In the Name of God Amen, I Thomas Brown Sen of the County of Frederick & colony of Virginia Yeoman being at present though weak of body, yet of perfect mind & memory do make & ordain this my last Will & Testament in manner & form following. That is to say first and principally, I recommend my soul into the hands of Almighty God who gave it, hoping through the Maret Death & passion of Jesus Christ my Saviour to obtain Remissal on all my Sins & to inherit everlasting Life & my Body I do commit unto the Earth to be decently buried at the discretion of my executors hereafter named: and as touching the Disposition of all such personal Estate as it hath pleased Almighty God to Bestow upon me in this World, I Leave and Bequeath as followeth....

First I will that all my just Debts & funeral charges be paid & Discharged.
Item - I give & bequeath unto my wife Ruth Brown, Sixty acres of my present Dwelling plantation beginning at the Creek & from thence by a straight line including the Dwelling house, thence by the Barn & taking in the field on the other side of the Barn & part of the Woodland Ground on the South side of the said Barn as also the use of part of the barn during the Term of Sixty Years or during her natural Life let which of the two be Expired first...
Item - I leave, give and bequeath unto my said Wife Ruth Brown a mare, bit, & saddle & 2 cows which she shall see cause to take, my best featherbed & furniture, a large pot, 3 plates, 2 Dishes, 1 new tankard, 2 porringers, 1 warming pan, 1 frying pan, a pair of hand irons, one broad iron pot rack, notched, 1 baking grid iron and 6 Ewes (?) as she shall make her choice all at her Disposal for ever....
Item - I give & bequeath unto my son Thomas Brown 200 acres of my present plantation lying & adjoining upon Simon Moons survey & Thomas Thornburgh Survey & twenty shillings Currency to him his heirs & assigns for ever....
Item - I give & bequeath unto my 2 sons, Samuel Brown and Joseph Brown the whole remaining part of my present plantation to be equally Divided betwixt them and that Samuel have the whole of the Improvements at present on the Said 800 acres to them their heirs & assigns for ever....
Item - I leave unto my said son Samuel Brown, a Sorrel mare called Trim, 1 horse colt, 1 young cow, 1 horse punch & plough irons & Sackling *(?) to him his heirs & assigns for ever....
Item - It is my Desire & Will that my Executors enter as soon as may be 200 Acres & more if it can had upon that place I bought & where my son William, did some time ago live for his proper Use his heirs &

assigns for ever at the cost of my Moveable Estate and it is my Will that my said Son William shall have the said land he paying what cost my Executors may be at in Clearing the said land or otherwise that the same shall be sold for the Benefit of my Three Sons ....
Item - I leave & bequeath unto my Grandson , Thomas McIntire, a white Mare Jewel his heirs & assigns for ever...
Item - I give & bequeath to my Daughter Deborah a Mare called Rose & that my daughter Francis have the Colt the said Mare is now with - if it lives - otherwise the first she bringeth that shall live to them...
Item - I leave unto my Daughter Ruth Brown a Gray Mare called Tibb & it is my Will that my Daugher Eliza: shall have the colt that the said Mare is now with to them their heirs & assigns for ever...
Item - I leave unto my granddaughters Elizabeth and Sarah McIntire to each a heifer calf & increase for ever...
Item - It is my will that if Joseph my son should die before of age that My son William shall have 200 acres of the said Demised Division & the remaining 200 acres to equally divided betwixt the widow & the rest of the children...
Item - It is my will that the Executors shall take care of the younger children while single...
Item - It is my will and pleasure that my son Thomas' Division for his 200 acres shall begin at a blazed white Oak on the East side of the Creek thence running South West by a strait (sic) line to one blazed hickory tree adjoining the Surveys above mentioned...
Item - It is my will that the division line betwixt my son Samuel's part & Josephs' shall run by a strait course cross the Creek from East to West...
Item - All the remainder of my Estate both Real and personal, I desire may be sold & the money of that sale to be equally divided betwixt my four daughters, Deborah, Frances, Ruth, & Elizabeth...
And lastly, I do hereby constitute, ordain & appoint my *(dear?) and loving Wife Ruth Brown, Thomas Brown, and Samuel Brown my sons Sole & joint Executors of this my last Will and Testament hereby revoking & making void all formerly written Wills Testaments Legacies or Executors by me made Given granted appointed constituted or or Ordained, ratifying & confirming this only to be my last Will & Testament. In witness whereof I have here unto let my hand and Seal this 30th day of Dec in the year of our Lord 1749..

This Will of Thomas Brown Senior, Deceased was proved in Open Court by the Oaths of Geo Hobson, Wm Smith and Hannah Hobson the Witnesses thereto; and Ruth Brown, Thomas Brown and Samuel Brown, the Executors therein named having affirmed to the same according to Law it was admitted to record.

Know all men by these presents that we Ruth Brown, Thomas Brown, Samuel Brown, John Chinoweth and Robert Cunningham are held and firmly bound us to Geo Wm Fairfax, Esq, the first Justice in the Commision of the Peace for Frederick County for and in behalf and to the sole use and behalf of the Justice of the said County and their Successors, in the Sum of Four Hundred pounds current money. To be paid to the said Geo Wm Fairfax his Executors?, ???, and assigns. To the which payment will and truly to be made. We bind ourselves and every of us one? and every of our Heirs Ex... and Asn... jointly and severally firm by the these presents. Sealed with our seals Dated this 8th Day of May 1750

The Condition of the Obligation is such that if the above bound Ruth Brown, Thomas and Samuel Brown, Executors of the last Will and Testament of Thomas Brown Deceased do make or cause to be made, a true and perfect Inventory of all and singular the Goods, Chattels, and Credit of the said Deceased which have or shall come to the hands, possession, or knowledge of the said Ruth, Thomas, and Samuel or into the hands, possession of any other person or persons for them and the same so made Do exhibit into the County Court of Frederick at such time as they shall be thereunto required by the said Court, and the same goods, Chattels and Credit and all other the Goods, Chattels, and Credits of the said Deceased Which at anytime after shall come to the hands or possession or knowledge of the said Ruth, Thomas, or Samuel or into the hands and possession of any

other person or persons for them Do well and truly administer according to Law and further do make a true and just account of their actings and Doings therein when thereto required by the said Court and also shall well and truly pay and Deliver all the legacies containe and specified in the said Testament as far as the said Goods, Chattel and Credit will thereunto Extend and the Law Shall Charge...Then this Obligation to be Void and of none Effect or else to remain in full force and Virtue.

Brown, John William-------------------------Newspaper Obituary----------------------------------

John William Brown, well known Newton citizen for the past 45 years, died this morning at 7:15 at the Bethel Deaconess hospital, where he had been taken Saturday. For some time Mr. Brown had lived at the home of his daughter and family, Mr. and Mrs. John Suderman, 201 South Pine Street.

Mr. Brown was born at Muncie, Ind., November 9, 1860, and hence was past 85 years old. He served Newton as a police officer and chief of the department, from which service he retired and was appointed police judge, serving in that capacity for several years, or until his health prevented further service.

Mrs. Brown passed away in 1935. He is survived by his daughter, Mrs. Suderman, a son R. B. Brown of Newton and Arthur L Brown, Kinwood, Tex, also a brother, Thomas O. Brown, Muncie, Ind.

Mr. Brown was a member of the Security Benefit Association, and of the Christian Friends church at Muncie, Ind.

He was taken to the Moody Funeral Home and funeral arrangements will be announced in Tuesday's Kansan after word has been received from relatives at distant points.

J. W. Brown - Funeral Notice
Funeral services for John William Brown who passed away early Monday morning at the Bethel Deaconess hospital will be held at the Moody's Funeral Chapel, Thursday morning, April 4, at 10:00 o'clock with Rev Lester Hostettler officiating. Burial will be made in the family lot in Greenwood Cemetery. Friends may see Mr. Brown at the Moody's Funeral Chapel anytime Wednesday evening.
