  • [WardOliverFile1.FTW] Charlotte County, Virginia Will Book I, pp106-107 In the Name of God Amen, thirtieth day of March in the year of our Lord one thousand Seven hundred and Seventy three, I James Grigg of the Parish of Cornwall and County of Charlotte being very sick and weak of body but of Perfect mind and memory thanks be God, therefore calling to mind the Mortality of my body and knowing that it is appointed for all men once to die do make & ordain this as my last will and Testament, that is to say Principally that first of all I give & commend my soul unto the hand of Almighty God that gave it and my body to the Earth to be buried in a decent manner, nothing doubting but at the ressurection I shall receive the same by the Power of God, and as touching my worldly Estate which it has Pleased God to bless me with in this life- I give demise & Dispose of the same in the following manner, first of all it is my will & desire that my Just Debts be paid in the following manner Viz that my Executors sell all the Land that I now Possess likewise a negro fellow named Abram, also it is my will & desire that after my Just debts is paid that the money over and above arising from the aforementioned Sales be laid out on a tract of land at the descretion of my Executors- also it is my will and Desire that my wife Possess my whole Estate 'til my Daughter Patty Grigg arives to the age of eighteen or marry's- also it is my will and Desire that after my oldest Daughter Patty Grigg shall arrive to the age above mention'd or shall marry that then my whole Estate both real and Personal shall be equally divided in three parts- Also I lend to my wife during her natural life one third of my Estate and after her decease to be equally Divided between my Daughters Patty Grigg and Katy White Grigg to them and their heirs forever. Also I give and bequeath to my Daughter Patty Grigg one third of my Estate above mentioned to her and her heirs forever, Also I give and bequeath to my Daughter Katy White Grigg one third of my Estate above mention'd to her & her heirs forever, Also I do appoint John White, Samuel White, & Mary Grigg my whole & Sole Executors & Executrix of this my last Will and Testament, and I do hereby utterly disavow & revoke and Disannul all and every other form or Testaments, Wills Legacys Bequests & Executors by me in any ways beforementioned or named, Will'd and Bequeath'd, Ratefying & Confirming this & no other to be my last Will and Testament. In Witness whereof I have hereunto Set my hand & Seal this day and year above written. James Grigg Signed, Sealed, Published, Pronounced and Declaired by the said James Grigg is his last Will and Testament in the Presence of us the Subscribers, Thomas Harlee Jun., Cutbirth Williamson, William White. At a Court held for Charlotte County the 5th day of October 1773. The within written last Will and Testamemt of James Grigg dec'd was exhibited in Court by John White, Samuel White, and Mary Grigg the Executors & Executrix therein named and the same was Proved by the oath of the three witnesses hereto Subscribed to be the Act and Deed of the said James Grigg and was Recorded on the motion of the said Executors & Executrix who made oath according to law Certificate for obtaining Probate of the said Will in due form is granted them they giving Security whereupon they together with William Price and Thomas Carter Gent. Their Securities, entered into & Acknowledged their bond according to Law for that Purpose.
