Will of Robert SHEAVYN, Ticknall, Derbyshire: 1728

Probate granted 9 April 1728, Lichfield

In the name of God Amen I Robert SHEVYN of Ticknall in the County of Derby Mercer being of sound Mind & manner Do make this my last Will and Testament as followeth

Imprimis:  I Recommend my soul to Almighty God who gave it Trusting through ye meritts and Intercession of my Saviour Jesus Christ to Inheritt Eternal Life And my Body I comitt to ye Grave to be decently Buried In Ticknall Churchyard six feet deep in ye Earth at ye Discretion of my Execut's and Executrix here after named. And as for my Worldly Goods - I dispose of them as followeth That is to say

I give Devise and Bequeath unto my Beloved wife during her Naturall Life & whilst a Widow all my Estate Houses and Lands lying and being in Ticknall aforesaid (Except such Lands and House as I shall afterwards mention to be sold) and I give my wife full power to sell the same towards paying my Just debts and Three Legacies, and no other Legacies to be paid till after my wives (sic) Decease. I give unto my Beloved wife all my personall Estate of what kindsoever, shee paying my Funerall charges Just Debts and Three Legacies.

After my wifes Decease or marriage I give unto my son Samuell SHEVYN at Thornton During his Naturall Life my now dwelling House in Ticknall with ye Barn Stable and Back Side which I Bought off Mr FARNILL of Seal. I give unto my son Samuell SHEVYN Three Half Acres of Land lying in the Little Field commonly call'd Wards Nook. But then my son Samuell SHEVYN shall pay to my daughter Sarah SHEVYN Twenty Pounds. And to my daughter Mary SHEVYN Tenn Pounds.

After ye decease of my son Samuell SHEVYN I give unto his wife Mary SHEVYN the said Estate during her Naturall Life And after her Decease I give unto my son Samuell SHEVYNs son or Daughter, lawfully begotten, ye said Estate to Dispose of as he or she shall think Proper for ever.

In case my son Samuell SHEVYN hath no son or Daughter lawfully begottten att his Decease then I give unto my son Robert Arme (Orme) SHEVYN and his Heirs male or female ye said Estate for ever

And in case my son Robert Arme (Orme) SHEVYN dies leaving no son nor Daughter lawfully Begotten Then I Give unto my ffive Daughters, Elizabeth BAGGERLY, Ann SMITH, Sarah SHEVYN, Mary SHEVYN & Martha SHEVYN the sd Estate for Ever to be Equally Divided amongst them Share and Share alike

But his wife ye Estate during her Life I give unto my son Robert Arme (Orme) SHEVYN the House and Croft commonly called Birds Yard and likewise one Beats pasture in Three Fields which I bought off Mr PIERSTON (?) he paying to my daughter Mary Tenn Pounds

Also I give ffive Pounds to my Grandson Matthew SMITH and ffive pounds to my Grandson John SMITH. I give unto my son (sic) John SMITH and his Heirs for ever a Hade (?) End Lying below the Rhode next to BANTONs garden.

I give unto my son Samuell SHEVYN and unto my son Robert Arme (Orme) SHEVYN about five or six Acres Land be ye said more or less share and share alike Lying in Three fields to Dispose of as they think fit for Ever. But then out of this ffive or six acres Land my son Samuell SHEVYN shall pay to my daughter Martha SHEVYN Twenty Pounds, And to my Daughter Elizabeth BAGGERLY Ten Pounds. And my son Robert Arme (Orme) SHEVYN shall have the whole of his share without any Deduction.

In case one or more of my Daughters die before ye Legacies I left them become due to be paid, then as many of my Daughters as living shall have amongst them share and share alike what legacies was left to ye Deceased when alive.

The Broomhill Close and two parts of a House called MARROTS House and a Close lying at ye LEAS Gate I give to my Beloved wife off all Power to sell, Forty Pounds of ye money Iwould have paid to Mr BIRD in Nottingham and Twnty Pounds to Mr FULLARD in Melbourn, Tenn Pounds to my Daughter Elizabeth BAGGERLY, to my Godson Matthias SHEVYN five shillings And unto my God Daughter Elizabeth BROWN ffive shillings. These Debts and three Legacies my Desire is to be paid in one year after my Decease.

And I do make an Appoint my Exects and Executrix, my Beloved Wife Sarah SHEVYN And my two sons Samuell SHEVYN and Robert Arme (Orme) SHEVYN Exects and Executrix of this my Last Will and Testament

And I do hereby Revoake all former wills whatsoever by me made

In Witness whereof I the sd Robert SHEVYN have hereunto put my Hand and Seale the Twenty ffourth day of Feby in ye first year of ye Reign of his present Majestie King George the Second over Great Britain and in ye Year of Lord God One Thousand Seven Hundred & Twnty seven

Sign'd Sealed Published & Declared by ye above named Robert SHEVYN as and for his last Will & Testament in ye presence of us who have subscrib'd our names as Witnesses thereto in his presence
