In the name of God Amen I Robert Orme SHEAVYN of Ticknall in the County of Derby Grazier being weak of Body but of sound Mind Memory & Understanding Do make & Ordain this my last Will and Testament in manner following I Give and Devise to my Daughter Elizabeth SMITH the full Quantity of twelve Statute Acres of Land out of my Freehold Estate at the Knowlhills and that the Inclosure with the Pit in it next the Town of Ticknall to be part of said twelve Acres and another Inclosed Part next the Knowlhills to be the other part of the said twelve Acres, and in Case those two Inclosures should be found to exceed twelve Acres the over Measure to go & enlarge the Third Inclosure next Mr Hill's Allotment. And in Case the two first mentioned Inclosures should not be in measure twelve Acres, then in that Case there shall be taken out of the Third Inclosure adjoining Mr Hill's Allotment so much Land as with the two first mentioned Inclosures will make twelve intire (sic) Statute Acres Also I give and Devise to my said Daughter Elizabeth SMITH a House and the Croft above it up to John STEPHENSON's called Bird's House & Croft with every appurtenance there to belongin (sic) To Hold all & every the aforementioned premises to my said Daughter for her Heirs and Assigns for Ever I give and Devise to my Grandson Robert SMITH all the rest and residue of my said Estate at the Knowlhills which shall be found above twelve Acres be that Quantity what it may To Hold to him the said Robert SMITH his Heirs and Assigns for Ever I give & Devise to my son in law Thomas BUCKNALL two Houses next the Street one in the Tenure of Robert MUMFORD & the other converted into a Bakehouse. Also I give him the Chandling Shop with the whole of the Garden in which it stands. Also I give him those two Crofts above the Gardens, one butting against Isaac HILL's Premises the other adjoining it, down to a line to be drawn from Isaac Hill's wall across to Hartshorn School Land. Also I give him all my share in a House now in the tenure of Christopher FORBOURNE with the Croft thereto adjoining, All which premises I give to my said Son in Law Thomas BUCKNALL To Hold to him his Heirs and Assigns for Ever. My Freehold Close called the Broomhill Close I order to be Sold by my Executors to the best Bidder so soon after my decease as conveniently may be & the Money arising from the Sale thereof to be dispos'd of as follows I give & bequeath to my Grandson Thomas BUCKNALL the sum of Twenty Pounds out of said purchase money. And to my Grandson John BUCKNALL the sum of Fifteen Pounds. And to my Grandson John SMITH the sum of Ten Pounds. And to my five GrandDaughters Daughters of my son in law Thomas BUCKNALL the sum of Two Guineas to each of them, to buy them Mourning or otherwise as they like. And to my Great Grand Daughter Ann Daughter of Thomas BUCKNALL Junr the sum of Two Guineas. And if the purchase Money will so far exceed the above Legacies as to pay William LANCELOTT the sum of Ten Guineas with the Interest I will & order it to be done, having Borrowed that sum of him. And should the purchase Money still extend further I give it to my Daughters Elizabeth SMITH & Mary BUCKNALL towards the payment of my further Debts & Legacies. I give & Devise to my said Daughter Elizabeth SMITH All that part of my now Dwelling House which I use & Occupy with all & Singular the Goods & Utensels (sic) therein of every Nature & Kind whatsoever To Hold to her her Heirs & Assigns for Ever. I give & Devise to my DaughterMary BUCKNALL All that other part of my Dwelling house which she & her Family now lives in Useth & Occupies with All & Singular the Goods & Utensels (sic) therein contained of every Nature & Kind whatsoever To Hold to her her Heirs & Assigns for Ever. I give & Devise to my said Daughter Elizabeth SMITH & my Son in Law Thomas BUCKNALL All the rest of my Homestead, jointly & Equally between them Namely my Foldyard Barns Stables Hogsty's & Rickyard for the equal Use & Accommodation of both Parties. And I give between them equally the whole of my Garden & Orchard & the bottom part of the Croft above adjoining up to a level with Isaac HILL's wall To Hold equally between them or in case it be thought most agreeable, to part the same to the satisfaction of both. And To Hold the same to them their Heirs & Assigns for Ever. Also I bequeath to my said Daughter Elizabeth SMITH & my Son in Law Thomas BUCKNALL the whole of my live Stock & the whole of my Crops growing & gathered for the purpose of payment of the following Legacies my further just Debts & funeral Expenses. I give & bequeath to Francis SMITH of Melbourne the sum of Three Pounds. I give & bequeath to Thomas PERKINS of the same place the sum of Two Pounds. And to John SMEDLEY the sum of One Pound. Each being Ministers of the Gospel. I give & bequeath to my late servant Hannah LEICESTER of Melbourne the sum of Two Pounds. I give & bequeath to my Son in Law James WORSTAL of Ashby de la Zouch the sum of Ten Pounds. I give & bequeath to my poor Sisters & Brothers the sum of two pounds to be distributed by my Executors as they shall think proper. All which Legacies I order to be paid in twelve Months after my decease. I bequeath to my Grandson John SMITH All my wearing Apparel of every sort. Lastly I nominate and appoint Francis SMITH & Richard LEICESTER both of Melbourne Executors of this my last Will & Testament to see the particulars of it executed according to my Directions herein mentioned hereby revoking all former Wills and declaring this to be my last In Witness whereof I have hereunto set my Hand and Seal this Sixteenth day of September One Thousand Seven Hundred & Ninety one Sign'd Sealed Published & Declared by Robert Orme SHEAVYN the Testator for & as his last Will & Testament in the presence of us who have subscrib'd our names as Witnesses thereto in his presence & in the presence of each other Signed: Robert Orme SHEAVYNWitnesses: John SIMPSON Isaac HILL Willm LANCELOTT
