In the name of God Amen I John Flooke als Flocke als Floote of Evington in the Parish of the Leigh in the County of Gloucr Esqr serjeant of his Matyes Wine Cellar (first to kinge Charles the Second then next to kinge James the second and since to his prsent Matye kinge Wm the third) beinge in good health of body and of sound and prfect mind and memory (thankes be to god) bout consideringe my age and uncertainety of my life doe make and ordaine this my last will and testamt in manner and forme followeinge (That is to say) First I bequeath my soule into the hands of almighty god my creator in Assured hopes of salvacoń by the alone merritts of my blessed Lord and saviour Jesus Christ my saviour and redeemer, And my body I comitt to the earth to be decently buryed att the discrecoń of my Executrix hereinafter named in the parish Church of the Leigh aforesaid And as for my worldly Estate which god of his mercy hath made me a disposer I Give and dispose as followes Imprs I Give devise and bequeath to the aged poore people of the parish of the Leigh aforesaid for the tyme beinge the yearly sume of Forty shillinges to be yssueinge and payable upon the Two and Twentyeth day of July yearly for ever out of my house & lands called Staplins att Evington aforesaid by such shares and proporcońs as the person by whome the same ought for the tyme beinge to be payd shall thinke most proper Alsoe give devise and bequeath unto the aged poore people for the tyme beinge of the parish of Deerhurst in the County of Gloucr the yearly sume of Forty shillinges to be yssueinge and payable upon the Two and Twentyeth day of July yearly for ever out of my Estate and lands lyeinge in Deerhurst Walton by such like shares and proporcońs as the person by whome the same ought for the tyme beinge to be payd shall thinke most proper and convenient Both which said sumes I doe hereby direct shall be payd yearly for ever in the respective parish Churches or Churchyardes of the Leigh and Deerhurst aforesaid in the prsence of two of the substanciall inhabitants of the same respective parishes aforesaid upon payne or forfeiture of Tenn shillings for ever default to be made in payment thereof as aforesaid for the use of the poore of the pish where such default shall happen to be made, Alsoe I Give and bequeath to the severall persons herein after named the severall sumes or Legacyes in money hereinafter expressed (That is to say) unto Wm Heaven my unkle Thomas Flookes eldest daughters sonn Five poundes And unto Mary Ladd who was formerly my servant in consideracoń of a bedstead which I had of hers and of the faithfull service which shee performed whilest shee lived with me Fower poundes And unto Samuell Kenricke my wives nephew Tenn poundes And unto my Nephew Florice Cooke of the Citty of Gloucr Baker Five poundes And unto my nephew Joseph Flooke one shillinge And unto my nephew Jonathan Flooke one shillinge And unto my sister in Law Mary Flooke Five shillings And unto Nicholas Lane the younger and to Samuell Powell my wives two nephews Five poundes a piece And unto Nicholas Lane thelder Forty shillings And unto Elizabeth and Deborah Roberts daughters of Wm and Susannah Roberts of Deerhurst aforesaid (which said Susannah was my late unkle Thomas Flookes youngest daughter) the sume of Five pounds a piece Alsoe I Give to the Aged poore people of the parish of Bishopes Norton Twenty shillings Alsoe I Give unto Joseph White my servant Five pounds And alsoe unto Mary Collins my maid servant Five pounds provided they dwell with me as my domestick servants att my decease but if they each or either of them is not my servant at my decease then I revoke his or her respective Legacy All which said severall legacyes my will is shall be payd by my Executrix within the space of Two yeares next after my decease. Alsoe I Give devise and bequeath unto my Kinsman Thomas Roberts the sonn of the said Wm and Susannah Roberts of Deerhurst aforesaid All my messuages Lands Tenements and hereditaments in Deerhurst Walton and in the pish of Deerhurst aforesaid To have and to hold all and singular my said Estate and Prmises in Deerhurst Walton and in the parish of Deerhurst aforesaid unto him the said Thomas Roberts his heyres and Assignes for ever subject and chargeable nevertheless with the yearly sume of Forty shillings to the aged poore of the parish of Deerhurst as is before appointed And alsoe subject and chargeable with the yearly sume of Five poundes which I Give and appoint to be payd out of my said Estate at Deerhurst Walton unto my Kinswoman Susannah the wife of the said Wm Roberts and mother of the said Thomas Roberts for the tearme of her naturall life upon Michas day yearly the first paymnt to be made the next Michas day after my decease And my desire is and I doe therefore enjoyne & request the said Wm Roberts and Susannah his wife with the profits thereof to breed up their said sonn Thomas Roberts at schoole till he attaines sixteen yeares & then place him to such trade or imploymt as shall be most to his likeinge or thought best by his freinds And I doe request his said father to advance some sume of money not exceedinge seventy pounds for placeinge him out to some such trade or imploymt the same sume soe to be advanced I appoint and direct shall by the said Wm Roberts be charged on and be payable out of my said Estate at Walton aforesaid and the possession and profits of the same shall be received and continued until such sume and Interest be fully repayd (saveinge and prserveinge the Ańuityes before appointed thenceout) Alsoe I Give devise and bequeath All my houses Lands Tenemt and hereditamt called Staplins situate lyeinge & beinge in Evington and in the parish of Leigh aforesaid and alsoe my meadow in Evington aforesaid settled on me & my heires & which I had upon my marriage with my now wife Elizabeth And alsoe my cheife rents Quitt rents or dry-rents issueinge and payable to me yearly out of severall persons Estates in Bishopps-Norton aforesaid And all other my Lands Tenemts and hereditamts lyeinge & Beinge in Evington Leigh & Norton aforesaid or any or either of them unto my beloved wife Elizabeth dureinge the tearme of her naturall life And from & after her decease I Give devise and bequeath these my said Estates in Leigh Evington & Norton aforesaid unto my said kinsman Thomas Roberts and to the heyres of his body lawfully to be begotten for ever And for want or in default of such yssue then I Give the same unto my Godsonn Flock Kenricke sonn of my broth in Law Christianus Kenricke Clerke and to the heyres of the body of the said Flock Kenricke for ever And for want or in default of such yssue or heyres then I Give and devise my said Estates & rents at Evington Leigh & Norton aforesaid unto my kinsman John Blanton Grandson of my sister Anne and to the heyres of his body lawfully begotten or to be begotten and for want or in default of such heyres unto the heyres and Assignes of the said John Blanton for ever subject and chargeable nevertheless with the charges and sumes of manner in manner as is herein after appointed (That is to say) In case the said Thomas Roberts or his heyres as aforesaid comes to be possessed of the said Estate at Evington Leigh and Norton aforesaid after my wives life by vertue of this my will that then I order charge and appoint the said Thomas Roberts and such of his heyres to pay unto my said Godsonn Flocke Kenrick the full sume of Two hundred poundes and to be payd with Six months after the said Thomas Roberts shall attaine his age of One and Twenty yeares he or his heyres shall come to be possessed of the said Estate; And further that in case the said Flock Kenrick or his heyres or the said John Blanton or his heyres shall hereafter come to be possessed of the said Estate by vertue of this my will that then I order charge and appoint the full sume of Three hundred pounds to be payd thereout unto Elizabeth Kenrick spinster daughter of my said brother in Law Christianus Kenricke within Six months after the same shall fall into their or any or either of their possessions or power by such person or persons who by vertue hereof have or shall have right to the same Estate by vertue of this my will their full age attaining And I doe hereby request and desire that the said Thomas Roberts after he has attained his age of One and twenty yeares and before he attaines Fower and Twenty yeares may take to wife the said Elizabeth Kenrick & settle in jointure on her soe much of the said Prmises as shall be of the full yearly value of Forty poundes Butt in case the said Thomas Roberts shall refuse such marriage or settlement or otherwise of the said Elizabeth Kenrick her freinds & next relacons shall adjudge the said marriage inconvenient or dislike the same soe as the said Marriage be not had or by any meanes prvented within the tyme aforesaid that then I doe order and appoint the said Thomas Roberts to pay to the said Elizabeth Kenricke the further full sume of Two hundred pounds out of my said Lands within Six months after the said Thomas Roberts or his heyres as aforesaid shall attaine his full age & by vertue hereof be possessed of the same Estate as aforesaid And I doe hereby further order and appoint my said wife yearly dureinge her life to pay to the said Thomas Roberts & his heyres the yearly sume of Twenty shillings out of my said messuage & Estate called Staplins to be taken in case of the said Forty shillinges yearly before hereby given by me to the poore of Deerhurst & charged on my Estate at Walton as aforesaid; Alsoe my will is that the Pictures and Tables Chaires and other furniture of the Parlour and the bedd and other furniture of the Roome over the forme in my house called Staplins aforesaid wherein I now dwell shall remaine as standards there & goe to the severall persons that shall successively happen to enjoy the same pursuant to this my will; And I doe hereby order and direct my executrix hereinafter named to deliver all my writinges & Deedes wtsoever in my custody & which shall come to her hands after my decease relateinge to all my said Estates imediately after my decease unto my beloved freinds Samuell Mansell of Tewkesbury in the County of Gloucr Glover[?] who desire to keep the same for the use of such persons shall have right to my said Estates respectively by vertue of this my will and untill such persons shall be of their compleat age of one and Twenty yeares desireinge my said freind to inspect & assist in the performance of this my will; And lastly whereas I have made the said Thomas Roberts in effect my heyre by giveinge my Estate to him as aforesaid my desire is that from henceforth he may be called by the name of Thomas Flock which I desire may be continued to his yssue.  Alsoe All the rest of my goods Cattle Chattles ready money and securityes for money and all other my personall Estate wtsoever (my debts legacyes and funerall expences beinge first payd) I Give and bequeath unto my beloved wife Elizabeth whome I doe hereby make and ordayne sole Executrix of this my last will and testamt hereby revokeinge all former wills by me at any tyme made.  In witnesse whereof I the said John Flooke alias Flocke alias Floote have to this my will putt my hand and seale beinge conteyned in three sheets of paper my hand & seale and to each sheete this Thirteenth day of may in the Thirteenth yeare of the raigne of our Soveraigne Lord kinge Wm the third over England &c Annoq Dni 1701
