This Indenture Tripartite made this Thirty first day of August in the year of our Lord one thousand seven hundred and ninty eight between Thomas Berry Sr of the one part, Samuel McChesney of the other part, and Esther Berry, wife of said Thomas of the third part. Witnesseth that whoever the said Thomas Berry being late the proprietor of a certain tract or parcel of land lying in the County of Washington and State of Virginia and being arrived at an age when no Burgess capable of superintruding that the management of a plantation has by and with the amount of the said Esther his wife alienated and sold the same unto a certain David McCord for the consideration one thousand three hundred thirty three dollars and thirty three cents for which sum the said David McCord with Thomas Berry his security has entered into two seperate obligations, the one for eight hundred eighty eight dollars and eighty eight cents and payable to David Lowery and Samuel McChesney within six years after the death of said Thomas Berry Sr: to be applied or shall be devised by his last Will and Testament, the other for four hundred and forty four dollars thirtysix cents payable to Samuel McChesney within six years after the death of the said Thomas Berry Sr. for the use, interest and purpose hereinafter excepted. And whosoever the said Thomas Berry in consideration of his love and affection for the said Ester his wife and in consideration of her having relinquished her right Domain in the land herein before mentioned & being desireous of making provision for the said Esther his wife after his death doeth Grant covenant and agree that aforesaid sum of four hundred and fortyfour dollars and thirty six cents part of the consideration of the land be sold to David McCord and for which an obligation bearing date the twentyfourth day of August payable within six years after the death of said Thomas Berry Sr: unto Samuel McChesney shall vest in the said Samuel McChesney and that he shall have right to collect and receive the same. And the said parties agree that from and after six years after the death of the said Thomas Berry the said sum of four hundred and forty four dollars and thirtysix cents shall be the sole property and at the absolute disposal of her the said Esther and that the right to the said sum of money herein vested in Samuel McChesney is understood as a trust for the use behalf and benefit of her the said Ester Berry from and after the period aforesaid and the said Samuel McChesney consents and agrees for himself his heirs executors & administrators that from and after the period aforesaid he will relinquish all right or causes of right which he has or may have Same or equity to that said sum of money. In witness of which the parties have hereunder set their hands and affixed their seals the day and year above written.

This Indenture made the eighteenth day of June in the year of our Lord one thousand seven hundred and ninety nine between Thomas Berry senr. and Esther his wife of the one part and David McCord of the other part.Witnesseth that the said Thomas Berry and Esther his wife for and in consideration of the sum of four hundred pounds current money of Virginia the receipt whereof they do hereby acknowledge the said Thomas Berry and Esther his wife hath Granted bargained and sold unto the said David McCord and his heirs one certain tract or parcel of Land containing two hundred and twenty six acres be the same more or less lying and being in the County of Washington and State aforesaid and is part of four hundred acres Granted unto said Thomas Berry senr by pattent bearing date the second day of October in the year of our Lord 1786 and is the Land the said Thos Berry and Esther now lives on bounded as followeth, to wit:
Beginning at a forked walnut on the bank of Wolf Creek corner to the said David McCord and John Berry Land and with their lines South seventy degrees West four poles to a white oak in a field North fifty nine degrees West twenty four poles to a white oak sapling by a path South thirty eight degrees West twenty poles to two white oak saplings North forty eight degrees West seventy poles to a black oak on David Lowrys line and with his lines North forty six degrees East seven poles to a poplar and hiccory North sixty eight degrees East forty four poles crossing the creek below a spring to a white oak north fifty six East sixty two poles to a white oak and red oak corner to David Lowry and James Doran and with his line fifty one East fifty five poles to a white oak hiccory and three chesnuts all Grubbs North fifty six degrees East thirty two poles to a black oak near a hollow North seventy five degrees East thirty two poles to a large poplar corner to Joel Drydens land and with his line South fifteen degrees East one hundred and seventy four poles to a white oak and hiccory a corner to the said Joel Drydens Land thence down the meanders of the River South forty west eighty poles South eighty degrees West forty eight poles South fifty six degrees West forty six poles crossing at the mouth of Wolf Creek to a walnut corner to John Berrys part of the said Land thence up the meanders thereof N.29 West 176 poles to the Beginning
together with the appurtenances To Have and To Hold the said tract or parcel of land with its appurtenances unto the said David McCord and his heirs forever. The said Thomas Berry and Esther his wife and their heirs do covenant with the said McCord and his heirs will forever warrant and defend the said tract or parcel of Land with its appurtenances against all persons whosoever. In witness whereof the said Thomas Berry and Esther his wife hath subscribed their names and affixed their seals the day and year above written.
