  • [WardOliverFile1.FTW] Charlotte County, Virginia Will Book 13, pp 399-400 In the name of God Amen I William White do make this my last will and testament In the first place I direct the payment of all my just debts and funeral expenses. Then I give my beloved wife Mary M. White as dower one third part of my tract of land on cub creek or less if she thinks it proper to take it two choice negroes my riding carriage two choice horses or mules as much of my Stock of cattle Sheep and hogs as she may think proper to take also a full supply of corn fodder oats wheat and pork for one years use one half of my household and kitchen furniture and such plantation tools as she may need all the above property to be held by my beloved wife during her natural life and at her death to be equally divided between Elizabeth P. Armistead Mary J. Ford and Sally L. Thorn- ton except the land which is to go John M. and David H. White Item 2 I give to my two sons John M. White and David H. White my tract of land on Cub Creek on which I now reside and the tract occupied by David H. White also the tract on the waters of Beaver dam tract containing 345 acres to be equally divided between them then the dower of my wife is to be taken out of the Cub Creek tract - Item 3 I give to my son John M. White one choice negro and then to my son David H. White one choice negro Item 4 I give to my two grandsons William Beverly White and Henry M. White each the sum of three hundred dollars to be paid to them out of the money which may be due my Estate from crops or other property to be sold by my Executors- Item 5 All the rest and residue of my Estate of every des- cription I direct to be equally divided among my three daughters Eliz- abeth P. Armistead Mary J. Ford and Sally L. Thornton in this division Elizabeth P. Armistead is to account for the sum of fourteen hundred dollars already advanced to her in property and any further advancement made to either is to be accounted for in a division and any and all property which my said daughters may receive under this Item or under the first Item of this my Will shall be held by each during her natural life and at her death to go to her children I intend to include in this the 5 Item of my Will all money which may be due me by bond or otherwise to be divided amongst my daughters as above stated. The money arising from the sale of my crops stock & any from debts due me shall constitute a fund for the payment of my debts and the payment of the specific legacies to William Beverly and Henry M. White the residue is to be divided as here- in before directed for the first provision of this my Will directing the payment of my debts. I acknowledge a debt of Six hundred and sixty dol- lars to be paid by me at the death of my wife for two small negroes we received from the property held by us under the will of James McCargo dec'd I hereby constitute and appoint my two sons John M. White and David H. White Executors of my Will In witness whereof I have hereunto set my hand and seal this 14th day of Feburary 1859 Signed and acknowledged in our presence William P. White (seal) all of us being present at the same time Thos Pugh A. Bailey T.P. Middleton H.S. Daniel I William P. White do make the followimg codicil to this my Will all the legacies and property of any description given to my daughter Mary J. Ford I direct to be placed in the hands of John M. White and David H. White as trustees for the benefit of my said daughter Mary J. Ford to be held by them for the natural life of the said Mary J. Ford to be used for the benefit comfort and support of the said Mary J. Ford and her children the said trustees may use the said property as they in their judgement deem most judicious for the comfort maintainance and support of the said Mary J. Ford and her children including the education of the said child- ren the said John M. White and David H. White shall hold the said prop- erty and legacies as above stated foregoing the claim or control of Abner D. Ford the husband of the said Mary J. Ford or any future husband not to be liable for the present or future contracts of the husband of the said Mary J. Ford and at the death of the said Mary J. Ford all of the said legacies or property which may then remain shall be equally divided amongst the children of the said Mary J. Ford. I give to my grandson Henry White my Rifle and to my grandson Beverly White my Shotgun single barrel In witness whereof I hereto set my hand and seal this 30th day of May 1861 Witnesses William P. White (seal) Tho Pugh A. Bailey A.I. Middleton Math W. Jackson At a court held for Charlotte County the 4th day of July 1863 The foregoing last will and testament of Wm P. White dec'd with a codicil annexed was this day produced in court by John M. White and David H. White the executors therein named and the said will and codicil were proved by the oaths of Thos Pugh A. Bailey A.I. Middleton and H.S. Daniel the subscribing witnesses hereto and ordered to be recorded and on the motion of the said John M. White and David H. White who took the oath of office and together with Thomas Pugh Andrew Bailey A.I. Middleton and Thomas I. Thornton his securities deemed sufficient by the court entered into and acknowledged a bond in the penalty of fifty thousand dollars conditioned for the due and faithful discharge of the duties of their said office or trust a certificate is granted them for obtaining a probat of the said will in due form.
