John Fluck of Twyning, yeoman

 

His is the last Will and testament of me John Fluck of Twyning in the county of Gloucester yeoman for the disposition of that estate wherewith I am blessed First I direct that all my just debts and funeral and testamentary charges and expences shall be fully paid and satisfied by my Executors hereinafter named I give and devise unto my friends William Bick of Elmore in the County of Gloucester Yeoman and John Buckle of Withybridge in the same County Yeoman all that my freehold Messuage Farm Lands & hereditaments with the appurtenances situate lying and being in the parish of Deerhurst in the County of Gloucester and all other my real estate whatsoever and wheresoever situate lying or being To hold to them the said William Bick and John Buckle and their heirs Upon trust to permit and suffer my dear wife Patience Fluck to have hold and enjoy the same and receive and take the rents issues and profits thereof for and during the term of her natural life provided that she shall remain my widow but if my said wife Patience Fluck should marry again after my decease then Upon trust to permit and suffer her my said wife to receive and take during the remainder of the term of her natural life after such second marriage one clear annuity or yearly rent charge of Ten pounds to be issuing and payable out of the same hereditaments and premises by even half yearly payments as the same shall become due with full power to enter and distrain for the same and all arrears thereof in case of non-payment within the space of thirty days next after the same shall become due together with the costs and charges of such distress and sale thereof And from and immediately after the decease of my said wife or such her second marriage I will and direct that the said William Bick and John Buckle and their heirs shall stand and be seized and possessed of and interested in all and singular the said hereditaments and premises with the appurtenances To and for the only proper use and behoof of my sons Charles Fluck and William Fluck their heirs and assigns for ever as tenants in common and not as joint-tenants Subject nevertheless in case of such second marriage to the said annuity or yearly rent charge of Ten pounds.  Also I give and bequeath unto my daughter Elizabeth Fluck the sum of Five hundred pounds which I will and direct shall be paid to her in manner hereinafter mentioned (that is to say) the sum of One hundred pounds part thereof at the expiration of twelve calendar months next after my decease and the remaining part thereof by sums of One hundred pounds at the expiration of every succeeding year until the whole shall be paid and satisfied and I hereby charge the same upon my said real estate in case the personal estate hereinafter bequeathed shall be insufficient thereto Also I give and bequeath unto my said dear wife Patience Fluck All my household furniture plate linen china and other household effects To hold to her for and during the term of her natural life if she shall continue my widow And from and immediately after her decease or second marriage I give and bequeath the same unto and amongst my said sons Charles Fluck and William Fluck and my said daughter Elizabeth Fluck equally to be divided between them.  And all my Money Securities for money Farming Stock Live and Dead Growing Crops Implements of husbandry and all other my goods chattels and effects whatsoever and of what nature kid or quality soever not hereinbefore disposed of I give and bequeath unto my said wife for and during the term of her natural life if she shall continue a widow And from and after her decease or in case of her second marriage then from and immediately after such second marriage I give and bequeath the same and every part thereof unto my sons Charles Fluck and William Fluck equally to be divided between them share and share alike To hold to them the said Charles Fluck and William Fluck their executors administrators and assigns in equal moieties subject nevertheless  as aforesaid And whereas I have provided already for my eldest son John Fluck and therefore have not made any gift devise or bequest to him in this my will Now I declare my will and meaning to be that if my said daughter Elizabeth Fluck shall marry in my life time and receive any portion or sum of money for her advancement in life from me that the amount of such portion or sum or sums of money shall be deducted from the said sum of Five hundred pounds so given and bequeathed to her as aforesaid.  And I recommend my wife and my said sons Charles and William and my said daughter to dwell together and assist each other in carrying on and managing my farming business so long as my said children shall remain unmarried And I do hereby nominate constitute and appoint my said wife and my said sons Charles Fluck and William Fluck joint Executrix and Executors of this my will hereby revoking all former wills by me at any time heretofore made In witness whereof I the said Testator John Fluck have to this my last will and testament contained in an written upon three sheets of paper set my hand and seal this twenty third day of July in the year of our Lord One thousand eight hundred and nineteen.

 

Signed Sealed Published and Declared by the said Testator John Fluck as and for his last Will and testament in the presence of us who at his request in his presence and in the sight and presence of each other have subscribed our names as witnesses hereto the interlineation of the words “as tenants in common and not as joint-tenants” in the thirty first line of the first skin being first made.
