Joseph Fluck of Hartpury
 

In the name of God my Creator, And in the believe of my Blessed Redeamer in whose Intercession I place my hope of a joyful Resurrection at the last great Judgement Day I constitute this my last Will and Testament as follows. First I give my body to the earth from whence it came to be decently interred. Secondly I give to my dear and good Wife Mary Fluck all my Real property of every description during her life so long as she shall remain single and not Marry again in which Case it is my Will and desire as all my property was made by my labour and savings that from the day of my Widow Mary Flucks second marriage She and her husband shall have no power whatever to claim or in any way retain or enjoy my Property left to her by this my Will or any part of it under any pretence whatever, but from the day of such marriage it shall belong fully and entirely my goods and all I leave to my Dear Chrildren Mary Emanuel Ann Caroline Ethelinda Patience and Emey Share and share alike But this my desire is that all the Property I shall die possed off shall be and remain to the sole benefit and use of Mary Fluck for and during her natural life if she shall during that time remain single And at her decease or in case she should Marry again it shall in either case then become absolute property of my very dear Seven Children Share and share alike And should Emanuel my Son wish to retain my Property so left, I order and agree to it on express Condition, and on no other Condition That he shall Pay to each of his Sisters within one year after a due Notice of this her desire to pay to her the sum of fifty pounds & which sum of fity pounds I give separately to each of them and Emanuel must pay to each of his Sisters one pound & five shillings half yearly the such time as he shall be required to pay the principal of fifty pounds And should I be possessed of more property at my death, than in that Case after my Wife’s death, or at the time of her second Marriage it shall all be equally and justly divided and if a disagreement arise Between them on account of their sharing the property so left by me than in that Case I order and ordain that the whole of the property be sold and equally divided or in the Case Emanuel shall not duly pay the Interest or each of the the fifty pounds when so duly required to do in the time specifyed

Dated this thirty first day of December 1835

Codicil to this my Will written on the other side of this sheet of paper Orders and ordains as follows that as my Property Situate in the parish of Hartpury in the County of Gloucester to which my Will on the other side refers os Collage property belonging to the Dean and Chapter of Gloucester Cathedral and must be renewed every seven years on the payment of a certain sum now my Will and desire is, that such fine for every renewal shall be paid after my wifes decease, or her second Marriage by each and every child share and share alike to make up the sum for such renewal till it shall be Sold and divided
