I Michael Beck of the County of Holmes and State of Ohio, for the purpose of making a satisfactory disposition of my estate, do make and publish this my last will and testament. Item 1st It is my will that of my personal estate all my just debts be fully paid. Item 2nd It is my will and I do hereby will and bequeath to my wife Rosana Beck the sum of one thousand dollars to be paid to her out of my personal estate and which said sum of one thousand dollars shall be in lieu of dower and all distributive share of my said wife in my estate real and personal. Item 3rd I do hereby will and bequeath that if my son Benjamin Beck shall pay to my son Joseph Beck, the heirs of Michael Beck, deceased, the heirs of Daniel Beck, deceased, to Susan Mitten and to the heirs of Polly Altman, deceased, certain notes amounting in the agrigate [sic] to the sum of twelve hundred and fifty dollars, and which notes were given in consideration of certain mill property deeded by the said Michael Beck the testator to the said Benjamim Beck and which said notes it is my will shall be paid by my son Benjamin within one year from this date with interest to be computed thereon and on each of them for the period of three years before the date of this my last will and testament and untill [sic] the date of said payment it is my will that my said son Benjamin Beck shall come in and stand as an heir in an equal distribution of my estate. But if he shall refuse or neglect to pay said notes and interest as aforesaid then it is my will that he shall have no claim or interest in my estate whatever but shall then be bound to pay said notes according to the tenor and effect of the same and each of them. Item 4th Whereas I am the owner of and am seized on fee simple of one hundred and fifty-four acres of land. Being part of the northwest quarter of section eleven, township eight and Range six lying and being in Holmes County Ohio, and whereas I shall have considerable personal property and choses [sic] in action, after the payment of my debts and the legacy to my said wife, now I do therefore here will and bequeath said farm and any and all other property which I may own at my decease whether it be real, personal or mixed to my son Joseph Beck, the heirs of Michael Beck deceased, the heirs of Daniel Beck deceased, the heirs of Polly Aultman deceased, Susan Mitten and to Benjamin Beck if he shall by compliance as aforesaid all said property to share the same equally the heirs of those deceased to get the shares that would have been due the parrent [sic] if living. But if my son Benjamin shall not comply with the terms aforesaid, by which he shall be an heir as aforesaid, then it is my will that the distribution of my estate shall be to the other above named heirs & children in the manner and proportions aforesaid by leaving my said son Benjamin Beck out of all share or interest therein. I do hereby revoke all former wills by me made. In testimony whereof I have hereunto set my hand and seal this 14th day of February AD 1871.
