The Last Will and Testament of William Martin deceased having been presented at the August term last of said this Court for proof and the same being deemed incompetent and inadmissible. The said Last Will and Testament was at the present term of this Court produced in open court and the Court being satisfied by the relinquishment and instrument of quit claim signed by the Heirs and Representatives of the said deceased that the said instrument in the Last Will and Testament of said deceased and that it is valid and admissible to record received the agreement aforesaid signed by the said Heirs and Representatives as confirmation of the said Last Will and Testament and claim the same together with the release and quit claim of said Heirs and Representatives to be admitted to record

I, William Martin of the County of Cooper and State of Missouri, considering the uncertainty of this mortal life and being of sound and perfect mind and memory blessed be Almighty God for the same do make and publish this my last will and testament in manner and form following (that is to say). First I give and bequeath

unto my beloved wife Martha one hundred dollars cash and horse beast worth fifty dollars with as much of the other live stock including cattle, hogs, and sheep as she may think proper to keep for her use and those under her care and all the household furniture, beds, and bedding with the hitching furniture and farming tools and other implements belonging to the plantation with the plantation and buildings wherein we now live. For her a home during her natural life or widowhood with the priviledge(sp) of water and timber for fire wood any where in the bounds of the land now belonging to me. The house and hundred dollars to be hers to dispose of as she pleases. The other property if any left with the plantation and buildings at her death or second marriage to revert back to the heirs agreeable to the discretion of this will hereafter. I have also gave and devised unto my eldest son Isham Martin the east half of the South East Quarter of Section Twenty Five in Township Forty seven of range sixteen containing 80 acres which he sold to Hugh Gilbreath. I have also gave and devised unto my third son Moses Martin the west half of the above named quarter of land which he sold to Jesse Martin and a deed made to both the purchases in my own name. I also give and devise unto my second son Solomon Martin the east half of the North east quarter section thirty three Township forty six of Range Sixteen. I also give and devise unto my fourth son Aaron Martin the (West half of South west quarter Section Thirty four Township Forty six of range Sixteen) I also give and bequeath unto my eldest daughter Elizabeth Martin one hundred dollars in cash with one feather bed and furniture one cow and calf. I also give and devise unto my second daughter Sarah Gist the East half of the North West quarter section six Township forty six of Range fifteen. (one cow and calf-this was inserted between the rows. Not sure who it was to go to) I also give and devise unto my fifth son Joshua Martin the east half of the South west quarter of section Thirty three Township forty six of Range Sixteen with one good horse bridle and saddle worth 65 dollars one bed and furniture one cow and calf. I also give and devise unto my youngest daughter Martha Martin the west half of the north east quarter of Section thirty three township forty six of Range Sixteen with one feather bed and furniture, one cow and calf. The distill and tubs to be sold to the highest bidder.

and after the expenses of this will and the above mentioned legacy is paid then the residue if any to be equally divided between the eleven heirs. This my last Will and Testament wrote and signed by my own hand this 25th day of July in the year of our Lord one thousand eight hundred and twenty nine.

Codicil - In lieu of the hundred dollars above mentioned to be given unto my third daughter Jane I now give and devise unto her the west half of the south east quarter of section thirty three township 46 and Range Sixteen and also in lieu of the half quarter directed to be given to my daughter Nancy I have given one hundred dollars cash to purchase her another tract of land. My son Joshua is to have the 40 acres above mentioned to be sold by his paying sixty dollars therefor.
I also give and devise unto my youngest son Caleb Martin the east half of the south east quarter of section thirty three township forty six range Sixteen with one horse and saddle and bridle worth 65 dollars and bed and furniture one cow and calf. I also will that the Negro boy Tom remain for the use and benefit of my beloved wife Martha enduring both their natural lives.

and which for want of the legal number of disinterested witnesses cannot be proven and recorded without great prejudice to one or more of the heirs of said deceased is the last Will and Testament of our said deceased Father William Martin and that the same shall be so held and understood between us and the disposition of and distribution of the Estate of the said William Martin our said ancestor shall be made according to the provisions thereof which said last will and testament reads in the words and figures following to wit. In the name of God Amen.
