In the Name of God Amen I William Berry Sr of Rockbridge County and State of
Virginia Being weak in body But of perfect Memory thanks be Given to the
almighty God for the same and Calling to mind the Mo[rta]lity of my Body an
knowing that it is appointed for all men once to Die Mak[e and] Ordain this my
last will and testament in the manner and form following first I Recommend my
Soul into the hands of God that gave it and my body to the [ground] to be Buried
in a Christian and desent Manner at the Diseration of my Exec[cutor] and as
tutching Such worldly Estate as it hath pleased God to bless me with in th[e] I
Give and Dispose of the Same in Manner and form following Im promist I Give
[and] Bequeath to my son James Berry the one half of this Plantation thu
and my s[on] William Berry now lives on to him his heirs & assigns forever and
the other half of s[aid] to my son William Berry & his heirs and assigns forever
orterwies my son William Berry is to have it at his Choice to pay sd James
Berry the just sum of one hundred fifty pounds after my just Debts is paid
and retain the whole of sd lands for Ever also my Negrow man Namd Ralph after my
Death is to be Valued By sd James and William Berry or Some other
fit persons chosen for that Purpose and the price of s[aid] Negrow to be Equally
Divided Betwixt the sd James and William Berry or their he[irs]
still referring to William Berry his choice like the of the land I also
Beq[ueath] to my son John Berrys heirs the Just sum of five Pounds I required
that my s[ons] James and William Berry Each is to pay fifty
shillings to the heirs of s[on] John Berry now Deceased I Bequeath to my
Daughter Mary Berry my W[earing] Coat and her Coalt and a Saddle and two cows
and two heifers those to [have] her Choice with her Bed and furniture and the
rest of my houshold furnitu[re] such as puter and pots I allow to be Divided
between my wo Daughters Mary and Jane Berry My Negrow wench named Ann I Leave to
my Daughter Mary Berry to be hers and her Assigns forever the rest of Moveble
Estate I allow to be Divided Between my two sons James and William
Berry Excepting one Mare Named Trim that I allow to Become the property of
my Son James Berry at my Decease Likewise to my Daughter Jane Berry I
Bequeath five shillings sterling in Room of her Birthright and to my Daughter
Nancy McCampble I bequeath five shillings sterling in Room of her Burthright
Likewise my Daughter Mary is to have her Mentainence off the planatation and I
Do Constitute and appoint my two Sons James & William Berry Executors of
this my last will and testament in Witness whereof I Have Set my hand and Seal
this sixteenth Day of February in the Year of our lord one thousand seven
hundred & Ninety one.

Writing purporting the last will & Testament of William Berry deceased was
presented in Court by James Berry & William Berry Executors herein named
and proved by John Berry & Charles Berry subscribing witnesses and Ordered to be
Recorded and on the motion of said Executors who made Oath according to Law
Certificate is granted them for obtaining Probate thereof in due form they
having together with James McCampbell & John Tedford their securities entered
into & acknowledged their Bond in the penalty of £1000 Conditioned according to
Law

This Indenture made the fourth day of February in the year of our Lord one
thousand Seven hundred & ninety four between James Berry & William Berry
of Rockbridge County & State of Virginia of the one part and Alexander Porter of
the same County and State of the other part.
Witnesseth that the said James
Berry and William Berry and Nancy, s.d Williams wife, for and in
consideration of the sum of six hundred & thirty pounds to them in hand paid by
the said Alexander Porter the Receipt whereof the said James Berry &
William Berry & Nancy, William’s wife, do hereby acknowledge have Bargained &
Sold & do by these presents Bargain & sell to the said Alex.r Porter a certain
Tract of Land containing four hundred & twenty seven acres lying in Rockbridge
County being the Land bequeath.d to the said James & William Berry by the Last
Will of William Berry deceased and bounded as follows (viz)
BEGINNING at three Elms corner to
James Telford and running thence South Seventy three degrees west sixty five
poles to a large White oak by a branch thence North ten Degrees West two hundred
& Sixty poles to a White Oak Thence South eighty two Degrees East one hundred
and thirty six poles to a Chesnut Thence North Fifty degrees East Seventy four
poles to a white oak North forty Degrees west twenty poles to a black --?--
thence north fifty Degrees East sixty three poles for a Black & Spanish Oak
Thence South [insert “thirty”] nine Degrees East three hundred & five poles to a
large white oak on a hill South fifty degrees West seventy eight poles to a
White oak and Stony hill -- Thence North forty three & half degrees west one
hundred & Seventeen poles to a white oak -- thence South forty nine degrees west
one hundred & fifty one poles to a hickory and white oak Splins -- North forty
one degrees west twenty seven poles to a hickory by a branch -- South forty nine
degrees west fifty poles to a hickory saplin grub -- Thence South twenty nine
degrees East fourteen poles to the BEGINNING
and now in possession of the
said Alexander Porter with all appurtenances and advantages to the s.d Land &
premises belonging and also all the estate little claim and demand whatsoever of
the said James & William Berry and Nancy, William’s wife, of in &
to the same Have & To Hold the said Land & premises with the appurtenances and
the said Alexander Porter his heirs and assigns forever & the s.d James Berry
& William Berry & Nancy, Williams wife, to their heirs the s.d Land & premises
to the s.d Alexander Porter his heirs & assigns against them the said James
& William Berry & and their heirs and all other persons will warrant &
forever defend by these presents in Wittness whereof the said James &
William Berry and Nancy, William’s wife, have hereunto set their hands
and Seals the day and year first above written.

This indenture made this seventeenth
day of August one thousand seven hundred and ninety nine Between Jacob Zumwalt &
Catherine his wife of the County of Harrison and the Commonwealth of Kentucky of
the one part and James Berry & John Berry of the County of Scott &
Commonwealth aforesaid of the other part
Witnesseth that the said Jacob Zumwalt and Catherine his wife for and in
consideration of the sum of three hundred and fifty two pounds ten shillings in
hand paid at and before the sealing and delivery of these presents the receipt
whereof is hereby acknowledged have granted bargained & sold & by these presents
do grant bargain sell alien and confirm unto the said James Berry & John
Berry and their heirs and assigns a certain tract of land containing by survey
four hundred and fifty acres lying on the south fork of Licking in the County of
Harrison & bounded as follows
To wit Beginning at a beech and small sugar trees standing on the bank of said
south fork thence from the river south thirty seven west eighty four poles to a
black gum at the foot of the hill thence south fifty seven west three hundred
and seventy eight (?) poles to a hickory & white oak near the old trace thence
north twenty seven west two hundred and forty five poles to a sugar tree & two
white oaks in the head of a hollow thence north fifty seven east two hundred and
fifty poles to a sugar tree and black ash under a clift on the south bank of
Licking thence up the same with the meanders to the beginning which said bounds
includes six hundred acres and it is understood between the two contracting
parties that one hundred fifty acres within the bounds aforesaid and laid off as
follows
To wit Beginning at a white oak thence north 57E 250 poles to a dogwood &
hickory thence north 32 W (?) 96 poles to a hickory and beech thence south 57W
250 poles to a stake in the back line thence with the fence to the beginning and
sold by said Zumwalt to John Rowland is excepted out of the six hundred acres
aforesaid
To have and to hold the balance t (?) four hundred and fifty acres of land with
its appurtenances to the said James & John Berry and their heirs
and assigns forever and to their only proper use and behoos of the said Jacob
Zumwalt & Catherine his wife for themselves and their heirs shall forever
warrant and defend the said tract of land containing four hundred and fifty
acres as aforesaid with its appurtenances to the said James & John
Berry & their heirs & assigns against the claim of them the said Jacob &
Catherine his wife and their heirs and every person or persons whatsoever
In witness whereof the said Jacob Zumwalt & Catherine his wife have hereunto set

This indenture made this tenth day of June 1815 between William Berry of
the County of Miami and state of Ohio of the one part and John Berry of Harrison
County & state of Kentucky of the other part
Witnesseth that the said William Berry for and in consideration of the sum of
one hundred and fifty pounds current of Kentucky in hand paid at & before the
sealing and delivery of these presents the receipt whereof is hereby
acknowledged have granted bargained sold & confirmed & by these presents doth
grant bargain sell alien convey & confirm unto the said John Berry and to his
heirs and assigns forever one equal undivided moiety of a certain tract or
parcel of land situated lying and being in the county of Harrison on the south
fork of Licking containing four hundred & fifty acres being the land and farm
whereon the said John Berry now lives & bounded as follows
To wit Beginning at a beach & small sugar trees standing on the bank of the
south fork, thence from sd fork So 37 West 84 poles to a black gum at the foot
of the hill thence So 57 West 370 poles to a hickory & white oak near the old
trace thence No 27 W 245 poles to a sugar tree & two white oaks in the head of
the hollow thence north 57 E 250 poles to a sugar tree & black ash under a clift
on the south bank of sd fork thence up the same with the several meanders
thereof to the beginning which said bounds includes 600 acres 150 acres of which
now belongs to the heirs and representatives of John Roland decd & laid off as
follows (viz) Beginning at a white oak thence No 57 E 250 poles to a dogwood &
hickory thence N 32 W 96 poles to a hickory & beach thence S 57 W 250 poles to a
stake in the back line & with the same to the beginning
Sold by Jacob Zumwalt to the sd John Rowland decd in his lifetime which said
tract of land of 450 acres as described was conveyed to John Berry & James
Berry by Jacob Zumwalt by deed bearing date the 17th day of August 1799 And
the said James Berry having since departed this life and the said William
Berry being the heir at law of the sd James Berry doth hereby forever
warrant and defend the title of the said moiety of 450 acres of land to the said
John Berry & to his heirs, assigns forever against the claims and demands of
himself and his heirs & all persons claiming under them against the claim or
claims of Solomon McCampbell & his heirs or any person claiming under them but
not from the claim or demand of any other person or persons whatsoever. In
testimony whereof I have hereunto set my hand and affixed my deal the date above
written.
