son in Law John Green otherwise Hooper I mean to designate the illegitimate Son of Sarah the wife of John Green of Huntly in the County of Gloucester Tailor before her marriage  to the said John Green Sarah Hooper and which said John Green otherwise Hooper was baptized in the parish Church of Huntley aforesaid on the seventh day of February one thousand seven hundred and ninety by the name of John Son of Sarah Hooper and is commonly called or known by the name of John Green I Give and bequeath unto my said Wife my Leasehold Cottage or Tenement  wherein I now live with the Garden and four Acres of Land thereunto belonging containing by estimation Nine Acres(be the same more or less) all situate in the Parish of Aston Ingham aforesaid and in the occupation of myself and my Son Joseph Fluck To hold the same unto my said Wife her Executors Administrators and Assigns for all my Estate Term and Interest therein I also Give devise and bequeath all the rest and residue of my Personal and Real Estate whatsoever and wheresoever situate lying or being unto my said Wife Mary Fluck To hold the same unto and to the use of my said Wife Mary Fluck her heirs Executors Administrators and Assigns respectively according to the nature and quality of such Estates respectively And I do hereby appoint my said Wife Mary Fluck residuary Legatee and sole Executrix of this my last Will and Testament hereby revoking and making void all former Wills Codicils and other Testamentary dispositions made by me at any time or times heretofore and declaring this only to by my last Will and Testament In Witness whereof I have to this my said last Will and Testament set my hand and seal this thirteenth day of March in the Year of our Lord One thousand eight hundred and twenty nine – The marks of James Fluck – Signed sealed published and declared by the said James Fluck the Testator as and for his last Will and Testament in the presence of us who at his request, in his presence and in the presence of each other have subscribed our names as Witnesses thereto – Elisha Young Aston Ingham Farmer – William Pedlingham Same place Carpenter – Jos: Cannock Clerk to Wm Cadle Solicitor Newent

 

Proved at Hereford 17th March 1831 before the reverend and Worshipful Charles Taylor D.D. Vicar general by the Oath of Mary Fluck the sole Executrix within named / To whom etc.
