William Fluck of the Parish of Leigh, yeoman

This the last Will and Testament of me William Fluck of the Parish of Leigh in the County of Gloucester, Yeoman First I will and direct that all my just debts Funerl and Testamentary Expences shall be paid and satisfied out of my Personal Estate by my Executor hereinafter named. I Give Devise and Bequeath unto my Housekeeper, Eleanor Williams for and during the term of her natural life (provided she shall occupy, live and reside therein but not otherwise) All that Building being near to or adjoining unto my Dwellinghouse and now used as a Brewhouse together with the room over it And all that piece of garden Ground called the Lower Garden extending up to the Filbert Trees and also all that Orchard or Piece of Ground called the Lower Orchard which said premises are situate in the Parish of Leigh aforesaid. To hold the same premises unto her the said Eleanor Williams for and during the term of her natural life and from and after her decease, or in case she shall refuse or decline to live in and occupy the Premises so as aforesaid given to her when the same shall have been put in sufficient repair which I request may be done by my Executor out of my Personal Estate, then I Give Devise and Bequeath the said Hereditaments and Premises so devised to the said Eleanor Williams for her life aforesaid unto my Son William Fluck his Heirs and Assigns for ever. I also give and bequeath unto the said Eleanor Williams the Bed on which she sleeps, also two Barrels (half hogsheads) and a small cask. And I also Give Devise and Bequeath unto her the said Eleanor Williams One annuity, clear yearly rent charge or sum of Seven Pounds of Lawful British Money to be issuing and payable, had received and taken unto her by my said son William Fluck his Heirs and Assigns by equal half yearly payments and her receipt shall at all times be a good discharge for the same. I Give Devise and Bequeath unto my said Son William Fluck All and singular my Messuage or Tenement together with all and every the Buildings, and also the garden and Orchard called or known by the name of the Upper Garden and Upper Orchard And also all the arable Lands Meadow and Pasture Grounds thereunto belonging and therewith now or at any time heretofore usually and of right held used occupied or enjoyed situate lying and being in the several Parishes of Leigh, Norton and Elmstone Hardwick in the County of Gloucester And also all and every of My Messuages Lands Tenements Hereditaments and Premises and all other my Real Estate whatsoever unot him my said Son William Fluck his Heirs and Assigns for ever Subject to and charged and chargeable an I do hereby subject charge and make liable the whole of my Hereditaments and premises hereby devised to my Son William with the payment of the following Legacies that is to say Unto my Son Thomas Fluck the Sum of One Hundred Pounds of lawful British Money to be paid him by my said Son William Fluck in manner following that is to say, the sum of Fifty Pounds part thereof at the expiration off one year after my decease and Fifty Pounds the residue thereof at the expiration of two years after my decease to whom I give and Bequeath the same accordingly, also with the payment unto my Son John Fluck of the Sum of One Hundred Pounds of Lawful British Money to be paid him my said Son John by my said Son William at the Times and on the Proportions as the said legacy given to my Son Thomas is directed to be paid as aforesaid, which said Sum of One hundred Pounds I give and bequeath to my said Son John accordingly And also with the payment unto my Grandsons, the sons of my Son John Fluck, namely Charles and William Fluck the Sums of Twenty Pounds apiece when and as soon as they shall respectively attain the age of twenty one years to whom I give and bequeath the same And I direct that if either of said Grandsons should die under that age that then the share of him so dying shall go and be paid to the Survivor. And I do hereby subject charge and make liable all and singular my said Freehold Messuages Lands Tenements and Hereditaments hereby devised to my Son William Fluck with payment of all and singular the same several Legacies and Sums of Money. Provided nevertheless and my Will is that in case my Son William Fluck should die without leaving lawful issue him surviving the I Give and Devise the whole of my said Messuages Lands Tenements Hereditaments and Premises (subject to the life interest of the said Eleanor Williams of and in the premises so given to her as aforesaid) unto my Son John Fluck his Heirs and Assigns for ever, subject nevertheless and I do charge and make liable the same Hereditaments and Premises and the rents and Profits thereof with the payment by him my said Son John of the Sum of Twenty Pounds yearly and every year unto my Son Thomas Fluck for and during the term of his natural life by equal half yearly payments and also subject to the payment of the Legacies hereinbefore mentioned and also with payment of the annual sum of Seven Pounds to the said Eleanor Williams for her life as aforesaid. And as to all and singular my Money, Securities for Money, Plate Linen China Household Goods and implements of Household, Cattle, Stock of Corn, grain, Hay Book Debts, Wearing Apparel and all other my Personal Estate and Effects of what nature or kind soever (except as aforesaid) I Give and Bequeath unto the same and every part thereof unto my Son William Fluck his Executors Administrators and Assigns absolutely. And I hereby nominate constitute and appoint my said Son William Fluck sole Executor of this my last Will and Testament hereby revoking and making void all former Wills by me at any time heretofore made. In Witness whereof I the said William Fluck the Testator have to this my last Will and Testament contained in three Sheets of Paper to the two first sheets hereof set my Hand and to the third and last sheet my Hand and Seal this Fourteenth day of April in the year of our Lord One thousand Eight hundred and twenty three.
