Will of William WALTON, Langley Mill, Sutton Coldfield, Warwickshire: 1780

Probate granted 4 August 1780, Lichfield

In the name of God Amen I William WALTON of the Parish of Sutton Coldfield in the County of Warwick, Miller being infirm in body but of sound and disposing mind and memory (Praised be to God for the same) Do for the better setting of my Affairs and preventing all disputes Make Publish and Declare this my last Will and Testament in manner and form following (that is to say)

First I will and direct that all my just debts and Funeral expenses shall be fully paid satisfied and discharged as soon as conveniently may be after my decease and I charge all my real and personal Estates with the payment thereof and subject thereto

Item   I give and bequeath unto my grandchildren, sons & daughters of my son-in-law James THOMPSON (that is to say) I give and bequeath unto my grand-daughters Mary THOMPSON   Sarah THOMPSON   &  Ann THOMPSON the sum of Twenty Pounds apiece to be paid to them within twelve months after my decease

Item   I give and bequeath unto my grandsons and Daughters Rachel THOMPSON   Elizabeth THOMPSON Rebecca THOMPSON    James THOMPSON   Eleanor THOMPSON    John THOMPSON   &   Jane THOMPSON the sum of Twenty Pounds apiece to be paid to them twelve months next after my decease if they shall have respectively attained their full age of twenty one years and if not then within twelve months next after they shall so have attained their said ages of twenty one years

But my mind and Will is and I do hereby direct that in case any of my said grandchildren shall happen to die before he she or they shall have arrived at their age of twenty one years that the legacy or legacys of him her or them so dying shall get and be paid to and amongst the survivor and survivors of them Equally share and share alike

Provided always nevertheless ~ I do hereby direct that in case my said Grand-Daughter Ann THOMPSON shall marry with John WARD son of Nicholas WARD of Hinckley in the County of Leicester then I give and bequeath unto my said Grand-Daughter Ann THOMPSON the sum of one shilling only in lieu and instead of in full satisfaction of the said legacy a sum of Twenty Pounds so by me before Given and Bequeathed to her as aforesaid

And in that case I give and bequeath the said legacy or sum of Twenty Pounds so Given and Bequeathed unto my said Grand-Daughter Ann THOMPSON aforesaid unto my daughter Mary THOMPSON But in case my said Grand-Daughter Ann THOMPSON shall marry with any other person but the said John WARD Then I give and bequeath to her the said legacy or sum of Twenty Pounds to be paid to her within twelve months next after my decease or upon such day of marriage in manner aforesaid ~ And I do hereby further Direct that in case my said Grand-Daughter Ann THOMPSON shall continue to be single or marry with the said John WARD that then and in either of the said cases the said legacy or sum of Twenty Pounds shall go and be paid to my said daughter Mary THOMPSON to and for her own use and Benefit

Item  I give and devise All that my Messuage Tenement and Dwelling House Croft Close pieces and parcels of Land Garden Backside and Premises with their and every of their Appurtenances situate standing lying and being at Little Sutton in the Parish of Sutton Coldfield aforesaid in the said County of Warwick and now in the several Tenures of Edward JOHNSON and John SHORE their Assigns or Under Tenants unto my grandson William THOMPSON his Heirs & Assigns forever

Item   As to all the Rest Residue & Remainder of my Real and Personal Estate whatsoever and wheresoever and of what nature kind or sort soever after payment of my just debts legacys and Funeral expenses as aforesaid I give devise and bequeath unto my son-in-law James THOMPSON his Heirs Executors Administrators & Assigns forever

And lastly I do hereby make nominate constitute and appoint my said son-in-law James THOMPSON and Mr John SNAPE of (Wishaw?) Executors of this my last Will & Testament hereby Revoking all former Wills by me at any time heretofore made

In Witness whereof I the said William WALTON the Testator have to this my last Will and Testament set my hand and seal the thirteenth day of April in the Year of our Lord One thousand seven hundred and seventy-eight

Signed Sealed Published & Declared by the said William WALTON the Testator as and for his last Will and Testament in the Presence of us who at his request and in the Presence of each other have hereunto subscribed our names as Witnesses

At Lichfield 4 Aug 1780: Let a Probate of this Will be Granted to James THOMPSON and John SNAPE the joint Executors therein named They being duly sworn before that the Deeds Personal Estate at the time of his death did not amount to the sum of five pounds Before me
