Will of Barbara CLEMOW, St Allen, Cornwall: 1789

Probate granted 13 January 1789, St Allen

In the name of God Amen. I Barbara Clemow of the parish of Saint Allen in the County of Cornwall Widow considering the uncertainty of this mortal life and being of sound mind and memory, blessed be almighty God for the same. Do make and publish this my last will and testament in manner and form following that is to say –

First I recommend my soul into the hands of Almighty God in full hopes of obtaining pardon for my sins through the merits of my blessed Savior Jesus Christ. As to my worldly goods and effects I dispose thereof in the following manner.

Also I give and bequeath to William Searle of the parish of Saint Austle in the said County Yeoman all that tenement with the appurtenances called Trerice situate in the said parish of Saint Allen and which I now hold under a lease granted by the late Hugh Lord Viscount Falmouth to have and to hold the same premises and every part and parcel thereof with the appurtenances unto the said William Searle his Executors Administrators and Assigns for and during all my estate and interest therein.

Also I give and bequeath unto John Thomas of Chiverton Esquire and William Hodge of Calestock in the parish of Perranzabuloe Gentleman both in the said County of Cornwall my Executors herein after named all that tenement called Tolgrogan situate in the said parish of Saint Allen with the appurtenances of which I now hold under a lease from ....? Prideaux Esquire / To have and to hold the said last mentioned tenement with the appurtenances unto the said John Thomas and William Hodge and the survivor of them his Executors and administrators for and during all my estate and interest therein in trust never the less and to and for the several uses trusts, interests and purposes hereinafter mentioned that is to say in trust and to and for the use of Richard Straight son of Richard Straight the Younger of the parish of St Erme in the said County Yeoman his Executors Administrators and Assigns subject never the less to the charge thereon hereinafter mentioned

And I do hereby direct the said John Thomas and William Hodge to assign the said Tenement of Tolgrogan to the said Richard Straight the son on his the said Richard Straight the son’s attaining his age of twenty one years. Subject never the less to the charge thereon herein after mentioned that is to say in the mean time and until the said Richard Straight / the son / shall obtain his full age of twenty one years my will and desire is that the said John Thomas and William Hodge and the survivor shall and do pay a moiety of the clear yearly rent of the said estate unto the said Richard Straight the younger/ the Father/ during his said son Richard’s minority in case the said Richard Straight the father shall so long happen to live. And I do hereby order and direct that the said Richard Straight the son shall yearly and every year after he shall have attained his said age of twenty one years pay of cause to be paid unto the said Richard Straight his father a moiety of the clear rent of the said estate called Tolgrogan after all charges and outgivings are paid during so many years of the remainder of the term and interest in the said estate as the said Richard Straight the father shall live.

Also I give devise and bequeath unto Jane the wife of Richard Bishop of the parish of St.Erme aforesaid Yeoman all that my copyhold estate called Victor’s Tenement situate in the said parish of Saint Allen / which lately has been surrendered to my use/ to have and to hold the same with the appurtenances unto the said Jane Bishop her Executors Administrators and Assigns during all my estate and interest therein.

Also I give and bequeath to Susannah the wife of Edward Rickett [sic Rickard] of the parish of St.Erme in the said County Yeoman one moiety of all that tenement called Polmest situate in the parish of Philleigh in the said County which I now hold under a lease from Christopher Hawkins, Esquire To have and to hold the same with the appurtenances unto the said Susannah Rickett her Executors Administrators and Assigns for and during all my estate and interest therein.

Also I give and bequeath the other moiety of my said Leasehold Tenement call Polmest unto William Bishop of the parish of Newlyn in the said County Yeoman To have and to hold the same with the appurtenances unto the said William Bishop his Executors Administrators and Assigns for and during all my estate and interest therein.

Also I give devise and bequeath unto John Searl of the parish of Crantock in the said County Yeoman father of Simon Searle of the same parish Yeoman. All that my Freehold Messuages Tenement called Trefell situate in the said parish of Newlyn with it’s Rights Members and Appurtenances to have and to hold the said Freehold premises with the appurtenances unto the said John Searl his heirs and assigns forever.

I give and bequeath unto William Magor and Grace Magor of the said parish of St Allen son and daughter of Thomas Magor of the same parish Yeoman all that tenement called or know by the name of Trolosan (?) situate in the said parish of Philleigh which I now hold under a lease from Sir James Laroche, Baronet to have and to hold the same with the appurtenances unto the said William Magor and Grace Magor and the survivors of them his or her Executors Administrators and Assigns for and during all my Estate and Interest therein.

Also I give and bequeath unto John Searle the younger son of the said John Searle the sum of twenty pounds to be paid him within twelve months next after my decease.

Also I give devise and bequeath all that messuage and tenement with all and singular the appurtenances commonly called or known by the name Blight’s Tenement situate lying and being in Trerew (?) within the aforesaid parish of Crantock, parcel of the customary lands of the manor of Cargoll unto the before named Simon Searle to hold to the said Simon Searle his Executors Administrators and Assigns according to the custom of the said manor for and during the estate and interest I now have or may have therein on condition never the less and it is the true intent and meaning of this my will that the said Simon Searle shall and do yearly and every year, out of the issues(?) and profits to arise and accrue for or in respect of the said messuage and tenement pay or cause to be paid unto his father the said John Searle three pounds during his natural life. And further shall and do pay or cause to be paid unto Sarah, Margaret, Mary and Elizabeth sisters to the said Simon Searl and daughters of the before named John Searl the respective legacies hereinafter particularized in the manner and form hereinafter expressed and mentioned.

Also I give and bequeath unto Mary Miners daughter of John Miners late of the parish of Laddock deceased the sum of one hundred pounds to be paid her when she shall attain her age of twenty one years or be married which shall first happen and in the mean-time I do hereby direct my Executors to lay the same out at interest and to apply the interest and product thereof towards her maintainance and in case she shall die before she attains her age of twenty one years unmarried, then I give the said sum of one hundred pounds to her brother William Miners to be paid him in like manner as the legacy of fifty pounds hereinafter given to him.

Also I give and bequeath unto the said Mary Miners all my cloaths and wearing apparel of every kind and sort whatsoever and I request and desire the said William Hodge one of my said Executors to take the said Mary Miners immediately on my death to live with him till she attains the age of twenty one years or is married fully persuaded that he will take great care of her and see that she is brought up in a proper manner and I do desire that the said William Hodge be made a reasonable satisfaction for his trouble in the taking care and providing for her till such a time as she attains her age of twenty one years is married as aforesaid.

Also I give and bequeath unto the said William Miners the sum of fifty pounds to be paid into the hands of my Executors and by them to be laid out in such manner as they shall judge most proper for his maintainance and in case he shall die before he attains his age of twenty one years I give and bequeath the said sum of fifty pounds or so much thereof as shall then remain in the hands of my Executors to his sister Mary Miners to be paid unto her in the same manner as the legacy of one hundred pounds given unto her as aforesaid and in case the said Mary Miners shall die before she attains the age of twenty one years or be married, then my will is that the sum of one hundred pounds before bequeathed to her shall lapse(?) and be given to her said brother William Miners.

Also I give and bequeath unto Sarah, Margaret, Mary and Elizabeth Searl the daughters of the said John Searle / and to each of them the sum of twenty pounds when and as they shall severally attain their ages or age of twenty one years with benefit of survivorship in case any or either of them shall happen to die before she or they shall attain their respective ages of twenty one years. And I hereby direct that the legacies or legacy of such of them as shall have attain her or their age or ages of twenty one years at the time of my decease shall be paid to her or them within twelve months next after my decease.

Also I give and bequeath unto Elizabeth Bishop of the parish of Newlyn in the said County – Widow the sum of thirty pounds to be paid her within twelve months next after my decease.

Also I give and bequeath unto Barbara the daughter of the before named Edward Rickett the sum of twenty pounds to be paid unto her within twelve months next after my decease.

Also I give and bequeath unto Richard Lanyon of the said parish of St Allen Yeoman the sum of one hundred and twenty pounds which said sum I hereby direct my Executors to deduct only the principal and interest that shall be due to me on his Bond or on any other Security at the time of my death.

Also I give and bequeath to Sarah, Jane, Isabella, Mary and John Lanyon daughters and sons of Henry Lanyon of the said parish of St Allen Yeoman the sum of thirty pounds equally to be divided between them share and share alike to be paid unto them or the survivor or survivors of them within twelve months next after my decease.

Also I give and bequeath unto Robert Vincent of the said parish of Crantock Yeoman the sum of one hundred and twenty pounds to be paid unto him within twelve months next after my decease.

Also I give and bequeath unto Jane, Mary and Elizabeth daughters of the said Elizabeth Bishop the sum of ten pounds each to be paid unto each of them within twelve months next after my decease.

Also I give and bequeath unto Elizabeth Benny of the said parish of Newlyn, widow; and to Jane the wife of John Roskilley of the same parish Carpenter the sum of five pounds and to be paid them within twelve months next after my decease.

Also I give and bequeath unto William, Thomas, John and Simon Straight sons of the said Richard Straight the younger the sum of twenty pounds each to be paid unto them respectively when and as they attain their ages or age of twenty one years with benefit of survivorship in case of the deaths of any or either of them before that period. And I do hereby direct my Executors herein after named to lay(?) the mine(?) out at [G----] and to retain the interest thereof in their hands for the use and benefit of the said William, Thomas, John and Simon Straight until they respectively become of age as aforesaid. And I do hereby impower my said Executors to lay out the whole of the said twenty pounds and the interest thereof or any part thereof at their discretion in apprenticing the said William, Thomas, John and Simon Straight or either of them out to Trades.

Also I give and bequeath unto the poor widows of the said parish of Newlyn that do not receive pay from the parish to be fixed upon by my Executors the sum of five pounds to be paid them in two payments To wit fifty shillings on the Christmas day next after my decease and the remaining fifty shillings the next day twelve months.

Also I give and bequeath unto ten poor widows of the aforesaid parish of St Allen of the description aforesaid the like sum of five pounds to be paid and distributed to them in like manner as the same is directed for feeding the poor of Newlyn parish.

Also I give and bequeath unto John Allen, Joannah, Michael Searle and Betsey, sons and daughters of Hannah Mitchell of the Borough of Truro (?) in the said County of Cornwall, widow the sum of ten pounds equally to be divided between them share and share alike as they shall respectively attain the age of twenty one years or be married with benefit of survivorship in case of the deaths of any or either of them before either of the said periods.

Also I give and bequeath unto Christopher the son of Richard Peters of the aforesaid parish of St Allen the sum of five pounds to be paid him at the expiration of four years after my decease.

Also I give and bequeath unto the before named Susannah Rickett wife of the said Edward Rickett of the aforesaid parish of St. Erme Yeoman all my household goods of every kind and sort whatsoever that I may die possessed of.

Lastly All the rest & residue and remainder of my goods, chattles, estates and effects whatsoever and wheresover lying and being of what nature kind or sort soever both real and personal I give devise and bequeath unto and amongst William Searl son of William Searl of the said parish of Crantock Yeoman deceased Simon Searl son of the before named John Searl and Richard Straight son of the said Richard Straight the younger equally. Equally to be divided between them share and share alike and I do hereby direct by Executors and [----] retain in their bonds the said Richard Straight’s share of the residuum of my said effects and to lay the same out at interest and to pay the same together with such interest as may be made thereof unto the said Richard Straight the son on his attaining his full age of twenty one years and not before. And I do hereby nominate constitute and appoint the said John Thomas of Chiverton Esquire and the said William Hodge of Calestock Gentleman Executors of this my last will and testament. In trust to see the same duty performed and I do hereby declare that neither of my said Executors shall be answerable for more monies than they shall actually receive nor shall they be answerable for the loss of failure of any security or securities that may be bad or taken by virtue of or on account of executing the trust hereinbefore mentioned.

And I do hereby impower my said Executors to reimburse themselves and himself out of the residuum of my estate and effects. All such loss costs damages and expenses as they or either of them shall or may sustain or reasonably expend and be just to in executing the several trusts herein before mentioned. In witness whereof I the said Barbara Clemow have to this my last will and testament contained in [?] sheets of paper to the first six sheets from No 1 to No 6 numbered progressively with the letters A.B.C.D.E.F. put my mark and to the six sheets thereof my mark and seal this twenty fourth day of October in the year of our Lord one thousand seven hundred and eighty eight.
