I, Thomas Berry, of the County of Washington and State of Virginia, being weak in body but sound in mind and knowing that all flesh must yield to death when it shall please god to call, I do hereby make constitute and ordain and declare this to be my last Will and Testament in manner and form following revolking and anuling by these present all and every testement or testaments will or wills heretofore by me made and declare either by word or writing and this to be taken only for my last will and testament and none other and now for the settling my temperate estate and such goods and chattals and debts as it pleased god for above my deserts to bestow on me. I do order, give and dispose the same in manner and form following, And first I do will that all my just debts be paid within convenient time after my decease by my executors hereafter named and seconded, I do give and bequeath to my well beloved wife Esther the third part of all the moveable Estate except the negros as I have left her the third part of the price of my land already. I do leave to my son George a negro named Adam and all my wearing apparel and George is to give to my daughter Rebeckah fifty dollars. I do also leave to my daughter Esther a negro girl named Phili to her and her heirs and if the girl has any children they are to go to Esther and her heirs, also my negro woman named Tawney I do allow her to be free and I leave her a milch cow. I also leave to my son John, four dollars. I also leave the rest of my estate to my children hereafter named, son James, son Thomas, my daughter in law Mary Berry, wife to son William deceased, my daughter Mary, my daughter Barbara, daughter Rebeckah, my daughter Elizabeth, my daughter Susannah, my son Francis to be equally divided among them. North Carolina Will Book E, page 10 In the name of God Amen, I John McCord snr being sick of body but of a sound disposing mind & memory, Do make, ordain & establish this to be my last will & testament. In primis I will that all my just debts be paid by my executors hereafter to be names [sic] , 2dly: I will and allow my beloved wife Hannah McCord to have an independent living off the plantation I now live on Including the mansion house barn out houses & all improvements occupied by me and a sufficiency of woodland to keep up the same in good repair during her natural life & I also allow her all the beds & furniture & all household & kitchen furniture of every kind for her own use & to have also my sorrel horse & young brown mare for her own use & to be at her own disposal & all the farming utensils sufficient to carry on the farm. 3dly I will & allow that my young son James Simpson McCord have my negro man George, which I allow to be left on the plantation to work for the support & education of him as long as my Executors shall think necessary, uncless said negro should prove refractory, then said negro to be hired out by my Executors & the profits arising from said hire applied to the care of my said son as above mentioned, and as it is certain that my wife is pregnant & said child when it is born, be it male or female I will and allow said child to have my negro man Manuel to be left on the plantation for the purpose of raising & education said child as long as may be thought by my executors, unless said negro should prove refractory then said negro to be hired out by my executors & said hire to be applyed [sic] to the use of said child receiving their estates, then I allow them to receive such negroes George & Manuel together with all the profits arrising [sic] from their hire to their only proper use & should either of said children die before they arrive at mature age I allow the estate of the deceased child to go entirely to the use of the other surviving child. 4th I will and allow that my negro boy Will be sold at public vendue [sic] and the money equally divided between by [sic] two sons William McCord and Thomas McCord. 5th I will and allow my son John McCord ten shillings. 6th I will and allow my son David McCord five dollars. 7th I will and allow my daughter Peggy Van Pelt ten shillings. 8th I will and allow my daughter Jane McCord twenty dollars. 9th I will and allow my daughter Martha Price five dollars and one milch cow. 10th I will and allow my grand daughter Dorcas Black my young bay horse for her use and to be at her disposal. 11th I will and allow that all my other property not willed to be put at publick sale at twelve credit and the money arising from such sale after paying off the above legacies to be equally divided between my two children to wit: James Simpson McCord and the child my wife is pregnant with. Analysis of the Timeline
Esther Berry’s birth date is known with certainty based on a family record, the bulk of the information probably being supplied, ultimately, by Esther herself. This data, here referred to as the “Esther (Berry) McCord Family Record” was originally transcribed by a researcher in the 1880s from the McCord family bible which was owned by the youngest son of Esther and her husband David McCord. Consequently, while the authenticity of this data is considered to be quite acceptable, it is still a transcription from an original source rather than the original source itself, and the bible has not been located in “modern times”. Despite this element of uncertainty, except for one birth order item, the birth sequence of Francis Berry, this information is still considered to be an accurate representation of the basic structure of this Berry family.12

The Esther (Berry) McCord family data specifies the birth date of Thomas Berry, Sr., identifies both of his wives, although the given name of the first wife was not listed, provides the birth and death dates for Esther Berry and David McCord, their marriage date and defines the birth sequence, and spouses in most cases, for all of the children from each of Thomas Berry's marriages. With a birth date of 1770, Esther was identified as the youngest daughter of Thomas Berry and his second wife, Esther Ward, and Francis Berry was listed as Thomas and Esther’s youngest child. In his federal pension application, however, Francis Berry clearly noted that he was born in 1762. Either the Esther (Berry) McCord birth order is incorrect on this point or the birth date that Francis Berry provided in his pension application is incorrect. In his pension application narrative, Francis Berry stated that his military service took place from 1779 through 1781. If he had been born after his sister Esther, who was born in 1770, he would have been as young as 8 years old in 1779 when he was drafted, which is clearly completely implausible. Using his stated birth date of 1762, however, he would have been 17 years old in 1779, which is much more likely. It seems much more logical to assume that the personal information provided directly by Francis Berry is correct, which changes the birth order slightly. Fortunately, the 1762 date fits quite well into the Esther (Berry) McCord family sequence and provides support for estimating the birth date of John Berry, who occurs in the birth order sequence between Susanna, (born in 1757) and the corrected placement of Francis Berry in 1762. John Berry’s birth date is, thus, estimated to be sometime between 1758 and 1761.While there is no direct, primary source information for the birth date of Rebecca Berry, an accurate estimate can be made. According to the family records ultimately derived from her younger sister, Esther, Rebecca married Caleb Litton, and, according to Litton family primary source documentation, Caleb was born in 1768. If it is assumed that Rebecca was about the same age as her husband Caleb, that she was slightly older than her next sibling Esther (born in 1770), slightly younger than her brother Francis (born in 1762), then Rebecca’s birth can be reasonably interpreted to be have occurred sometime between 1763 and 1769.12,601,694
