IN THE NAME OF GOD AMEN I John Berry of the County of Augusta and Colloney of
Virginia being weakly of body but of perfect mind and Memory thanks be given to
Almighty God there fore Considering the Mortallity of my body Knowing that it is
appointed for all men once to die I do Make & Ordain this my last will and
Testament that is to say Principally first of all I recommend and Commite my
soul into the hands of Almighty God who gave it and my body to the Earth
decently buried at the discretion of my Executor doubting nothing but I shall
receive the same again by the Mighty Power of God at the General resurection and
as Touching what estate it hath Pleased God to bless me with in this life I give
devise & dispose of the same in the following Manner and form Impremis it is my
Will and I do order that all my lawful debts and funeral charges be fully Paid
and Satisfyed

Call to Reverend Cummings
A call from the united congregations of Ebbing and Sinking Springs, on Holston's
River, Fincastle County, to be presented to the Rev. Charles Cummings, minister
of the Gospel, at the Rev'd Presbytery, of Hanover, when sitting at the Tinkling
Spring:
Worthey and Dear Sir: We being in very destitute circumstances for want of the
ordinances of Christ's house statedly administered amongst us under distressing
spiritual languishment, and multitudes perishing in our sins for want of the
bread of life broken among us; our Sabbaths too much profaned, or at least
wasted in melancholy silence at home; our hearts and hands discouraged; our
spirits broken with our mournful condition, so that human language cannot
sufficiently paint.Having had the happiness, by the good Providence of God, of
enjoying part of your labors, to our abundant satisfaction, and being
universally well satisfied by an experience of your ministerial abilities,
piety, literature, prudence, and peculiar agreeableness of your qualificaions to
us in particular as a gospel minister. We do, worthey and dear sir, from our
very hearts, and with the most cordial affection and unanimity, agree to call,
invite and entreat you to undertake the office of a pastor among us, and the
care and charge of our precious souls. And upon your accepting of this, our
call, we do promise that we will receive the word of God from your mouth, attend
on your ministry, instructions and reproofs, in public and private, and submit
to the discipline which Christ has appointed in his church administered by you
while regulated by the word of God, agreeably to our confession of faith and
directory. And that you may give yourself up wholly to the important work of the
ministry, we do hereby promise to pay unto you annually the sum of ninety pounds
from the time of your accepting this, our call; and that we shall behave
ourselves toward you with all that dutiful respect and affection that becomes a
people towards their minister, using all means within our power to render your
life comfortable and happy. We entreat you, worthey and dear sir, to have
compassion upon us in this remote part of the world, and accept this our call
and invitation to the pastoral charge of our precious and immortal souls, and we
shall hold ourselves bound to pray. In witness whereof, we hereunto set our
hands, this 5th day of January, 1773.

wit Andrew Covill, Charles Campbell, Allexander Richey, Robert Trimble,
Allexander Montgomery, Joseph Scott, Robert Cowan, Samuel Porter, John Berry,
Daniel McKinney, Samuel Hennery and James Bates who being elected tried and
Sworn the Truth to Spake upon the Issue joined upon thier oath do say that the
Defendant is not guilty in Manour and form as the plaintiff against him hath
complained therefore it is concedered by the Court that they Plantiff take
nothing bu his Bill but for his false clamour be in Mercy & C. and the Said
Defendant go hence without pay and recover against the Plantiff for his Costs by
him about his Defence in this behalf Expended. |

these presents shall come. Greeting. Know ye that by Virtue of a Certificate in
right of Settlement Given by the Commissioners for adjusting the titles to
unpatented lands for the district of Washington and Montgomery Counties and in
cosideration of the ancient Composition of six dollars & sixty seven cents paid
unto the Treasury of this Commission, There is Granted by the said Commonwealth
unto Samuel Henry a Certain tract or parcel of land Containing Two
hundred and sixty acres by Survey bearing date the Twenty fifth day of July
seventeen hundred and eighty four lying and being in the County of washington on
the south side of the middle fork of Holsten and bounded as followeth “to wit”
Beginning at a bunch of lynns on the north side of the knobs with John
McCullocks land and with his line north twenty nine degrees West ninety poles to
two white oaks north seventy five degrees west eighty poles to two chesnuts near
a sink hole south forty seven degrees west ninety six poles to two Chestnuts on
James McCutchans line south forty five degrees West one hundred and forty eight

In the name of God, Amen. That I Samuel Henry of Washington County, Virginia
being weak in body but of sound memory and Judgment blessed be God for all his
mercies Calling to mind the mortality of the body and that it is appointed for
all men once to die do recommend my soul to God who gave it & my body to be
buried in a decent Christian manner at the discretion of my Executors and as for
what worldly Estate goods and Chattels it has pleased God to bless one with in
this life at this time I do order and bequeath in following manner; and first I
order that the Land I bought from Archibald Maginnis be sold at the discretion
of my Executors and my other effects that can be spared, and all my lawful debts
to be paid. I leave and bequeath to my beloved wife Elizabeth the thirds of the
plantation I live on and the third of the plantation I bought from George Berry,
during her widowhood and in she marries her third part afterwards to be valued
by men what it is to be, and her to be paid what is just and one Cow and year
old heifer her choice, the black horse & her saddle & bridle one bed and
furniture the dresser furniture her own pot and little Over her wheels & Reel
and one Chest and two Sheep her choice. I leave and bequeath to my two sons
Robert and Charles to them their heirs and assigns the plantation I bought from
George Berry equal chares according to Quantity and Quality and the plantation I
now live on I leave to my son James to his heirs and assigns. I leave to my
three daughters Mary, Sarah and Jean a ten pound horse saddle and bridle and a
Cow to each of them to be paid as follows (to wit) Robert to pay Mary, Charles
to pay Sarah and James to pay Jean two years after said Robert, Charles and
James are come of age and if it should be that another lawful heir should appear
I desire allow and appoint James Henry my brother, James Berry Robert Kinhead
and my beloved wife Elizabeth to make it an equal share which my sons Robert
Charles and James are to pay when it comes to age, and I further allow that my
children be raised Schooled and cloathed out of my personal Estate and if it
should be that any of my heirs should die under age I allow that their share
shall fall to the other of the same sex females to females the Males to the
Males and further I allow my brother James Henry, James Berry, Robert Kinkead
and my beloved wife Elizabeth to Execute this my last Will and I do hereby
revoke & disannul all other Wills & Testaments and Testament and do Ratify and
confirm this to be my Last Will and Testament. In Witness my hand and seal this
twenty fourth day of April one thousand seven hundred and Eight six.

IN THE NAME OF GOD AMEN I Charles Berry Senr. of the County of Augusta in the
State of Virginia, farmer, Being Very Sick and weak in Body but of Perfect Mind
and Memory Thanks be Given to Almight God for the same and Calling to mind the
Mortality of my Body and Knowing that it is appointed for all men once to Die do
make and Ordain this my last Will and Testament in manner and form following,
First I Recommend my Soul into the hand of God that Gave it and my Body to the
Earth to be buried in a Christian Like and decent Manner at the Discreation of
my Executors and as Touching Such Worldy Estate as it hath Pleased God to bless
me in this life I give and Dispose of the Same Manner and for following Impremis
I Give and Bequeath to my beloved wife Mary Berry the one half of my moveable
Estate after my Just Debts and funeral Chages is paid By my Executors and my
Plantation that I now Live on for her Support During widowhood or Natural Life
and my two oldest Negroes Viz Tom and Mack for her support and my son Robert
Berry The Property Land and Negroes is to Equally for the Support of my Beloved
Wife and my son Robert Berry dureang my Beloved Wifes Life and at her Death the
whole of s.d property Property to Become the Property of my Son Robert Berry and
his heirs and assigns for Ever- Only if the Two Negroes have any Increase they
are to be at my Wifes Disposal. Item I give and Bequeath to my son John Berry my
Plantation or Tract of Land above and Joining the tract I now Live on to be his
and his heirs and assignes for Ever the s.d Two Tracts to be Equally Divided
across to be in Each an Equal part and my Negro Boy Named Andy to be his for
Ever. Item I give and Bequeath to my Son Charles Berry my Plantation or Tract of
Land Lying in Washington County on houlstone [see 1796 deed below] and my Negro
Boys Named Tom to be his and his heirs and assigns for Ever, Item I give and
Bequeath to my Daughter Challe Berry my Negro Girl Named Lucy and my Mare Named
Mige a Saddle at five Pounds price Two Cows and a heifer her bed and furniture
to be hers and assigns for Ever, and She is to have her living off the
Plantation I now live on with her Mother and Brother Robert till she is Married,
my Negro Girl Named Fan (?) I leav at the Disposeal of my Executors to be
Continued with my Daughter Elizabeth Henry as Long as they think fit and then to
be Disposed of as they think proper. Item I give and Bequeath to my daughter
Jean Brawford my Negro Girl Named Jude to be hers and her heirs if she has
Lawfull Issur If she dies without Issue then to be Returned to my Executors for
the use of my Family, I likewise Bequeath to my Son James Berry and to my
Daughters Elizebeth, Mary and Jean to Each of them five shillings Sterling in
Room of their Birthright the remainer of my of my Moveable Esate I Allow to be
Equally Divided Between my Two Sons John and Charles Berry, and I do Constitute
and appoit my Beloved Wife Mary Berry Exectrix and my Beloved sons James and
John Berry Executors of this my Last will and Testament, and do Disannule all
other Wills By me heretofore made Ratifying and Confirming this to be my Last
Will and Testament in Witness whereof I have hereunto Set my hand and seal this
Eighth Day of April one thousand Seven hundred and Eighty Nine

THIS INDENTURE, made the nineteenth day of August in the year of our Lord one
thousand seven hundred and ninety four between Archibald Mcginnis and Mary his
wife of the one part, and Elizabeth Henry of the other part,
Witnesseth that the said Archibald McGinnis and Mary his wife for and in
consideration of the sum of seventy pounds current money of Virginia in hand
paid by the said Elizabeth Henry the receipt of which the said Archibald
McGinnis and Mary his wife doth hereby acknowledge, the said Archibald McGinnis,
hath granted, bargained and sold and by these presents doth grant bargain and
sell to the said Elizabeth Henry and her heirs one certain Tract or parcel of
Land containing one hundred and thirty acres be the same more or less being part
of two different Tracts, to wit, --?-- of four hundred acres, the other one
hundred and fifty seven acres granted to John Bowles deceased by Patent bearing
date the seventh day of May 1785 the other the second of November 1793, both
Tracts in the county of Washington on the North side of the middle fork of Holston River, bounded as followeth.
To wit, BEGINNING at a black oak and white oak on the patent line corner to
Joseph Snodgrass and the said McGinnis, and with a line of the same South forty
one degrees East twenty seven poles to a black oak and beech at the head of a
spring, and dividing the spring at the head between the said Snodgrass and the
said Henry, thence South twenty seven degrees East one hundred and eighty seven
poles down the Meanders of the Spring branch to a Stake in the side of the
Knobs, thence North forty three degrees East one hundred and thirty seven poles
to two white oaks corner to William Kennedy and the said McGinnis Land and with
Kennedys line, West twenty four poles to three white oaks North fifty nine
degrees west, seventy four poles to three blacks and a poplar on the and of a
ridge, thence leaving Kennedys line North twenty five degrees west one hundred
and forty four poles to two chestnuts on the North East side of a ridge, South
thirty five degrees west one hundred poles to the BEGINNING With its
appurtenances TO HAVE AND TO HOLD the said Tract or parcel of Land with its
appurtenances to the said Elizabeth Henry and her heirs forever, and the said
Archibald McGinnis and Mary his wife and their heirs will forever warrant and
defend the said Tract or parcel of Land with its appurtenances to the said
Elizabeth Henry and his heirs against the claims of all persons whatsoever In
Witness whereof the said Archibald Mcginnis and Mary his wife hath subscribed
their names and affixed their Seals the day and year above written.

and James Anderson of the other part both in the county of Washington and
Commonwealth of Virginia.
WITNESSETH as followth, that the said Elizabeth Henry for and in consideration
of the sum of seventy pounds current money of virginia to the said Elizabeth
Henry, in hand, paid by the said James Anderson the receipt whereof the said
Elizabeth Henry doth hereby acknowledge, the said Susannah (sic) Henry hath
Granted bargained and sold and by these presents doth grant bargain and sell to
the said James Anderson and his heirs one certain Tract or parcel of Land
containing one hundred and thirty acres be the same more or less being part of
two different Tracts Viz one of four hundred acres and the other of one hundred
and fifty seven and Granted to John Bowles deceased by Patents bearing date the
seventh day of May 1785, the other the second day of November 1793, both Tracts
lying and being the county of Washington on the North side of the middle fork of
Holstein River, bounded as followeth, to wit

James Monroe, Esquire Governor of said Commonwealth and the lessor seal thereof
bearing date the 27th day of November A.D. 1800, by metes and bounds in said
patent mentioned and particular described, did grant unto them the said
Elizabeth Henry, Robert Henry and Charles Henry four hundred acres of land
situate in spring creek a branch of Holstein river in the county of Washington
aforesaid. And Whereas a division of said land has taken place and the herein
after mentioned and described part of said tract of land has fell to the share
of said Charles Henry and his full portion and share to the same, and which he
the said Charles Henry did sell and make oven unto the said william Hickay and
his heirs some time heretofore. And Whereas no deeds or instruments of writings
heretofore have been made between them the said Elizabeth Henry Robert Henry &
Charles Henry for the division of said land.
Now this Indenture Witnesseth that they the said Elizabeth Henry, Robert Henry
and Charles Henry for and in consideration to make partition of said land as
also for and in consideration of the sum of two hundred and fifty pounds lawful
money of Virginia, to the said Charles Henry in hand paid by the said William Hickay at and before the ensealing and delivery hereof the receipt whereof is
hereby acknowleged by the said Charles Henry Have granted, bargained and sold
and by these presents do grant, bargain & sell unto the said William Hickay, his
heirs and assigns out of the aforementioned tract of land by said patent
granted; the following described Tract, piece & parcel thereof
(To wit) BEGINNING at a stake within one pole of the western band of spring
creek thence by patent line S 69° West (but by -------?--- fine S 56° 40° 11)
seventy four poles to a white oak and hickory on the south side of a Knobb
thence with a line of Samuel McChesney south 57° E 233 poles to a poplar and
white oak, then leaving said line N. 37 East 80 poles to a white oak N. 47 E. 78
poles to a spanish oak and hickory by a hollow N. 70°E 45 poles to a black -?-
stump one 2 w. -?- N 48° E. 36 to a white -?- on a ridge N. 30° E 140 poles to a
large white oak near a sink hole and N. 61° W 11 poles to small hickory (thus
far the courses are by patent and the courses for division, by the per---?--
porch on the maquitical needle are ) from thence by the land of said Robert
Henry south 61° West 246 to a locast post S. 20° # 18 poles 5 feet to a locust
post south 80° West 100 poles to a locust stake in a land then N. 20° W 28 poles
to a white -?- N 43°/2 W 17.3 poles to a rock N. 19° E. 2.5 poles to a small
buckeye N. 12°E to a mark in a rock at the head (and near the middle) of a
spring, then through the middle of the spring house and down the spring stream
S. 54° W. 6 poles & 9/10 crossing a branch to a maple then N. 84° W. 21 poles
crossing siad branch & spring creek to a post on the western bank of said spring
creek then with a straight line about one pole to the place of BEGINNING.
Together with all and sigular the appertenances thereunto belonging or in any
wise ----?--. And the revisions and remainders thereof. To have and to Hold the
above described tract piece or parcel of land, hereditaments and premises hereby
granted with its appurtenances to him the said William Hickay his heirs and to
the only proper use and behoof of him the said William Hickey, his heirs &
assigns assigns forever. And they the said Elizabeth Henry, Robert Henry and
Charles Henry do hereby covenant promise and grant (separately but not jointly)
to and with the said William Hickay his heirs and assigns that they the said
Elizabeth Henry Robert Henry & Charles or either of them (separately) or their
of either of them heirs, executors, or administrators (separately) the above
described against all person or persons whomsoever lawfuly claiming or to claim
shall & will Warrant and forever defend by these presents In Witness whereof

In the Name of God Amen. I, Elizabeth Henry of Washington County,
Virginia, wife of Samuel Henry Dec.d being very sick & weak in body but
of perfect mind & memory thanks to be given to god calling to mind the mortality
of my body & knowing it is appointed for all overt to Dec. to make & ordain this
my last Will & Testament that is to say principally & first of all I give &
recommend my soul into the hands of a ---?-- God that give it & my Body I
recommend to the earth to Be buried in a Decent christian manner at the
direction of my executors and as touching such worldly estate wherewith it has
pleased God to bless me within this life, I give devise & dispose of the same in
the following manner & form. First, I give & bequeath to my son and son in law
James Henry & Hugh Magill the prices of my Negro woman named Fann when sold to
Be equally Divided between the. Also, I give to James Henry my son & my other
son in law William Magill the Bonds that I have against John Kincaid of Kentucky
the father of Robert Kincaid of Washington County Virginia. I give my Daughter
Jane Henry a negro Child named Fern also a Brown horse colt & a washing kettle
also all my cubboard articles except one large earthen Dish which I leave to
Sarah Magill. Also I give my son James Henry one fether Bed & Bedcloths and my
Daughter in law Margaret Henry the Bed I lie on & the Bedclothes. I give my body
cloths to my three Daughters & Daughters in law to be equally divided in four
parts. I Give to my Grand Daughter Betsy Magill one red heiffer. I also give to
my son Robert Henry a entry of one hundred acres of land adjoining his place &
he is to pay his brother James what is reasonable when he obtains a good title
for the land. likewise I give my son Robert Henry the roan horse. I give to my
son Charles Henry the sum of two Dollars in Cash. And I also make & ordain my
sons Robert Henry & James Henry the sole executors of this my last Will &
Testament & I do hereby utterly disallow revoke & Disannul all & every the
former testaments wills legacies bequests & executors By me in any wise before
named willed or bequeathed -----?----- & confirming this & no other to be my
last Will & testament. In witness whereof I have hereunto set my hand and seal
this eighteenth day of November in the year of our Lord one thousand and eight
hundred & seven & the thirty first year of the independence of North America.

This last Will & Testament of Elizabeth Henry Dec.d was produced in Court
& proven by the oath of John Carson subscribing witness thereto who also made
oath that he saw Alexander Maxwell now deceased sign his name thereto as a
witness in the presence of the Testatrix & at her request. Thomas Maxwell being
sworn says that he believes the name Alexander Maxwell subscribed to the said
Will as a witness is the proper hand writing of Alexander Maxwell now deceased.
It is therefore ordered that the said Will be recorded. And on the motion of
Robert Henry one of the Executors prescribed by law & entered into &
acknowledged his bond with Thomas Maxwell & John Woods securities in the sum of
one thousand five hundred dollars conditioned as this Law directs. A Certificate
is therefore granted him for the probate of the said Will in due form.
