Isaac Bennet & Christian Leman

Know all men by these presents that I Isaac Bennett of Quemahoning Township. Somerset County, Pennsylvania, for and Consideration of the sum of one hundred & thirty pounds lawful money of Pennsylvania, to me in hand paid by Christian Leman of Brothersvalley Township in the County aforesaid, at and before the ensealing and delivery hereof, the receipt whereof I do hereby acknowledge, have granted bargained & sold, released and confirmed, and by these presents do grant bargain and sell release & confirm unto the said Christian Leman and to his Heirs & assigns all my Estate, right, Title interest, property, claim & demand whatsoever of in to or out of a certain tract or parcel of land, situate in Quemahoning Township aforesaid, containing two hundred acres and the usual allowance adjoining land of Thomas Vickroy & land sold by me the said Isaac Bennett to James Walker to the south, the said Tract of land being the ‘motity’ [?] of a tract of land conveyed to me by George Edmond, and held by improvement right. Together with all and singular the rights, members, and appurtenances thereinto belonging, and the reversions and remainder rents issues & profits Thereof – To have and To hold the said Tract of land and premises hereby bargained and sold or mentioned or intended so to be, with the appurtenances unto the said Christian Leman his heirs and assigns, to the only proper use & behoof of the said Christian Leman his heirs & assigns forever – In Witness whereof the said Isaac Bennet hath hereunto set his hand & Seal this twenty second day of October on the year of our LORD one thousand eight hundred & four.

Article of Agreement

Isaac Bennett & Richard Nichols

Pennsylvania Somerset County

 

Articles of Agreement made and conducted the eighth day of October Eighteen hundred by and Between Isaac Bennett of the County and State aforesaid of the one part and Richard Nichols of Ohio County and Commonwealth of Virginia of the other part. Witnessth that he the said Isaac Bennett for the considerations herein after mentioned hath this day covenanted granted and agreed to and with him the said Richard Nichols his heirs executors administrators or assigns that he the said Isaac Bennett his heirs executors administrators or assigns will on or before the expiration of Three months from the date hereof convey by a good and sufficient deed clear of all incumbrances taxes dues and demands whatsoever the following described lands lying in Somerset County & on the head waters of Shade creek and adjoining the lands of Christopher Spake, Jacob Cable, Henry Tarr & others originally surveyed for Thomas Vickroy containing & to be Two thousand five hundred acres and likewise to contain a legal releasement of Wifes dower, in consideration of which he the said Richard Nichols for himself his heirs executors administrators or assigns hereby covenant grant and agree to and with him the said Isaac Bennett his heirs executors administrators or assigns that he or they shall and will well and truly convey by a good and sufficient Deed of convey and within the [?] three months from the date hereof clear of all incumbrances taxes and demands whatsoever unto him the said Isaac Bennett his heirs executors administrators or assigns the following described lands lying & being in Ohio county or Wood County Commonwealth of Virginia, (to be at he choice or option of him the said Isaac Bennett his heirs or assigns in which county he will choose the lands) purchased of Robert Woods surveyor of Wood County James Caldwell, John Caldwell, Moses Chapline & Archibald Woods, (the lands originally was surveyed all in Ohio County before the division of said county) the lands in Ohio county of which the said Isaac Bennett his heirs or assigns may have choice as above, lies on Middle Island Creek – the Lands in Wood County lies on Hughes river – the lands to be laid off to him the said Isaac Bennett two lots containing one thousand acres each, one other lott of five hundred acres, containing in the whole Twenty five hundred acres - In Testimony whereof we and each of us have hereunto mutually and interchangeably set our hands and affixed our seals the day and year first above written. Aquilla Bennet Ex.Ut. to Peter Kover

This Indenture made this thirtieth day of October in the Year of our Lord one thousand eight hundred and four Between Aquilla Bennet of Somerset County, Pennsylvania and Susanna his wife, late Susanna Kover daughter of Peter Kover senior late of said county deceased of the one part, and Peter Kover junior of the same county of the other part. Witnesseth that the said Aquilla Bennet & Susanna his wife for and in consideration of the sum of Eighty dollars lawful money of the United States, to them in hand paid by the said Peter Kover Jun’r at & before the ensealing & delivery hereof the receipt whereof is hereby acknowledged has and each of them hath remise, released & forever quit claimed, and by these presents DO and every of them doth remise, release & forever quit claim unto the said Peter Kover and to his heirs & assigns, all the Estate and Estates, shares, purports & dividends, title interest property claim & demand whatsoever of them the said Aquilla Bennet & Susanna his wife of in to or out of all that messuage, plantation & tract of land situate lying & being in Brothersvalley township in the county of Somerset aforesaid adjoining land of Christian Boger, Adam Miller, John Wageman & others containing Two Hundred & Six acres surveyed in pursuance of a Warrant granted to the said Peter Kover senior deceased and whereof he the said Peter Kover senior, died -----sured [?]---- and to the one ninth share of which said plantation the said Aquilla Bennet & Susanna his wife are entitled. And also all the right Title purpart share & dividend of the real and dividend of the real or personal estate whatsoever, of the said Peter Kover sen’r deceased to which the said Aquilla Bennet & Susanna his wife are or may be entitled or at any time hereafter may become entitled to have and to hold all & singular the premises hereby remised & released or mentioned & intended so to be with the appurtenances, thereunto belonging unto the said Peter Kover his heirs & assigns to the only proper ‘use’ [?] benefit behoof of the said Peter Kover his heirs & assigns forever ~~~ In witness whereof the said parties have hereunto interchangeably set their hands & seals date the day & year first herin before written

Aquilla Bennet & Susanna his wife the grantors in the foregoing deed of release named, and acknowledged the same as & for their act & deed, and desired the same might be recorded according to law. She the said Susanna being of full age and by me separate & apart from her said Husband by me examined declared that she ‘excuted’ [?] the same voluntarily and without any compulsion of undue influence of her said husband Witness my hand & seals.

    Jesse Bennet to John Kover

    This Indenture made this sixteenth day of October in the Year of our LORD one thousand eight hundred & four. Between Jesse Bennett of York County upper Canada of the one part and John Kover of Brothersvalley Township, Somerset County, Pennsylvania, of the other part Witnesseth that whereas the said Jesse Bennett in right of his wife Catherine late Catherine Kover, a daughter of Peter Kover late of Brothersvalley, Township aforesaid deceased, is entitled to the one ninth part of the Estate real and personal of the said deceased. Now This Indenture Witnesseth that the said Jesse Bennett for and in consideration of the sum of one hundred & one dollars lawful money of the United States to him in hand paid by the said John Kover at and before the ensealing & delivery hereof the receipt whereof is hereby acknowledged hath remised released & forever quit claimed and by these presents doth remise release & forever quit claim unto the said John Kover & to his Heirs & assigns all the estate right, Title, interest property, claim, & demand whatsoever of them the said Jesse Bennett & Catherine his wife in law or equity [?] or otherwise howsoever of in to or out of all that messuage plantation & tract of land situate in Brothersvalley Township aforesaid, adjoining land of Christian Boger Christian Wageman & Adam Miller & others, containing Two hundred and six acres & allowance granted to the said Peter Kover deceased by warrant dated the day of ……….whereof the said Peter Kover died seized, together with all & singular the rights, member & appurtenances whatsoever thereunto belonging or in any use [?] appertaining. And also all the right Title interest ~ purpart or dividend of and in the personal estate of the said Peter Kover deceased whereto the said Jesse Bennett & Catherine his wife are or may be entitled to, To have and to hold the premises hereby remised & released or mentioned or intended so to be with the appurtenances, unto the said John Kover his heirs & assigns to the only proper use & benefit of the said John Kover his heirs & assigns forever. And the said Jesse Bennett for himself & his wife Catherine doth hereby Covenant promise & agree to & with the said John Kover his heirs and assigns that he the said Jesse Bennett & Catherine his wife & their heirs and all and every other person or persons lawfully claiming or to claim by from or under him them or any of them. Shall & will from time to time & at all times hereafter upon the reasonable request of the said Peter Kover his heirs or assigns, cause the said Catherine to execute all and every such further and other lawful act or acts, deed or deeds whatsoever, for the further better more perfect and absolute assurance and confirmation of the premise herein before mentioned and hereby granted with the appurtenances unto the said John Kover his heirs & assigns as by him or them, or by his or their Counsel learned in the law shall be reasonably advised devised required, In Witness whereof the said parties have hereunto interchangeably set the hands & seals.     Pennsylvania vs. John Black

    March Session, Eighteen-hundred

    Somerset County to wit:                                                                                                                                                                                     The Grand Inquest, for the county of Somerset upon their oaths & affirmations respectively - do present, that John Black late of Stoney Creek township, in the county aforesaid, yeoman the twentieth day of April - in the year of our Lord, one thousand seven hundred and ninety nine at the township of Brothersvalley in county aforesaid, and within the jurisdiction of this Court, did commit Fornication, with a certain Hannah Bennett - and a Bastard Child, on the body of the said Hannah then and  there did beget.  Against the form of the act of Assembly, in such case made and provided, and against the peace and dignity of the Commonwealth of Pennsylvania.

    Anna Catherine Bennett, Letter of Administration

    To Robert Baldwin, Esquire. Surrogate Court for the Home District of the Province of Upper Canada:

    The Petition of Catherine Bennett of the Township Vaughan

    Shewith:

    That your Petitioner is the Widow of the late Jesse Bennett who departed this life on, or about, the twenty sixth day of February last past, Intestate - possessed of some personal and real Estate, within the Home District of said Province, and that your Petitioner is advised of Counsel that she is well, and best entitled to take out Letters of Administration of all and singular, the Goods and Chattels, Rights and Credits of him the said Jesse Bennett, and which were accruing to the said Intestate at the time of his death.

    Your Petitioner therefore prays that you may be pleased to grant unto her Letters of Administration of all and singular the Goods and Chattels, Rights and Credits, which were of the said Jesse Bennett at the time of his death or lawfully accruing after within the Home District of said Province, upon your Petitioner giving the usual security unto the Registry of the Surrogate Court of the said District faithfully to Administer.
