In the name of God Amen The Nineteenth day of December Anno Domini One thousand six hundred and eighty foure Anno Domini Regis Caroli secundi Tricesimo sexto I John Flock of Wightfield in the Parish of Dearhurst in the County of Gloucester Yeoman considering and laying to heart the fraile estate of man that though it be certain I must dye yet uncertaine when and alsoe being desirouse to put my worldly estate in order whilst the Lord affordeth health and memory for the avoiding of after trouble a thing I principally aime at excepting mine owne pease Doeth resort at this time before sicknesse and death take possession of me make and ordaine this my last Will and Testament in manner and forme following Viz First I willingly and with a free heart render and give againe into the hands of my Lord God and Creator my soule which hee of his fatherly goodnesse gave unto me when he first fastsoned me in my Mothers womb makeing me a living and reasonable creature nothing doubting but for his infinite mercies set forth in the precious blood of his beloved sonne Jesus Christ my only Saviour and Redeemer hee will receive my soule unto his glory and place in the company of his heavenly angells and blesses saints when hee shall dissolve it from this earthly tabernackle of mine which earthly tabernacle I commend to the earth whereof it was made nothing doubting but according to the article of my faith at the great day of the resurrection shall receive the same again by the mighty power of God not a corruptable mortall vile and weake body as it now it is now but an incorruptable strong and perfect and for my worldly goods wherewith the Lord of his meere mercy not my merrit hath endowed me my desire is to glory to God in the bestowing of them and to benefitt others Item I give and bequeath all those my closes or parcell of Meadow or Pasture ground with the appurtenances thereunto belonging in Turly alias Trinley in the County of Gloucester unto my Nephew William Francombe and his heires for ever who now holdeth the same of me by the yearly Rent of tenne pounds per Annum Provided the said William Francombe doe pay or cause to be paid to Arnold Aram of the City of Gloucester Haberdasher and Elizabeth his Wife or to one of them the summe of Fifty pounds of current money And my Neice Rebeccah Digges the summe of Twenty pounds and to my Neice Jane Francombe the summe of Thirty pounds of like current money within two yeares after my decease and to pay or cause to be paid unto my Kinsmen Thomas Cox one of the sonnes of Mary Cox of Newent the summe of Fifty pounds of like current money when he shall attaine unto the age of twenty and one yeares of age And if it shall happen that hee the said Thomas Cox shall depart this life before hee shall accomplish the age of twenty and one yeares That then my will is that the said Fifty pounds shall be paid unto John Cox Brother of the said Thomas Cox when he shall attaine unto the age of twenty and one yeares And if it shall happen that hee the said John Cox doe depart this life before hee shall come to the age of twenty and one yeares of age that then my will is that the said Fifty pounds soe given shall remain to the use of him the said William Francombe But if the said William Francombe shall make default neglect or refuse to pay the four severall summes of fifty pounds twenty pounds thirty pounds and fifty pounds according to the time hereby limitted for payment thereof Then my will is that the said Arnold Aram Elizabeth his wife Rebeccah Digges Jane Francombe and Thomas Cox or soe many of them as shall be then living shall have full power by vertue hereof to make sale of the said premises and to deduct or default out of the purchase or consideration money for themselves and to whom it shall belong if otherwise disposed of by the death of either of them the said parties that hath power to dispose of the same the said four severall summes of fifty pounds twenty pounds thirty pounds and fifty pounds and the charge and expense in sale thereof made and returne the said William Francombe the overplus And if it shall happen that the said Arnold Aram Elizabeth his wife Rebeccah Digges Jane Francombe or either of them depart this life before the said three summes of fifty pounds twenty pounds and thirty pounds become due then it is my will that his or her summe shall come unto such person or persons as hee shee or they shall dispose of at his her or their deaths Item I give and bequeath unto all the children of the said William Francombe and Mary his Wife the summe of twenty shillings apeice to be paid them when they shall be respectively of the age of tenne yeares apeice Item I give and bequeath unto Thomas Aram the sonne of the said Arnold Aram the summe of twenty shillings to be paid when hee shall be of the age of tenne yeares Item I give and bequeath unto Elizabeth Aram the daughter of the said Arnold Aram the summe of twenty shillings to be paid when shee shall be of the age of tenne yeares Item I give and bequeath unto my Nephew Jonathan Beale and Mary his Wife the summe of twenty shillings to be paid within two yeares after my decease Item I give and bequeath unto all the Children of the said Jonathan Beale and Mary his Wife that are now borne the summe of tenne pounds apeice to be paid when they shall come to the age of twenty and one yeares Item I give and bequeath unto my Neice Mary Cox and to her son John Cox the summe of twenty shillings to be paid within one yeare after my decease Item I give and bequeath unto my Brother in Law John Digges and Jane his Wife and to John and Christopher sonnes of the said John Digges and Jane his Wife the summe of two shillings and six pence apeice to be paid within two yeares after my decease they lawfully demanding it and giving in a sufficient discharge for the same Item I give and bequeath unto William Sevill of the parish of Bisley in the County of Gloucester Clothier and unto my Neice Hannah his Wife the summe of twenty shillings apeice to be paid within one yeare after my decease Item I give and bequeath unto all the Children of the said William Sevill and Hannah his Wife except John and Hannah the summe of twenty shillings apeice to be paid them when they shall respectively attaine to the age of tenne yeares apeice Item I give and bequeath unto John Sevill one of the sonnes of the said William and Hannah his Wife the summe of two hundred pounds of lawfull money of England to be paid him when hee shall come to the age of one and twenty yeares and if the said John Sevill shall happen to dye before the said two hundred pounds become due Then I give and bequeath the said two hundred pounds unto Edward Sevill another of the sonnes of the said William and Hannah to be likewise paid him when hee shall attaine to the age of one and twenty yeares and if it shall happen that the said Edward Sevill shall dye before hee shall be of the age one and twenty yeares Then I give and bequeath the said two hundred pounds unto Elizabeth and Jane Sevill two of the Daughters of the said William Sevill and Hannah his Wife to be equally divided between them and to be paid when they shall respectively attaine to the age of one and twenty yeares or upon their severall dayes of marriages which shall first happen Item I give and bequeath unto Hannah Sevill one of the Daughters of the said William Sevill and Hannah his wife the summe of Fifty pounds of current money to be paid her paid her when shee shall attaine to the age of one and twenty yeares or upon their day of her marriage which shall first happen Item I give devise and bequeath all those my Freehold Lands Tenements and Hereditaments whatsoever lying in the severall parishes of Trinly als Tirley Hasfield and Chasley alias Chatisley and alsoe all my Freehold Lands Tenements and Hereditaments whatsoever lying in the severall parishes of Dearhurst Leigh and Bodington and alsoe all my Freehold Lands Tenements and Hereditaments whatsoever lying in the severall parishes of Uckington Breedens Norton and Bricklehampton and every if them else where in the Countys of Gloucester and Worcester unto Susannah my beloved Wife for the terme of her naturall life And after the decease of her the said Susannah my Wife I give devise and bequeath all the aforesaid Lands Premises and Hereditaments in manner and forme as followeth that is to say First I give devise and bequeath unto John Sevill one of the sonnes of the said William Sevill and Hannah his wife all my Freehold lands tenements and hereditaments whatsoever lying and being in the severall parishes of Dearhurst Leigh and Bodington in the County of Gloucester and in every of them for and during the terme of the naturall life of him the said John Sevill and from and after his decease to the Heires of the body of the said John Sevill lawfully to be begotten and for want of such Issue I give devise and bequeath all and every the same Premises to Sarah the Daughter of Arthur Tully of Apperly in the Parish of Deerhurst and County of Glouc Gent and Sarah his wife for and during the terme of her life and from and after her decease to the Heires of her body lawfully to be begotten And for want of such Issue I give devise and bequeath all the same premises unto Susannah another of the Daughters of the said Arthur Tully and Sarah his Wife for and during the terme of her naturall life And after her decease to the Heires of her body lawfully to be begotten And for want of such Issue I give and bequeath all the same Premises unto Arthur Tully sonne of the said Arthur Tully and Sarah his Wife for and to his Heires for ever I give devise and bequeath all my Freehold Lands Tenements and Hereditaments not before bequeathed lying and being in the severall parishes of Hasfield and Turley alias Trinly in the County of Gloucester and Chasley alias Chattisley in the County of Worcester and in every of them unto Sarah Tully Daughter of the said Arthur Tully and Sarah his Wife for and during the terme of her naturall life And from and after her decease to the Heires of her body lawfully to be begotten And for want of Heires of her the said Sarah Tully I give and bequeath all the same premises unto the said Susannah Tully Daughter of the said Arthur Tully and Sarah his Wife for and during the terme of her naturall life And after her decease to the Heires of her body lawfully to be begotten And for want of such Issue then I give and bequeath all and every the same premises unto the said John Sevill sonne of the said William Seville and Hannah his Wife for and during the terme of his naturall life And after his decease to the Heires of his body lawfully to be begotten And for want of such Issue I give and bequeath the same premises unto Arthur Tully sonne of the said Arthur Tully and Sarah life and to the Heires of him lawfully to be begotten for ever Item give devise and bequeath all my Freehold Lands Tenements and Hereditaments whatsoever lying and being in the severall parishes of Uckington Breedens Norton and Bricklehampton all in the County of Worcester and in all and every of them unto the said Susannah Tully Daughter of the said Arthur and Sarah his wife for and during the terme of her naturall life and after her decease to the Heires of her body lawfully to be begotten And for want of Heires of the body of her the said Susannah I give and bequeath all the same premises unto the said John Sevill during the terme of his naturall life and after his decease to his Heires lawfully to be begotten And for want of such Issue I give and bequeath the same premises unto Sarah Tully aforesaid Daughter of the said Arthur and Sarah during the terme of her naturall life and after her decease to the Heires of her body lawfully to be begotten And for want of such Issue I give and bequeath the same premises unto said Arthur Tully sonne of the said Arthur and Sarah his Wife and to the Heires of him lawfully to be begotten for ever Item I give devise and bequeath all my Leasehold Lands Tenements and Hereditaments whatsoever lying and being in the severall parishes of Deerhurst Turley alias Trinley Chalsley alias Chatisley Norton and Bricklehampton and in all and every of them in the County of Gloucester unto the said Susannah my Wife and during the terme of her naturall life and after her decease I give and bequeath all the same in manner and forme as followeth that is to say First I give and bequeath all my Leasehold Lands Tenements and Hereditaments lying in the parish of Dearehurst aforesaid in the said County of Glouc unto the said John Sevill sonne of the said William Sevill and Hannah his Wife during the full and whole terme of fifty yeares next after my wifes decease fully to be compleate and ended if hee the said John Sevill shall soe long live and after his decease I give and bequeath all the same Lands and Premises to his Heires of his body lawfully to be begotten for and during such and soe long time of the terme or interest that I have therein and for want of Issue of him the said John Sevill I give and bequeath all the same Lands and premises unto Sarah the Daughter of Arthur Tully aforesaid and Sarah his Wife for and during the full and whole terme of fifty yeares if shee shall soe long live And after her decease I give and bequeath all the same Lands and premises to the Heires of her the said Sarah lawfully to be begotten of her body for and during all such and soe long time as I myself have therein and for want of Issue I give and bequeath all the same Lands and Premises unto the said Susannah Tully Daughter of Arthur Tully and Sarah his Wife for and during the said terme of fifty yeares if shee shall soe long live and after her decease to the Heires of her body lawfully to be begotten for and during all such terme time or interest that I have therein and for want of such I give all the same Lands and premises unto Arthur Tully aforesaid sonne of the said Arthur and Sarah his Wife and to the Heires of lawfully to be begotten for ever and during all such time that I my selfe have therein Item I give and bequeath all my Leasehold Lands and Tenements whatsoever lying in the parishes of Chasley alias Chatisley in the County of Worcester aforesaid unto the aforesaid Sarah Tully Daughter of Arthur and Sarah his wife for and during the full and whole terme of fifty yeares after the decease of the said Susannah my wife if shee the said Sarah Tully shall soe long live and after her decease to the Heires of her body lawfully to be begotten for and during such and soe long time of the terme or interest that I have therein And for want of issue of her the said Sarah then I give all the same Lands and premises unto the said Susannah Tully for and during the whole terme of fifty yeares as is aforesaid if shee shall soe long live and after her decease to her Heires lawfully to be begotten of her body for and soe long time or terme of yeares as I have therein and for want of such Issue I give the same Lands and premises unto the said John Sevill for and during the said terme of fifty yeares as is before mentioned if hee shall soe long live and after his decease to the Heires of his body lawfully to be begotten for and during soe long time or terme of yeares that I have therein And for want of Heires of him the said John Sevill I give all the same Lands and Premises unto the said Arthur Tully sonne of the said Arthur Tully and Sarah his Wife and to his Heires during all such and soe long terme or time that I have therein Item I give and bequeath all my Leasehold Lands and Tenements whatsoever lying in the Parishes of Brickehampton and Norton both in the County of Worcester unto the said Susannah Tully Daughter of the said Arthur and Sarah his wife for and during the whole terme of fifty yeares after the decease of the said Susannah my wife if shee the said Susannah shall soe long live And after her decease I give all the same Lands and premises to the Heires of her body lawfully to be begotten for and during all the whole terme or terme that I have therein And for want of issue of her I give and bequeath all the same Lands and Premises unto the said John Sevill during the fifty yeares in manner as aforesaid if hee shall soe long live and after his decease to the lawfull Heires of his body during the whole terme of time that I have therein And for want of such Issue I give and bequeath all the same Lands and Tenements said Sarah Tully the Daughter of the said Arthur Tully and Sarah his Wife during the whole terme of fifty yeares arrising as is before mentioned if shee shall soe long live and after her decease to the lawfull Heires of her body for and during all the whole time or terme that I have therein and for want of such Issue I give and bequeath all the same Lands and premises unto the said Arthur Tully sonne of the said Arthur and Sarah his Wife and to his lawfull Heires during all the whole time or terme that I have therein Item my will is that the said Susannah my wife shall put or cause to be put the said John Sevills life into my copyhold estate wherein I doe now dwell And if she shall refuse or neglect the doeing of the same the I give and bequeath unto the said John Sevill all my Mortgage that I have of John Haines estate of Dearehurst and all the money hee oweth me Item I give unto the said Sevill my six great Bookes which his Uncle Edward Staunton gave unto me Item I give unto the said Sarah Tully my sett of Virginalls and if shee dye without Issue then I give them to her sister Susannah Item I give and bequeath unto Arthur Tully and Sarah his wife the summe of twenty shillings a peice in gold Item I give unto Arthur Tully the sonne of the said Arthur Tully and Sarah his wife the summe of five pounds in gold Item my will is that the said Susannah my wife shall sufficiently keepe and maintaine the said John Sevill with meat drink washing and lodging and all sorts of apparell whatsoever and schooling and all other necessarys whatsoever for and during soo long time as the said Susannah my wife shall live and if it shall happen that they doe diagree in their living together then my will is that the said John Sevill shall have duly paid to him the summe of tenne pounds a yeare of lawfull money by the said Susannah my wife during the terme of her naturall life for the maintenance of him in another place Item all the rest and residue of my goods chattells and cattle whatsoever I give and bequeath unto the said Susannah my Wife shee paying all my Debts Legacies and funerall expenses And I doe hereby nominate constitute and appoint her my said Wife sole Executrix of this my last Will and Testament revoking all Wills by me formerly made In witness whereof I have hereunto put my hand and seale the day and yeare first above written - John Flocke - Sealed signed and published in the
