Know all Men by these Presents That We Elizabeth Berry Thomas
Berry and Charles Berry are held and firmly bound
unto John Lewis the first Justice in the Commission of
the Peace for Augusta County for and in Behalf to the
sole Use and Behoof of the Justices of the said County,
and and their Successors in the sum of five hundred
pounds Cur Money To be paid to the said Jn Lewis his
Executors, Administrators and Assigns: To the which
Payment well and truly to be made we bind ourselves and
every of us our and every of our Heirs, Executors and
Administrators jointly and severally, firmly by these
Presents. Sealed with our Seals. Dated this 29th Day of
Nov. 1749 The Condition of this Obligation is such that
if the above-bound Eliz. Berry Adm of all the Goods,
Chattels and Credits of James Berry deceased do make or
cause to be made a true and perfect Inventory of all and
Singular the Goods, Chattels and Credits of the said
Deceased which have or shall come to the hands possession
or knowledge of her the said Elizabeth Berry or into the
hands or possession of any other person or persons for
her and the same so made do exhibit or cause to be
exhibited into the County Court of Augusta at such Time
as she shall be thereunto required by the said Court and
the same Goods Chattels and Credits and all other the
Goods Chattels and Credits of the said Deceased at the
time of his Death, which at any time after shall come to
the hands or Possession of the said Berry or into the
hands and possession of any other Person or Persons for
her do well and truly Administer according to Law:And
further do make a just and true account of her Actings
and Doings therein, when thereto required by the said
Court and all the rest and residue of the said Goods
Chattels and Credits which shall be found remaining upon
the said Admn. Account, the same being first Examined and
allowed by the Justices of the Court for the time being
Shall deliver and pay unto such Person or Persons
respectively, as the said Justices by their Order, or
Judgement shall direct pursuant to the Laws in that case
made and provided And if it shall hereafter appear that
any Last Will and Testament was made by the said Deceased
and the Executor or Executors therein named do exhibit
the same into the said Court making request to have it
allowed and approved accordingly, if the said Eliz Berry
being thereunto required do render and deliver up her
Letters of Administration, Approbation of such Testament
being first had and made in the said Court Then this
Obligation to be void and of none Effect or else to
remain in full Force and Virtue

same Colony of the other Part WITNESSETH that they the s.d
Robert Robinson & Isabella for and In Consideration
of the sum of fifty five pounds Current Money of Virginia
to them in hand Paid by the s.d Thomas Berry at or
before the sealing and Delivering of these presents the
Receipt whereof they do hereby Acknowledge And thereof

Three Between Thomas Berry of Augusta County and
Colony of Virginia and Esther his wife of the one
part and James Berry Son to the said Thomas of the
other part Witnesseth that for and in Consideration of
the sum of twenty five pounds Current Money of Virginia
To the said Thomas Berry and Esther in hand
paid by the said James Berry at or before the Sealing and
Delivery of these presents the receipt whereof they do
hereby acknowledge and thereof doth release acquit
Exonerate and discharge the said James Berry his heirs
Executors & Administrators by these presents They the
said Thomas Berry & Esther have Given

Call to Reverend Cummings
A call from the united congregations of Ebbing and Sinking Springs, on
Holston's River, Fincastle County, to be presented to the Rev. Charles
Cummings, minister of the Gospel, at the Rev'd Presbytery, of Hanover,
when sitting at the Tinkling Spring: Worthey and Dear Sir: We being in
very destitute circumstances for want of the ordinances of Christ's
house statedly administered amongst us under distressing spiritual
languishment, and multitudes perishing in our sins for want of the bread
of life broken among us; our Sabbaths too much profaned, or at least
wasted in melancholy silence at home; our hearts and hands discouraged;
our spirits broken with our mournful condition, so that human language
cannot sufficiently paint. Having had the happiness, by the good
Providence of God, of enjoying part of your labors, to our abundant
satisfaction, and being universally well satisfied by an experience of
your ministerial abilities, piety, literature, prudence, and peculiar
agreeableness of your qualifications to us in particular as a gospel
minister. We do, worthey and dear sir, from our very hearts, and with
the most cordial affection and unanimity, agree to call, invite and
entreat you to undertake the office of a pastor among us, and the care
and charge of our precious souls. And upon your accepting of this, our
call, we do promise that we will receive the word of God from your
mouth, attend on your ministry, instructions and reproofs, in public and
private, and submit to the discipline which Christ has appointed in his
church administered by you while regulated by the word of God, agreeably
to our confession of faith and directory. And that you may give yourself
up wholly to the important work of the ministry, we do hereby promise to
pay unto you annually the sum of ninety pounds from the time of your
accepting this, our call; and that we shall behave ourselves toward you
with all that dutiful respect and affection that becomes a people
towards their minister, using all means within our power to render your
life comfortable and happy. We entreat you, worthey and dear sir, to
have compassion upon us in this remote part of the world, and accept
this our call and invitation to the pastoral charge of our precious and
immortal souls, and we shall hold ourselves bound to pray. In witness

Berry Sen.r and Esther his wife of the county
of Washington, of the one part, and John Berry of said
County of the other part, Witnesseth, that the said Thomas
Berry and Esther his wife for and in
consideration of the sum of fifty pounds current money of
Virginia to them in hand paid, doth bargain and sell unto
the said John Berry and his, a certain tract or parcel of
Land in the said county of Washington containing two
hundred acres lying on the north side of Holston river
and Joining the mouth of Wolf Creek, it being part of a
Tract granted to the said Thomas Berry by Patent
bearing date the second day of October in the year of our
Lord One thousand seven hundred and Eighty six and
bounded as followeth to wit,
Beginning at a black Oak and White Oak corner to Lowrey
and Montgomery and with Montgomery's lines South thirty
five degrees East eighty six poles to a large forked
white oak
South forty nine degrees East forty five poles to a black
Oak and hiccory on the bank of the river, and up the
Meanders of the same One hundred and niney four poles to
a Walnut Saplin by the mouth of the creek and up the
several courses of the same One hundred and seventy six
poles to a forked Walnut, thence leaving said creek south
seventy degrees west four poles to a white Oak in a
field, North fifty nine west twenty poles to a white Oak
sapling by a path, South thirty eight degrees west twenty
poles to a hiccory and two white Oak Saplings North forty
six degrees west seventy poles to a black oak sapling
thence south, forty five west one hundred and seventy
eight poles to the Beginning Together with all it
appurtenances to the said John Berry and his heirs, to
the sole use and behoof of him the said John Berry and
his heirs forever and the said Thomas Berry and Esther
his wife for themselves, and their heirs do the covenant
with the said John Berry and his heirs that they the said
Thomas Berry and Esther his wife and their
heirs the said land with all the appurtenances unto the
said John Berry and his heirs against all persons
whatever will forever warrant and defend, in Witness

In the name of god amen, the sixteenth of December one
thousand seven hundred and ninety eight. I, Thomas
Berry, of the County of Washington and State of
Virginia, being weak in body but sound in mind and
knowing that all flesh must yield to death when it shall
please god to call, I do hereby make constitute and
ordain and declare this to be my last Will and Testament
in manner and form following revolking and anuling by
these present all and every testement or testaments will
or wills heretofore by me made and declare either by word
or writing and this to be taken only for my last will and
testament and none other and now for the settling my
temperate estate and such goods and chattals and debts as
it pleased god for above my deserts to bestow on me. I do
order, give and dispose the same in manner and form
following, And first I do will that all my just debts be
paid within convenient time after my decease by my
executors hereafter named and seconded, I do give and
bequeath to my well beloved wife Esther the third
part of all the moveable Estate except the negros as I
have left her the third part of the price of my land
already. I do leave to my son George a negro named Adam
and all my wearing apparel and George is to give to my
daughter Rebeckah fifty dollars. I do also leave to my
daughter Esther a negro girl named Phili to her and her
heirs and if the girl has any children they are to go to
Esther and her heirs, also my negro woman named Tawney I
do allow her to be free and I leave her a milch cow. I
also leave to my son John, four dollars. I also leave the
rest of my estate to my children hereafter named, son
James, son Thomas, my daughter in law Mary Berry, wife to
son William deceased, my daughter Mary, my daughter
Barbara, daughter Rebeckah, my daughter Elizabeth, my
daughter Susannah, my son Francis to be equally divided
among them. I also leave to my grandson Thomas Dryden my
best saddle. I also will that David Dryden and Samuel
McChesney and David Lowry shall be my Executors given
under my hand and seal this sixteenth of December 1798.

This Indenture Tripartite made this Thirty first day of
August in the year of our Lord one thousand seven hundred
and ninty eight between Thomas Berry Sr of the one
part, Samuel McChesney of the other part, and Esther
Berry, wife of said Thomas of the third part.
Witnesseth that whoever the said Thomas Berry
being late the proprietor of a certain tract or parcel of
land lying in the County of Washington and State of
Virginia and being arrived at an age when no Burgess
capable of superintruding that the management of a
plantation has by and with the amount of the said Esther
his wife alienated and sold the same unto a certain David
McCord for the consideration one thousand three hundred
thirty three dollars and thirty three cents for which sum
the said David McCord with Thomas Berry his
security has entered into two seperate obligations, the
one for eight hundred eighty eight dollars and eighty
eight cents and payable to David Lowery and Samuel
McChesney within six years after the death of said Thomas
Berry Sr: to be applied or shall be devised by his
last Will and Testament, the other for four hundred and
forty four dollars thirtysix cents payable to Samuel
McChesney within six years after the death of the said Thomas
Berry Sr. for the use, interest and purpose
hereinafter excepted. And whosoever the said Thomas
Berry in consideration of his love and affection for
the said Ester his wife and in consideration of her
having relinquished her right Domain in the land herein
before mentioned & being desireous of making
provision for the said Esther his wife after his
death doeth Grant covenant and agree that aforesaid sum
of four hundred and fortyfour dollars and thirty six
cents part of the consideration of the land be sold to
David McCord and for which an obligation bearing date the
twentyfourth day of August payable within six years after
the death of said Thomas Berry Sr: unto Samuel
McChesney shall vest in the said Samuel McChesney and
that he shall have right to collect and receive the same.
And the said parties agree that from and after six years
after the death of the said Thomas Berry
the said sum of four hundred and forty four dollars and
thirtysix cents shall be the sole property and at the
absolute disposal of her the said Esther and that
the right to the said sum of money herein vested in
Samuel McChesney is understood as a trust for the use
behalf and benefit of her the said Ester Berry from and
after the period aforesaid and the said Samuel McChesney

This Indenture made the eighteenth day of June in the
year of our Lord one thousand seven hundred and ninety
nine between Thomas Berry senr. and Esther his
wife of the one part and David McCord of the other part. Witnesseth
that the said Thomas Berry and Esther his
wife for and in consideration of the sum of four hundred
pounds current money of Virginia the receipt whereof they
do hereby acknowledge the said Thomas Berry and Esther
his wife hath Granted bargained and sold unto the
said David McCord and his heirs one certain tract or
parcel of Land containing two hundred and twenty six
acres be the same more or less lying and being in the
County of Washington and State aforesaid and is part of
four hundred acres Granted unto said Thomas Berry senr
by pattent bearing date the second day of October in
the year of our Lord 1786 and is the Land the said Thos
Berry and Esther now lives on bounded as followeth, to
wit: Beginning at a forked walnut on the bank of Wolf
Creek corner to the said David McCord and John Berry Land
and with their lines South seventy degrees West four
poles to a white oak in a field North fifty nine degrees
West twenty four poles to a white oak sapling by a path
South thirty eight degrees West twenty poles to two white
oak saplings
North forty eight degrees West seventy poles to a black
oak on David Lowrys line and with his lines
North forty six degrees East seven poles to a poplar and
hiccory North sixty eight degrees East forty four poles
crossing the creek below a spring to a white oak north
fifty six
East sixty two poles to a white oak and red oak corner to
David Lowry and James Doran and with his line
North fifty one East fifty five poles to a white oak
hiccory and three chesnuts all Grubbs North fifty six
degrees East thirty two poles to a black oak near a
hollow
North seventy five degrees East thirty two poles to a
large poplar corner to Joel Drydens land and with his
line
South fifteen degrees East one hundred and seventy four
poles to a white oak and hiccory a corner to the said
Joel Drydens Land thence down the meanders of the River
South forty west eighty poles South eighty degrees West
forty eight poles South fifty six degrees
West forty six poles crossing at the mouth of Wolf Creek
to a walnut corner to John Berrys part of the said Land
thence up the meanders thereof N.29 West 176 poles to the
Beginning
together with the appurtenances To Have and To Hold the
said tract or parcel of land with its appurtenances unto
the said David McCord and his heirs forever. The said Thomas
Berry and Esther his wife and their heirs do
covenant with the said McCord and his heirs will forever
warrant and defend the said tract or parcel of Land with
its appurtenances against all persons whosoever. In
witness whereof the said Thomas Berry and Esther
his wife hath subscribed their names and affixed their

At a court held for Washington County by the 20th day of
August 1799. The last will and Testament of Thomas
Berry deceased was exhibited into court and proved by
the oaths of Jonathan Dryden and William Palmer the
witnesses thereto and ordered to be recorded. And on the
motion of David Dryden, David Lowry and Samuel McChesney
the Executors thereon named who took the oath of
Executors presented by law and together with David Craig,
David McCord and James Maxwell their securities entered
into and acknowledged their bonds in the sum of four
thousand dollars with conditions as the law directs. A
certificate for the probate of the said will is therefore
granted them in due form excud.

Craig and John Houston, Gent. justices of this court of
Washington county now sitting and their successors the
sums of four Thousand Dollars To which payment will and
truly to be made to the said justices and their
successors we bind ourselves our heirs executors and
administrators jointly & severally firmly by these
presents Witness our hands and Seals this 20th day of
August 1799.
The Condition of the above obligation is that if we the
said David Dryden, David Lowrey & Saml. McChesney
executors of the Last Will and Testament of Thomas
Berry deceased, do make a true and perfect inventory
of all and singular the goods chattels and credits of the
said deceased, which has or shall come to the hands
possessions or knowledge of them the said Dryden Lowrey,
& McChesney or with the Lands or possessions of any
other person or persons for them, and the same is made do
exhibit unto the Clerk of Washington County at such
times, as they shall be therefore required by the said
Court, and the same goods chattels and credits, do well
and truly administer according to Law, and making just
and true account of their askings and doings therein when
thereunto required by the said court; and futher do well
and truly pay and deliver all of the Legacies contained
and specified in the said Will, as far as the said goods
chattels and credits wills extend, according to the value
thereof and as the Law shall charge them; then this
obligation to be void Otherwise to remain in full force.
