William Fluck of Morehampton, Herefordshire, husbandman

 

I William Fluck of Morehampton in the County of Hereford Husbandman being mindful of my mortality do make my last Will and Testament as follows I give devise and bequeath all my Household goods and furniture Stock Crop personal Estate and Effects whatsoever and wheresoever unto my good Friends John Pye and Thomas Bird Gentleman To hold to them their Exors Admors and Assigns upon the trusts following (that is to say) Upon trust to permit and suffer my Wife Mary to have the use and occupation thereof for and during the term of her natural life or Widowhood to enable her to provide for and maintain herself and my Children and from and immediately after her decease I direct my said Trustees the said John Pye and Thomas Bird or the survivor of them or the Exors or Admors of such survivor to call in and receive all such part of my said personal Estate as shall consist of money and to sell and dispose of such part thereof as shall not consist of money and there out to pay to my Sons William and John the sum of fifty pounds apiece and to my other Children the sum of one hundred pounds each within twelve months next after the decease of my said Wife and in case of the decease of either of my said sons William and John in the lifetime of or during the Widowhood of my said Wife I do direct that his or their said Legacy or Legacies of fifty pounds be equally divided amongst my seven other Children, and in case of the decease of either of my said seven other Children in the lifetime of or during the Widowhood of my said Wife I direct that the Legacy of one hundred pounds each payable to my said seven other  Children together with the Legacy or Legacies of fifty pounds which would have been payable to either of my said Sons William and John be equally divided amongst the survivors of my said seven Children or their Issue lawfully begotten such Issue being intituled to a Father or Mother’s share only And I do further direct that my said Wife shall be at Liberty during her natural life or Widowhood to pay and advance to either of my said Children out of my said Stock and Effects all or any part of the said Legacies by me given and bequeathed to them as aforesaid And as to all the residue of my said personal Estate and Effects from and after the decease of my said Wife I direct the same to be equally divided between all my Children  then living except my Sons William and John and my Daughter Mary, or the Children of either of them during the life or Widowhood of my said Wife in manner aforesaid But in case my said Wife shall at any time marry again the I direct my said Trustees or the survivor of them or the Exors Admors or Assigns of such survivor to pay and divide my said personal Estate and to sell and dispose thereof in such manner and form and in such proportions as is hereinbefore directed in case of her decease And I do hereby direct that my said Trustees shall not be answerable or accountable for any more money that they shall actually receive, nor for the loss of any part of my said property and Effects unless the same shall happen thro’ their wilful neglect or default, and that the one shall not be answerable for the Acts Deeds or defaults of the other but each for himself only And I direct my just debts funeral expences and the charges of proving this my Will to be paid in the first place out of my said personal Estate, and hereby revoking all former Wills by me made I declare this to be my last Will and Testament, and do appoint my said Wife Executrix thereof In Witness whereof I have hereunto set my hand and seal the seventeenth day of January in the year of our Lord one thousand eight hundred and eight – Wm Fluck – Signed sealed published and declared by the Testator as and for his last Will and Testament in the presence of us who in his sight and presence have subscribed our names as Witnesses – James Haynes – James Matthews

 

Proved at Hereford 23rd June 1808 before the Revd and Worshipful John Napleton D:D: Vicar General &c by the Oath of Mary Fluck Widow the sole Executrix within named To whom &c

Will of William Fluck late of the Parish of Door in the County & Diocese of Hereford deced was proved by Mary Fluck Widow the sole Executrix. Sworn before the Revd Charles Taylor M.A. Surrogate &c
